Cubicles. Developer shall provide 15 total cubicle area spaces for administrative staff 20 (nominally 80 square feet each). Developer may provide power supply and data and 21 communication lines to cubicles through power pole drops.

Cubicles. Landlord and Tenant acknowledge and agree that, (i) Landlord shall purchase a minimum of seventy-three (73) cubicles but a maximum of eighty-two (82) cubicles of comparable quality to those cubicles of Landlord situated in the Building within the Park located at 000 Xxxxxxx Xxxxx, and otherwise of a type, and produced by a manufacturer, reasonably satisfactory to Landlord and Tenant (“Cubicles”), (ii) the Cubicles shall be configured in the manner described in the Final Space Plan (as defined in Exhibit B), (iii) the Cubicles shall be installed by Landlord and shall be wired for three (3) data lines (CAT – 5), and electrical service, and one (1) chair per Cubicle (together with the Cubicles, the foregoing are collectively, “Cubicles and Equipment”), (iv) the cost of the purchase, transport and installation of the Cubicles and Equipment shall be deducted from the Tenant Improvement Allowance, (v) during the Term of this Lease, Landlord shall lease, as owner, to Tenant, as lessee, at no additional cost or expense, all of the Cubicles and Equipment, (vi) such leasing is on an “AS-IS, WITH ALL FAULTS” basis and subject to all of the terms of this Lease (including, without limitation, Article 10, of this Lease), without recourse, representation or warranty of any kind or nature, express or implied, including without limitation, habitability, merchantability or fitness for a particular purpose, (vii) at the expiration or earlier termination of this Lease, the Cubicles and Equipment shall be returned and surrendered to Landlord in the same or substantially similar condition and repair as when delivered to Tenant, reasonable wear and tear and damage by Landlord excepted, (viii) Tenant shall be obligated to repair, maintain and insure the Cubicles and Equipment, (ix) Tenant shall not have the right or ability to (a) remove or materially modify the Cubicles and Equipment or (b) assign or sublet any of the Cubicles and Equipment except in conjunction with this Lease and the Premises and (x) Tenant shall pay any taxes, assessments and insurance premiums attributable to the Cubicles and Equipment. ///signatures on next page/// ///continued from previous page///

Cubicles. Developer shall provide 55 total cubicle area spaces (nominally 80 square feet each).
Cubicles. Subtenant and Sublandlord each own certain cubicles located in the Leased Premises and the Subleased Premises. Subtenant and Sublandlord hereby agree that the cubicles owned by Subtenant shall remain in the office area of the Northwest quadrant, and that the cubicles owned by Sublandlord shall remain in the office area of the Northeast quadrant; provided, however, that Sublandlord and Subtenant may agree to exchange certain of their cubicles for one another in the event that it proves more expedient to do so.
Cubicles. Landlord shall remove from the Expansion Space sixteen (16) cubicles, and Tenant shall be entitled to use any cubicles remaining in the Expansion Space following such removal (with such remaining cubicles referred to herein collectively as, the “Cubicles”), subject to the terms of this Section. Tenant shall have the right to use such Cubicles during the Term, at no additional cost except as hereinafter provided. Tenant agrees that the Cubicles are in their “as is” condition and in good order and satisfactory condition, and that there are no representations or warranties by Landlord regarding the suitability for Tenant’s use, the condition or any other matter relating to the Cubicles. Tenant, at its sole cost and expense, shall maintain the Cubicles in good condition and repair during the Term and in accordance with the conditions and requirements described in any warranties issued by the manufacturer of the Cubicles and delivered to Tenant. In the event of any damage to the Cubicles, Tenant shall provide written notice to Landlord of such damage and Tenant shall make any and all repairs that are necessary at Tenant’s sole cost and expense. If Tenant fails to make any repairs to the Cubicles for more than fifteen (15) days after notice from Landlord (although notice shall not be required if there is an emergency), Landlord may make the repairs, and Tenant shall pay the reasonable cost of the repairs to Landlord within thirty (30) days after receipt of an invoice, together with an administrative charge in an amount equal to ten percent (10%) of the cost of the repairs. At all times during the Term, Tenant shall cause the Cubicles to be insured pursuant to the provisions of Article 8.B of the Original Lease. Tenant agrees that notwithstanding anything to the contrary {2011-0761/00030501 contained in this Amendment, the Cubicles are owned by Landlord and, upon the expiration or earlier termination of the Lease, as amended hereby, all Cubicles shall be returned to Landlord in the same condition as of the date of this Amendment, reasonable wear and tear excepted.
Cubicles. All cubicles shall be designed for ease of operation and maintenance. EPC Schedule A (A-50) 09 October 2003 Outdoor cubicles shall be to IP55 classification in IEC 60529.
Cubicles. WW is prohibited from changing any cubicle configurations, removing cubicles or doing any type of repair or maintenance to cubicles. Activity of this type must be conducted by an authorized vendor representative or it will invalidate FBMC’s warranty on the cubicles. Any cubicle change that is needed should be requested through FBMC’s Facility Management department. These services will be billed back to WW at the vendor’s current rate.
Cubicles. Landlord shall install, setup and fully wire up to 189 modular furniture cubicles in the Premises so that such cubicles are in a “plug & play” condition. The cubicle specifications are provided in Exhibit C-2, attached hereto. In addition, the floor layout of the cubicles shall be as determined by Tenant; however, the number of cubicles on the second floor shall not be greater than 141 (with the actual number to be determined by Tenant) and the number of cubicles on the first floor shall not be greater than 48 (with the actual number to be determined by Tenant); and
