MANAGEMENT CLAUSE. The management of the business and the authority to execute all of the various functions and responsibilities incidental thereto are vested in the Company. The direction of the workforce, the establishment of plant policies, the determination of the processes and means of manufacture, the units of personnel required to perform such processes, and other responsibilities incidental to the operation of the plant are vested in the Company. Such duties, functions, and responsibilities shall also include hiring, retirement, disciplining, evaluating the qualifications of employees, and promotions. The exercise of such authority shall not conflict with the rights of the Union under the terms of this Contract.
MANAGEMENT CLAUSE. Except as modified by this Agreement, the Employer retains all rights of management, which, in addition to all powers, duties, and rights established by constitutional provision or statute, will include but not limited to, the right to:
(a) Determine the Employer’s mission and strategic plans;
(b) Determine the Employer’s budget and size of the agency’s workforce and the financial basis for layoffs;
(c) Direct and supervise employees;
(d) And all other rights to manage and operate the Ferries Division in an effective, efficient, safe, and fiscally prudent manner within the Ferries Division fiscal budget.
(e) The Union reserves the right to intercede on behalf of any employee who feels aggrieved because of the exercise of this right and to process a grievance in accordance with Section 23.
(f) The existence of this clause shall not preclude the resolution of any such grievance on its merits.
MANAGEMENT CLAUSE. Subject to the provisions of this Agreement, the Employer has the exclusive right and authority to establish policies and manage stores covered by this Agreement and to direct the working forces employed therein including, but not limited to, the rights of hiring, suspending and discharging for proper cause, promoting, transferring and releasing employees from duties because of lack of work. The Employer will notify the Union when it places a cashier on an individual cash control program. There shall be no suspension because of work performance, absenteeism and/or tardi ness, without prior written notice having been given to the Union and the employee involved. The trial period for newly engaged employ ees shall be the first thirty (30) days of employ ment and may be extended to sixty (60) days at the request of the Employer to the Union. When new stores are opened by the Employer, the trial period shall be sixty (60) days for all employees newly employed at such time. After the first sixty (60) days from the opening date of the store, the trial period shall be thirty (30) days.
MANAGEMENT CLAUSE. 18-1 Except as abridged or restricted by any provision in this Agreement or by applicable law, the Board shall have the exclusive right to supervise and control all of its departments, schools, and employees, to issue reasonable rules and regulations, and to exercise any and all rights and authority granted to the Board as an employer by statute, ordinance, and applicable regulations, and to comply with its responsibilities thereunder. The Board agrees that no such rights or authority shall be exercised in violation of this Agreement. Further, the exercise of rights normally entrusted to management shall be subject to any obligations the Board may have under Rhode Island law.
MANAGEMENT CLAUSE. The Employer shall remain vested with all management functions, including but not limited to, the direction of the staff, the full and exclusive right to hire, promote, demote, discharge for cause, discipline employees consistent with a merit system of personnel management; to promulgate rules and regulations governing the conduct of employees and to require their observance; to make temporary job assignments necessary to ensure the efficient performance of work; to control the use of vacations so as not to jeopardize the functions of the Employer; to establish and direct the location and methods of work, job assignments and work schedules; to maintain order and efficiency; to determine the hours of work including starting and quitting time, length of work week; and to accomplish the reduction of the work force for efficiency purposes, to control, direct and supervise all equipment, subject to the terms of this Agreement. The Employer further reserves the exclusive right to subcontract any work or public services and to merge any of said work or public services with other governmental entities, provided that the Union shall be notified thirty (30) days in advance of such subcontracting if it will result in direct layoffs. During such thirty (30) day period the City and the Union will meet to review economic conditions, methods to achieve cost savings, methods to improve efficiencies and other ways to avoid such layoffs. The Employer agrees to exercise all reasonable effort possible to find suitable placement with city employment for any employees affected by subcontracting on the part of the Employer. Further, when it is necessary for the Employer to accomplish the reduction of the workforce for efficiency and economic purposes, the Employer shall do so whenever possible or practicable by means of attrition.
MANAGEMENT CLAUSE. The management of the Company and the authority to execute all of the various functions and responsibilities incidental thereto are vested in the Company. The direction of the workforce, the establishment of plant policies, the determination of the processes and means of work execution, the units of personnel and work schedules required to perform such processes, and other responsibilities incidental to the operation of the plant are vested in the Company. Such duties, functions, and responsibilities shall also include, but not be limited to, hiring, retirement, disciplining, evaluating the qualifications and performance of employees, and promotions. The exercise of such authority shall not conflict with the rights of the Union under the terms of this Contract.
MANAGEMENT CLAUSE. The management of the business in all its phases and details shall remain vested in the Employer. The rights of the Employer and the employees shall be respected and the provisions of this contract for the or xxxxx settlement of all questions regarding such rights shall be observed.
MANAGEMENT CLAUSE. In the best interest of PCC, the CEO has the authority to direct the staff to implement new ideas or changes in operations. PCC confirms its goal of preserving the cooperative and participatory nature of PCC management through its polices and Internal Grievance Procedure.
MANAGEMENT CLAUSE. 1. Except as herein provided in this Agreement, the right of the Board in all respects to manage its business, operations and affairs; discharge and discipline employees for cause, to sub-contract, and to change, combine, establish or discontinue jobs or operations, shall be unimpaired. The Board’s not exercising any right hereby reserved to it, or its exercising any right in a particular way, shall not be deemed a waiver of any such right or preclude the Board from exercising the same in some other way not in conflict with the express terms of this Agreement.
2. Nothing in the Agreement shall be construed as abridging any right, benefit, or privilege that employees of the Board have enjoyed heretofore unless such practice has been superseded by provisions of this Agreement.
MANAGEMENT CLAUSE. Section 1 The Employer retains the sole rights in its discretion to manage its business to hire, discharge for cause, lay off, assign, transfer, demote and promote its employees; to determine the starting and quitting time and the number of hours to be worked, establish, discontinue or change operations and all other rights and prerogatives subject only to such regulations and restrictions governing the exercise of these rights as expressly provided in this Agreement.
Section 2 The execution of this Agreement shall not create any vested rights in the employees of the Employer and all rights not specifically relinquished by the Employer in this Agreement, shall remain the Employers.
