Cross-Over Clause. In the event the Employer performs any road building, utility, sewer and watermain construction, pipeline construction, heavy con- struction or any other construction work, the Employer agrees to be bound by the applicable Union Agreements for any such work.

Cross-Over Clause. 25.01 Should the Employer perform any work falling within the scope of the following Collective Agreements with or binding upon Local 183 then the Employer shall abide by and perform such work in accordance with the terms and conditions of the applicable Collective Agreement including, but without limiting the generality of the foregoing, any terms and conditions thereof with respect to the contracting or subcontracting restrictions. The Union will provide the Association with a copy of each of the Collective Agreements, noted below, within ninety (90) days of their execution. (a) “The Apartment Builders Agreement” being a Collective Agreement between the Metropolitan Toronto Apartment Builders’ Association and Local 183. (b) “The Carpentry and Framing Agreement” being a Collective Agreement between The Residential Framing Contractors' Association of Metropolitan Toronto and Vicinity Inc. and Local 183. (c) “The Concrete and Drain Agreement” being a Collective Agreement between the Ontario Concrete and Drain Contractors' Association and Local 183. (d) “The Forming Agreement” being a Collective Agreement between the Ontario Formwork Association and the Formwork Council of Ontario. (e) “The Heavy Engineering Agreement” being a Collective Agreement between the Heavy Construction Association of Toronto and Local 183. (f) “The House Basements Agreement” being a Collective Agreement between The Residential Low- Rise Forming Contractors' Association of Metropolitan Toronto and Vicinity and Local 183. (g) “The House Builders Agreement” being a Collective Agreement between the Toronto Residential Construction Labour Bureau and Local 183. (h) “The Landscaping Agreement” being a Collective Agreement between certain landscaping contractors in Ontario Labour Relations Board Area Nos. 8 and 18 and Local 183. (i) “The Marble Tile Terrazzo and Cement Xxxxx Agreement” being a Collective Agreement between the Residential Tile Contractors’ Association and Local 183. Cross-Over Clause. In the event the Employer performs other construction work, including but not limited to, road building, sewer and watermain construction, pipeline construction, heavy construction or utility work, other than cable TV services, the Employer agrees to be bound by the applicable Union Agreement. The applicable Union Agreement for utility work, other than cable TV services, shall be the Collective Agreement between the Utility Contractors Association and the Labourers International Union of North America, Ontario Provincial District Council.

Cross-Over Clause. If an Employer covered by this Agreement engages in work other than that falling within the Heavy Engineering Sector and such other work comes within the purview of the existing Collective Agreements between the Union and the Toronto and Area Roadbuiders Association, the Metropolitan Toronto Sewer & Watermain Contractors Association, the Utility Contractors' Association of Ontario, the Underground Parking Restoration Contractors, and Landscaping Agreement (Xxxxx Xxxxx), then all terms and conditions of the applicable Collective Agreement(s) shall apply.

  • ZIPPER CLAUSE 1. This Agreement sets forth the full and entire understanding of the parties regarding the matters herein. This Agreement may be modified, but only in writing, upon the mutual consent of the parties.

  • WAIVER CLAUSE The parties acknowledge that during the negotiations which resulted in this Agreement, each had the unlimited right and opportunity to make demands and proposals with respect to any subject matter not removed by law from the area of collective bargaining, and that the understandings and agreements arrived at by the parties after the exercise of that right and opportunity are set forth in the Agreement. Therefore, the Employer and the Association, for the life of this Agreement, each voluntarily and unqualifiedly waives the right and each agrees that the other shall not be obligated to bargain collectively with respect to any subject or matter not specifically referred to or covered in this Agreement, even though such subjects or matters may not have been within the knowledge or contemplation of either or both of the parties at the time that they negotiated or signed this Agreement.

  • Indemnity Clause CONTRACTOR agrees to indemnify, save harmless, and release DISTRICT, and all its officers, agents, volunteers, and employees from and against any and all loss, damages, injury, liability, suits, and proceedings arising out of the performance of this contract which are caused in whole or in part by the acts or negligence of CONTRACTOR's officers, agents, volunteers, or employees, but not for claims arising from DISTRICT's sole negligence. The parties agree that if there are any Limitations of CONTRACTOR's Liability, including a limitation of liability for anyone for whom CONTRACTOR is responsible, such Limitations of Liability will not apply to injuries to persons, including death, or to damages to property.

  • MANAGEMENT CLAUSE Subject to the provisions of this Agreement, the Employer has the exclusive right and authority to establish policies and manage stores covered by this Agreement and to direct the working forces employed therein including, but not limited to, the rights of hiring, suspending and discharging for proper cause, promoting, transferring and releasing employees from duties because of lack of work. The Employer will notify the Union when it places a cashier on an individual cash control program. There shall be no suspension because of work performance, absenteeism and/or tardi­ ness, without prior written notice having been given to the Union and the employee involved. The trial period for newly engaged employ­ ees shall be the first thirty (30) days of employ­ ment and may be extended to sixty (60) days at the request of the Employer to the Union. When new stores are opened by the Employer, the trial period shall be sixty (60) days for all employees newly employed at such time. After the first sixty (60) days from the opening date of the store, the trial period shall be thirty (30) days.

  • Geographic Area and Sector Specific Allowances, Conditions and Exceptions The following allowances and conditions shall apply where relevant. Where the Employer does work which falls under the following headings, the Employer agrees to pay and observe the relevant respective conditions and/or exceptions set out below in each case.
