Court of Protection. 4.14 The Home understands that in some cases, payment of fees may be delayed while a Court of Protection application is being processed. If this is happening for the Resident, it is important that a member of the Resident’s family notifies the Home in writing of the application’s progress and that a member of the Resident’s family makes arrangements to pay all outstanding fees in full once the application is finalised. The Home will have the right to charge interest under clause 4.11 above during any period in which fees remain unpaid. Furthermore, the Home is also entitled to recover in full from the Payer all legal fees, administration costs and other expenses incurred in relation to any such Court of Protection application or in relation to taking security by way of a charge over property in relation to sums payable under this Agreement or otherwise in respect of the Resident.

Court of Protection. The Court of Protection is the court which deals with issues relating to people who lack capacity to make specific decisions. The Court of Protection can make decisions or appoint Deputies in certain circumstances to protect people who cannot make particular decisions for themselves. Deprivation of Liberty Deprivation of liberty is a term used in the European Convention on Human Rights about circumstances when a person’s freedom is taken away. When a person lives in a care home or hospital and the person:  Lacks capacity to consent to the arrangements in place regarding their care and/or treatment  And is not free to leave should they choose to  And those treating or looking after the person are exercising complete and effective control over their care and movements That person is then considered to be Deprived of their Liberty. Deprivation of Liberty Safeguards (XXXX) Known as XXXX, these safeguards form part of the MCA 2005. They relate to Article 5 of the Human Rights Act 1998, the right to liberty and freedom. They apply to people who are 18 years of age or over and the arrangements must in the person’s best interests and be necessary to protect the person from harm.

Mental Capacity The ability of a person to make a decision or take an action for themselves at the time the action or decision needs to be taken, including those decisions that affect day to day life as well as more serious or significant decisions and decisions with legal consequences. Mental Capacity Assessment An assessment to determine whether a person lacks the Mental Capacity to make a decision or take an action in accordance with the Mental Xxxxxxxx Xxx 0000. Outcome In social care, an ‘outcome’ refers to an aim or objective a Resident would like to achieve or need to happen – for example, continuing to live in their own home, or being able to go out and about with Residents able to say which outcomes are the most important to them, and receive support to achieve them. Person Centred Care Ensuring the person is at the centre of everything the Provider does with and for them taking into account their individual wishes and needs, their life circumstances and health choices and have flexible systems, processes and a culture to achieve this. Quality Assurance A process to measure whether the Services are meeting the required Outcomes and contractual requirements.   • Whistleblower Protections The Party shall not discriminate or retaliate against one of its employees or agents for disclosing information concerning a violation of law, fraud, waste, abuse of authority or acts threatening health or safety, including but not limited to allegations concerning the False Claims Act. Further, the Party shall not require such employees or agents to forego monetary awards as a result of such disclosures, nor should they be required to report misconduct to the Party or its agents prior to reporting to any governmental entity and/or the public.

  • Foot Protection The Employer reserves the right to require the wearing of foot protection by employees. In such cases, the Employer will provide a safety device or, if the Employer requires the employee to purchase approved safety shoes, the Employer will pay an allowance, not to exceed the established contract price approved by the State Purchasing Division, during January of each year.
