TEACHER PROTECTION. A. The teachers shall have the right to review those things in his/her personnel file to which he/she is entitled by Law. At the option of the teacher, a representative of the Association may be present for such review. Each file shall contain a record indicating reviewer and date of review, excluding school personnel official access for record maintenance. B. The teacher may submit a written notation regarding any material and the same will be attached to the file copy of the material in question. If the teacher is asked to sign material placed in his/her file, such signature will be understood to indicate his/her awareness of the material but in no instance shall said signature be interpreted to mean agreement with the content of the material. X. Any serious complaint made against a teacher by any parent, student, and other person will be promptly called to the attention of the teacher. D. If a teacher is to be disciplined or reprimanded by the Board or its designee, he/she shall be entitled to have a representative of the Association present. That representative shall be the teacher's choice between the building representative or another Association officer. E. Each teacher has the responsibility for maintaining proper student control and discipline throughout the school day as well as at school-sponsored activities where he/she is serving as a sponsor or chaperone. The teacher, however, has the primary responsibility for maintaining control and discipline in his/her classroom. The Board will give reasonable support and assistance to teachers with respect to maintenance of control and discipline. Whenever is appears that a particular pupil requires special attention, reasonable steps shall be taken to provide such attention. The teachers recognize that all disciplinary actions and methods invoked by them shall be in accordance with established Board policy. F. Any case of assault upon a teacher which is related to a school-centered problem shall be promptly reported to the Board or its designated representative. If the assault was by a pupil or pupils, the Administration shall promptly investigate the matter and determine suitable discipline for the assaulting pupil. This decision shall be communicated to the teacher concerned. If the assault is by an adult, who is not a pupil, the Board its designee representative shall promptly report the incident to the proper law enforcement authorities. G. TEACHER PROTECTION. A. If a teacher, in connection with his employment, is subjected to assault or battery, he shall immediately report the incident and the circumstances to his Principal. The Principal shall forward the report to the Executive Director of Elementary/Middle or Secondary Schools, as appropriate, with a copy to the Union. B. A student involved in an assault on a teacher may be removed from the school by the Principal or other appropriate administrator in accordance with Board rules and State law. C. The alleged assault will be promptly investigated. The report of this investigation shall be forwarded to the Board and to the Union . The teacher has the right to have a conference with the appropriate Executive Director prior to a decision relating to the student’s placement in the school. If there is an objection to the placement decision, the teacher has the right to request a fair hearing. D. If the assault is by a pupil or a non-pupil and the teacher wishes to file criminal charges, the Principal or their appropriate staff will promptly report the incident to the proper law enforcement authorities. E. In either case (pupil or non-pupil), the Board agrees to cooperate with the teacher by complying with any lawful request by the teacher for information in the Board’s possession relating to the incident or the person involved. F. In cases involving an assault upon a teacher, the security officer shall, upon request of the teacher involved, provide the necessary advice and assistance including assistance in securing proper warrants, investigation of assaults, filing of juvenile petitions, calling for Police Department assistance, accompanying the teacher to court and sharing information relevant to the assault incident. G. If a teacher files criminal charges against a student, the student shall not return to the teacher’s class until after final determination of criminal charges. In any event, the Board shall attempt to place the student in another school pending final determination. In all cases the actions described herein are subject to the order and direction of appropriate judicial authority. H. A joint committee of three (3) Union representatives and three (3) Board representatives shall be established to study and propose responses to the issues of teachers’ personal property destroyed, stolen or damaged by students or others on school property, as a result of accident, vandalism or theft. TEACHER PROTECTION. The Board agrees that every certificated classroom teacher of the District shall have the right to freely join and support the Association for the purpose of engaging in negotiations and that it will not discriminate against any employee on the basis of membership, or participation in, or association with, the activities of the Association. The Association agrees that it will, without discrimination, represent all certificated employees, except the Superintendent, principals, and assistant principals, for purposes of negotiations, without regard to membership or participation in the Association.
TEACHER PROTECTION. All teachers will be entitled to fair, reasonable and equitable treatment when processing grievances. A teacher who participates or intends to participate in any grievance as described herein shall not be subjected to discipline, reprimand, warning, or reprisal because of such participation or intention. All documents, communications, and records dealing with the processing of a grievance will be filed separately from the personnel files of the participant.

Section B: Medical Evaluation Paragraph 1: Teachers shall undergo a medical evaluation if so requested or directed by the Superintendent or designee. TEACHER PROTECTION. A. The Board recognizes its responsibilities to continue to give administrative backing and support to its teachers, although each teacher bears the primary responsibility for maintaining proper control and discipline in his/her classroom. The Building Student Behavior Committee (BSBC) and District Student Behavior Committee (DSBC) will be utilized to assist in fulfilling these responsibilities. 1. A teacher may send to the principal and/or request the removal of a pupil from his/her class or classroom when the grossness of the offense, the persistence of misbehavior, or the disruptive effect of the violation makes the continued presence of the student in the classroom intolerable. In each case, the teacher will furnish the principal, as promptly as his/her teaching obligations will allow, but in no event later than the close of the school day, a signed statement containing the full particulars of the incident. 2. Building principals will provide their teachers with copies of all policies involving student suspension and expulsion for reasons of unexcused absence and/or tardies. Copies of other Board policies regulating students are available from the building principal. 3. When a student is suspended or expelled, the referring teacher and/or teachers having direct instructional responsibility for the student will be notified of such action within two (2) school days. In other cases of student discipline the referring teacher shall receive a copy of the written disciplinary action. 4. Individual classroom teachers have the authority to establish reasonable classroom rules, which are consistent with Board policies and Student Handbooks. Updated copies of classroom rules shall be provided to the building administrator for advance review. 5. In any case where a teacher and administrator fail to agree upon the appropriate student discipline, the matter is subject to review by the BSBC and, if necessary, the DSBC. B. It shall be the responsibility of the teacher to report to his/her principal the name of any student who, in the opinion of the teacher, needs assistance from skilled personnel. The teacher shall be advised by the principal of the disposition of the teacher's report that a particular student needs such assistance. C. TEACHER PROTECTION. The Board acknowledges the desirability of giving reasonable support and 18 assistance to teachers with respect to proper maintenance of control and 19 discipline in the classroom. Individual school procedures and policies for 20 handling student discipline shall be reviewed by each school’s School 21 Advisory Council and revised or developed as needed so as to ensure that 22 the referring teacher has the opportunity to input his/her feelings regarding 23 the disposition of the referral. Discipline procedures shall stress the 24 importance of uniform application. When the offense is serious enough to 25 warrant suspension of the student in accordance with the School Board 26 policy and/or the School Discipline Plan, such referred student will not be 27 returned to the teacher’s class the same period (or 30 minutes in elementary 28 school) from which the student was referred unless he/she is escorted by an 29 administrator or a written explanation from same stating his/her reasons for 30 the student’s return accompanies the student. 32 Except as otherwise provided herein, when a student(s) is referred to the 33 administrator for disciplinary reasons, the teacher shall be informed of the 34 conditions, if any, which have been imposed on the student before he/she 35 reenters the class. Whenever the circumstances do not permit the 36 administrator to address a particular student referral, the administrator may 37 return the student to the referring teacher's class and recall the student at a 38 later time. The referring teacher shall be notified of the necessity of such 39 return and recall. If a serious situation exists, the teacher may return the 40 student to the principal. 41 42 Before the student is returned to class, serious consideration should be 43 given to the effect such return would have on the learning environment for 44 the other students in the class. TEACHER PROTECTION. The Board agrees to protect and indemnify teachers employed by the District and covered by this Agreement from suit to the extent provided by Section 10-20.20 of the Illinois School Code. A teacher shall report as soon as possible in writing to his/her principal and to the Director of Personnel all cases of assault and/or battery suffered by him/her in connection with his/her employment, and all facts concerning the incident. The principal or designee shall investigate the incident and shall provide appropriate assistance to the teacher and law enforcement authorities in the investigation of such incident. In addition, the principal or designee shall acknowledge receipt by the end of next school day of any safety concerns about the work environment that are submitted to the principal by the affected teacher.
TEACHER PROTECTION. .1 In cases involving a criminal complaint on the part of a parent, student, or outsider, against the teacher in the course of his/her employment where the teacher is requested to report to the police department or the court, the principal shall immediately notify the Superintendent. In such event, the school district shall provide an attorney to represent the teacher in connection with his/her initial police department or court appearance concerning the complaint. The Association shall be notified when such an event occurs. .2 In cases involving assault and/or battery, etc., on the part of a parent, student, or outsider against a teacher, the school principal should immediately contact the police department. The teacher may file a complaint against such offender, and/or legal actions for injury or damages against such persons. Immediately following this, a written report should be made of the incident, including all particulars, and two (2) copies sent to the Superintendent. The Superintendent will keep one on file and send a copy to legal counsel for his/her records. The Board shall provide legal counsel, medical treatment not covered by insurance and financial remuneration for all expenses and damages incurred as the result of such cases. However, this provision is applicable only if the teacher was acting within the normal scope of the teacher's duties. .3 Absence from teaching duties resulting from Item 4.2.1 and 4.2.2 of this Article shall not be charged to the teacher's accumulation of absence days. .4 Teachers shall exercise reasonable care with respect to the safety of pupils and property, as outlined by administration, but shall not be individually liable for any damage or loss to person or property except in the case of negligence or neglect of duty.
TEACHER PROTECTION. A. Although each Member bears the primary responsibility for maintaining control and discipline of students, the Board recognizes its responsibility to provide appropriate assistance to its Members. The Members recognize that all disciplinary actions and methods invoked by them shall be reasonable, just, and legal. It shall be the responsibility of the Member to report immediately to the Principal, or the Principal’s designee, the name of any student, who, in the opinion of the Member, needs particular assistance from skilled personnel. The Member shall be advised by the Principal, or the Principal’s designee, of the disposition of the Member's report that a particular student needs such assistance within five (5) regular school days of the disposition. B. Any case of assault upon Members while performing their duties shall be promptly reported, in writing, to Administration. The Board shall seek legal counsel, upon request, before advising Members of their rights and obligations with respect to such matters and shall render all reasonable assistance to Members in connection with handling of such matters by law enforcement and judicial authorities. Time lost as a result of such matters shall not be charged against a Member's pay or sick leave unless the Member is judged negligent. C. Members shall be expected to exercise reasonable care with respect to the safety of students and property, but shall not be individually liable, except in the case of gross negligence of duty, for any damages or loss to person or property. D. The Board will reimburse replacement costs not covered by the member’s personal insurance for loss or damage of clothing or personal property sustained while in the line of duty on or off District property unless the member’s negligence contributed to or directly caused the loss or damage. Members are strongly discouraged from bringing or wearing personal items that are of significant value to work.
