Construction Project Manager. The Construction Project Manager will have the following compliance responsibilities: 1 The term Contractor, as used in this document, refers to the Project construction contractor and includes any subcontractors, vendors or other personnel and entities acting on behalf of the Contractor. • Communicating project schedules and upcoming work activities to the Compliance Team • Communicating between the Compliance Team and the Construction Team • Reviewing and understanding field application of the requirements of the Certificate and other permits • Reporting unsatisfactory performance of the Contractor to the Compliance Team
Construction Project Manager. AGREES TO AND SHALL, TO THE EXTENT PERMITTED BY TEXAS LOCAL GOVERNMENT CODE §271.904, INDEMNIFY, AND HOLD THE CITY, ITS AGENTS, EMPLOYEES, OFFICERS, AND LEGAL REPRESENTATIVES (COLLECTIVELY, THE “CITY”) HARMLESS FOR ALL CLAIMS, CAUSES OF ACTION, LIABILITIES, FINES, AND EXPENSES (INCLUDING, WITHOUT LIMITATION, ATTORNEYS’ FEES, COURT COSTS, AND ALL OTHER DEFENSE COSTS AND INTEREST) FOR INJURY, DEATH, DAMAGE, OR LOSS TO PERSONS OR PROPERTY ARISING AS A RESULT OF CONSTRUCTION PROJECT MANAGER ’S AND/OR ITS AGENTS’, EMPLOYEES’, OFFICERS’, DIRECTORS’, CONSULTANTS’, OR SUBCONTRACTORS’ ACTUAL OR ALLEGED NEGLIGENCE OR INTENTIONAL ACTS OR OMISSIONS IN CONNECTION WITH ITS PERFORMANCE UNDER THIS AGREEMENT, WHETHER CONSTRUCTION PROJECT MANAGER IS IMMUNE FROM LIABILITY OR NOT. CONSTRUCTION PROJECT MANAGER SHALL INDEMNIFY AND HOLD THE CITY HARMLESS DURING THE TERM OF THIS AGREEMENT AND FOR FOUR YEARS AFTER THE AGREEMENT TERMINATES. THE INDEMNITY SHALL APPLY WHETHER OR NOT THE EVENT IS CAUSED BY THE CONTRIBUTORY NEGLIGENCE OF THE CITY.
Construction Project Manager the consultant, Swinerton Management & Consulting, retained by the District to serve as a point of contact in coordinating the District’s interests on this Project.
Construction Project Manager. As identified in the preamble of this Agreement and includes its successors and assigns, including a Certified Construction Manager (“CCM”), as required by the Construction Management Association of America (CMAA).

Construction Project Manager and COUNTY acknowledge that the Scope of Services does not delineate every detail and minor work task required to be performed by Construction Project Manager to complete the Project. If, during the course of the performance of the services included in this Agreement, Construction Project Manager determines that work should be performed to complete the Project which is in Construction Project Manager's opinion outside the level of effort originally anticipated, whether or not the Scope of Services identifies the work items, Construction Project Manager shall notify Contract Administrator in writing in a timely manner before proceeding with the work. If Construction Project Manager proceeds with said work without notifying the Contract Administrator, said work shall be deemed to be within the original level of effort, whether or not specifically addressed in the Scope of Services. Notice to Contract Administrator does not constitute authorization or approval by COUNTY to Construction Project Manager to perform the work. Performance of work by Construction Project Manager outside the originally anticipated level of effort without prior written COUNTY approval is at Construction Project Manager's sole risk.
