Common use of Court Appearance Clause in Contracts

Court Appearance. (a) In the event an Employee is required to appear before a court of law as a member of a jury, or as a subpoenaed witness in matters arising out of her employment with the Employer, the Employee shall: (i) suffer no loss of regular earnings for the scheduled workday(s) so missed; (ii) be paid at an amount equal to her average daily earnings at the basic rate of pay to a maximum of seven and one-half (7 1/2) hours for each day in attendance in court on a scheduled day of rest, and be granted an alternate day of rest as scheduled by the Employer. Such rescheduling of the day of rest shall not be construed to be a violation of the scheduling provisions of Article 7; (iii) advise the Employer upon receipt of notification of the date(s) requiring her attendance; (iv) if requested, provide proof of such attendance to the Employer. (b) In the event an Employee is scheduled to work on the evening(s) of the day(s) she is called as a juror, or witness in matters arising out of her employment with the Employer, she shall be granted a leave of absence without pay for those scheduled hours. (c) Where an Employee is required by law to appear before a court of law for reasons other than those stated in (a) above, she shall be granted a leave of absence without pay. The Employee shall advise the Employer upon receipt of notification of the date(s) requiring her attendance and provide proof if requested.

(a) In the event an a Regular or Temporary Employee is required by law to appear before a court of law for jury selection, as a member of a jury, jury or as a subpoenaed witness in matters arising out of her the Employee’s employment with the Employer, the Employee shall: (i) suffer no loss of regular earnings at the Employee’s basic rate of pay for the scheduled workday(s) shifts so missed; (ii) be paid at an amount equal to her average daily earnings at the Employee’s basic rate of pay to a maximum for the hours of seven and one-half (7 1/2attendance at Court on the Employee’s scheduled day(s) hours for each day in attendance in court on a scheduled day of rest, and be granted an alternate day day(s) of rest as scheduled by the Employer. Such rescheduling of the day day(s) of rest shall not be construed to be a violation of the scheduling provisions Article of Article 7this Collective Agreement; (iii) advise assign to the Employer upon receipt of notification of the date(s) requiring her attendance; (iv) if requested, provide proof of all pay for such attendance to the EmployerCourt appearance. (b) In the event an a Regular or Temporary Employee is scheduled to work on the evening(sevening or night shift(s) of and the day(s) she the Employee is called as required to appear before a jurorCourt for the reasons stated in (a), or witness in matters arising out of her employment with the Employer, she Employee shall be granted a leave of absence without pay for those scheduled hoursshifts so missed and shall suffer no loss of regular earnings at the Employee’s basic rate of pay. (c) Where an a Regular or Temporary Employee is required by law to appear before a court of law for reasons other than those stated in (a) above, she the Employee shall be granted a leave of absence without pay. The Employee shall advise the Employer upon receipt of notification of the date(s) requiring her attendance and provide proof if requested.

Such rescheduling of the day of rest shall not be construed to be a violation of the scheduling provisions of Article 7; (iii) advise the Employer upon receipt of notification of the date(s) requiring her attendance; (iv) if requested, provide proof of such attendance to the Employer26. (b) In the event an Employee is scheduled to work on the evening(sevening or night shift(s) of on the day(s) she is called as a juror, or witness in matters arising out of her employment with the Employer, or as a juror, she shall be granted a leave of absence without pay for those scheduled hoursshift(s) so missed at the basic rate of pay. (c) Where an Employee is required by law to appear before a court of law for reasons other than those stated in (a) above, she shall be granted a leave of absence without pay. The Employee shall advise the Employer upon receipt of notification of the date(s) requiring her attendance and provide proof if requested.

(c) Where an a Regular or Temporary Employee is required by law to appear before a court of law for reasons other than those stated in (a) above, she they shall be granted a leave of absence without pay. The Employee shall advise the Employer upon receipt of notification of the date(s) requiring her attendance and provide proof if requested.

(c) Where an a Regular or Temporary Employee is required by law to appear before a court of law for reasons other than those stated in (a) above, she they shall be granted a leave of absence without pay. The Employee shall advise the Employer upon receipt of notification of the date(s) requiring her attendance and provide proof if requested.

Such rescheduling of the day of rest shall not be construed to be a violation of the scheduling provisions of Article 7; (iii) advise the Employer upon receipt of notification of the date(s) requiring her attendance; (iv) if requested. An employee required to serve jury duty, or who is a witness as above, shall provide proof of such attendance appropriate documentation to the Employer. (b) In the event an Employee is scheduled to work on the evening(sevening or night shift(s) of on the day(s) she or the night shift commencing on the day(s) on which the Employee is called as a juror, juror or witness in matters arising out of her the Employee’s employment with the Employer, she the Employee shall be granted a leave of absence without pay for those scheduled hoursshift(s). (c) Where an Employee is required by law to appear before a court of law for reasons other than those stated in (a) above, she the Employee shall be granted a leave of absence without pay. The Employee shall advise the Employer upon receipt of notification of the date(s) requiring her attendance and provide proof if requested.
