Ill Health. Requests for leaves of absence which extend beyond time compensated in Article 10 must be accompanied by a statement from the attending physician recommending that the employee be granted such leave. A request to return to regular duties with the Board must be accompanied by a statement from the attending physician that the bargaining unit member is able to resume his regular duties.
Ill Health a. A written application for leave of absence for ill health must be accompanied by a statement from the attending physician stating the nature of the illness and definitely recommending that a leave of absence be granted.
b. Such request for leave of absence will be granted for a specified length of time. The leave may be renewed, but in no event will a leave extend for more than two (2) years. The request for extension of leave for personal illness will be accompanied by a doctor’s statement recommending such an extension.
c. If an bargaining unit member is unable to perform satisfactorily the duties of his/her position because of a physical or other disability, or if the bargaining unit member has been absent on account of personal illness for a continuous period of ninety (90) days following the expiration of his/her sick leave, the Superintendent may recommend, without the request of the bargaining unit member a leave of absence for a part of the school year, for the remainder of the school year, or for a full school year, and renewals thereof.
d. The Board shall continue to carry on payroll records all school bargaining unit members whose sick leave accumulation has expired, or who are on a disability leave of absence, or an approved leave of absence, for the purpose of group term life, hospitalization, surgical or major medical insurance. The bargaining unit member shall make the total premium payment to the Business Manager/Director of Human Resources by the first of each month. This paragraph is contingent upon the approval of this procedure by the insurance carrier.
e. Said bargaining unit members shall have the right of restoration to contract status, if any, prior to approval of leave.
Ill Health a. Upon the written request of a bargaining unit member, the Board may grant an unpaid leave of absence for a period of not more than two (2) consecutive years for illness or other disability. The Board may grant a leave for these reasons without a request from a member pursuant to provisions specified in Section 3319.13 of the Ohio Revised Code.
b. The bargaining unit member's request for said leave must be accompanied by a statement from the attending doctor and at the discretion of the Board, approved by a Board appointed physician. Said statement must indicate the nature of the illness and recommend that the member be relieved of duties. If the Board requires the member to be examined by the Board appointed physician, it shall assume the cost of the examination.
c. At least thirty (30) days before a bargaining unit member on a leave of absence for ill health expects to resume his/her duties, said bargaining unit member or someone acting in his/her behalf, must request, in writing, the reinstatement of said member to the staff. In requesting reinstatement, said bargaining unit member does not forfeit his/her right to request an extension of his/her leave of absence for ill health. Failure to comply with this regulation shall be deemed an automatic resignation.
d. Not less than ten (10) days before termination of leave, a doctor's statement, certifying that the bargaining unit member has been examined, and that he/she will be able to resume his/her duties when the leave of absence expires, must be submitted by said member. The doctor's statement, at the discretion of the Board, will be subject to approval by a Board appointed doctor.
Ill Health. The unit member shall submit a physician’s certification, as may be required by the District, regarding the ill health and its expected duration.
Ill Health. (i) If the person engaged shall be compelled by reason of ill-health (not caused by his/her own misconduct) to resign his/her office or if at any time it shall be certified by a duly certified medical officer employed by the Government that he/she is incapable of reason or any infirmity of mind or body (not caused by his/her own misconduct) of rendering further efficient service in Malta, the Government shall pay his/her salary up to the date of such resignation or certificate (and shall, if he/she is in Malta at the time, furnish him/her with a free passage to his/her country of residence for himself/herself and, if married, for his wife/her husband and children, if any, not exceeding four persons besides himself/herself, provided that they went to Malta under this Agreement and provided that he/she claims and avails himself/herself of such passages by the first available aircraft by which, in the opinion of the Government, he/she could have embarked16).
(ii) A certificate signed by a duly certified medical officer employed by the Government shall be conclusive evidence on the question whether or not the person engaged was compelled to resign his/her office by reason of ill-health within the meaning of this Clause.
(iii) The person engaged may be allowed full pay sick leave for 30 working days followed by half pay sick leave for a similar period during every period of twelve months commencing from the date of engagement as specified in Clause 1 (i).
Ill Health. A. A written application for leave of absence for ill health must be accompanied by a statement from the attending physician stating the nature of the illness and definitely recommending that a leave of absence be granted.
Ill Health. 6.1 Provided that you supply the Company with self-certification sickness forms and/or medical certificates covering the periods of absence as required by the Company’s Sick Leave Rules you will be entitled to be paid during absence from work due to sickness or injury for a period of a total of up to six months on full salary in any period of twelve months you are employed by the Company. Thereafter, you will at the discretion of the Company and, subject to the provisions of Sub-Clause 12.2 below, continue to be paid for a further six months at half salary. In the event that your employment is terminated either at the end of the aforementioned six month period or under the terms of Sub-Clause 12.2 you will be entitled to receive the benefits of such health insurance scheme as may from time to time be in force.
6.2 If the sickness or injury resulting in your absence from work is, or appears to be caused by the acts or conduct of a third party you must immediately notify the Company giving full particulars, including particulars of any relevant claim or legal proceedings. If required by the Company, you must also refund to it that part of any damages recoverable relating to loss of earnings for the period of your absence as the Company may reasonably determine provided that the amount to be refunded shall not exceed the amount of damages or compensation actually recovered by you less any costs borne by you in connection with such recovery and shall not exceed the total remuneration paid to you in respect of the period of absence.
Ill Health.
48.1 The University, through the Director of Human Resources, may require an employee whose capacity to perform the duties of their role is in doubt to undergo a medical examination by a registered medical practitioner approved by the University. The employee may suggest a medical practitioner for consideration.
Ill Health. The Superintendent or designated central office administrator may require medical or psychological verification of written application of a leave of absence, without pay, for ill health. In meeting the medical (or psychological) verification requirement, generally the written certification of the teacher’s physician or psychologist is sufficient. In circumstances where the Superintendent or designated central office ad- ministrator requires additional explanation, the teacher shall provide a written report from the bargaining unit member’s physician or psychol- ogist to the Superintendent or designated central office administrator.
Ill Health. Must be properly verified by a physician or other practitioner with a recommendation for the specific purpose of recuperation and/or regaining health of self or of a member of the immediate family.
