Contract Bar. Approval of this MOU by the Hemet City Council shall constitute a temporary bar to implementation of the provisions of Section 13(B)5 of the Employee-Employer Relations Resolution of the City of Hemet. The procedure for decertification of a recognized bargaining agent may be instituted and filed only during the period commencing one hundred and eighty (180) days from implementation and ending one hundred and fifty (150) days prior to the termination of this MOU.
Contract Bar. The recognition rights of the Tustin Municipal Employees Association shall not be subject to challenge for a period of not less than twelve (12) months following the date of recognition or until the expiration of this MOU, whichever is later; provided that recognition rights may be challenged between one hundred and twenty (120) and one hundred and fifty (150) days prior to the expiration of the MOU and that no MOU shall be construed to be a bar for a period of more than three (3) years. Existing Memoranda of Understanding shall remain in effect even when the recognition rights of employee organizations are changed in accordance with the provisions of this section.
Contract Bar. Except as provided in Section 1.3, requests for a representation election shall be denied during the term of an existing MOU.
