Currency of Software. Subject to and in accordance with Sections 6.4, 9.5, 9.6, 9.14, Exhibit 2 and Exhibit 4, Service Provider shall maintain reasonable currency for Software for which it is financially responsible under this Agreement and provide maintenance and support for Software (including new Upgrades, Major Releases and Minor Releases) for which it is operationally responsible under this Agreement. At DIR's direction, Service Provider shall operate, maintain and support multiple releases or versions of the same Software and, subject to Sections 9.7(e) and 9.7(f), without any increase in the Monthly Base Charge. In addition, unless otherwise directed by DIR, Service Provider shall keep Software within release levels supported by the appropriate third party vendor to maintain compatibility with other Software or Equipment components of the Systems and of DIR's Retained Systems and Processes. To the extent Third Party Software for which Service Provider is operationally responsible under this Agreement is no longer supported by the applicable licensor or manufacturer, Service Provider shall use commercially reasonable efforts to perform maintenance for such Software as required. For purposes of this Section, "reasonable currency" means that, unless otherwise directed by DIR, (i) Service Provider shall maintain Software within one Major Release of the then-current Major Release, unless otherwise specified pursuant to the Software Currency guidelines set out in Attachment 4-B and (ii) Service Provider shall install Minor Releases promptly or, if earlier, as requested by DIR.
Currency of Software. Subject to and in accordance with Sections 6.4, 9.5, 9.6, 9.7.3 and Schedule 4, Supplier will maintain reasonable currency, in compliance at least with the currency requirements set forth in Schedule 2 (including the subsidiary schedules to Schedule 2) and Schedule 4.2, for Software for which it is financially responsible under this Agreement and to provide maintenance and support for new releases and versions of Software for which it is operationally responsible. At Kraft’s direction, Supplier shall operate multiple releases or versions of Software, without any increase in the Monthly Base Charges, consistent with Supplier’s obligations under Schedule 2.2. Supplier shall use commercially reasonable efforts to support Software that is beyond the support requirements of Schedule 2.2. In addition, unless otherwise directed by Kraft, Supplier shall keep Software within release levels supported by the appropriate third party vendor to ensure compatibility with other Software or Equipment components of the Systems and of Kraft’s Retained Systems and Business Processes. For purposes of this Section, “reasonable currency” shall mean that, unless otherwise directed by Kraft, (i) Supplier shall maintain Software within one Major Release of the then current Major Release, unless otherwise specified in Schedule 2 and Schedule 4.2, and (ii) Supplier shall install Minor Releases promptly or earlier, if requested by Kraft.
Currency of Software. Subject to and in accordance with Sections 6.2, 9.6, 9.7 and 9.8(b), IBM agrees to maintain reasonable currency for Software for which IBM is financially, operationally and administratively responsible and to provide help desk and other support for new releases and versions of such Software. For purposes of this Section, “reasonable currency” shall mean that, unless otherwise directed by ACE, IBM shall maintain Software within one Major Release of the then current Major Release and shall do so within twelve (12) months of such then current Major Release becoming publicly available. “Reasonable currency” also shall mean that, unless otherwise directed by ACE, IBM shall promptly install Minor Releases as they become publicly available. Prior to installing a new Major Release or Minor Release, IBM shall evaluate and test such Release to verify that it will perform in accordance with the specifications and the architectures and standards established by ACE and that it will not without ACE’s prior approval (i) increase ACE’s total cost of receiving the Services; (ii) require material changes to ACE Facilities, systems, software or equipment; or (iii) materially and adversely impact the functionality, interoperability, performance or resource efficiency of the Services. Notwithstanding Sections 9.7 (c), IBM shall confer with ACE prior to installing any Major Release or Minor Release, shall provide ACE with the results of its testing and evaluation of such Release and shall not install such Release if directed not to do so by ACE, notwithstanding, in the event that ACE directs IBM not to install such Release, IBM will continue to support the currently installed version of the Software provided that the manufacturer of the such installed version continues to provide a standard maintenance offering for such installed version. If ACE requires IBM to use a Major Release or Minor Release for which maintenance offerings are not available and for which source code is not available, IBM shall be relieved of Service Levels to the extent that failure to achieve such Service Levels is caused by such Major Release or Minor Release.
Currency of Software. Subject to Advanta’s prior written approval, Supplier shall maintain, in accordance with Supplier’s internal policies and the Policies and Procedures Manuals, reasonable currency for all Software (including the Core Software) and ****** — Denotes material that has been omitted and filed separately with the Commission. shall provide “help desk” and other support for all new releases and versions of the Software. For purposes of this Section 9.3, “reasonable currency” shall mean that, unless otherwise directed by Advanta: (i) Supplier shall maintain the Software within one Major Release of the then-current Major Release; and (ii) Supplier shall install Minor Releases promptly upon their availability.
Currency of Software. Subject to and in accordance with Sections 6.4, 6.9, 9.5, 9.6, 9.7(c) and Schedule J.1, Supplier shall maintain reasonable currency for Software for which it is financially responsible under this Agreement and provide maintenance and support for new releases and versions of Software for which it is operationally responsible. At Triad’s direction, Supplier shall operate multiple releases or versions of Software (other than the Software of the ERP Solution, the C&RC Solution to the extent the Parties intend such Systems to be operated on an enterprise-wide, single instance basis) at levels consistent with those existing as of the Effective Date. In addition, Supplier shall keep Software within release levels supported by the appropriate third party vendor to ensure compatibility with other Software or Equipment components of the Systems and of Triad’s Retained Systems and Processes, unless otherwise directed by Triad or Triad is expressly responsible for upgrading or refreshing such Software under Schedule J.1. If Triad directs Supplier to support any Software on a non-current release, Supplier may need to support other Software or Equipment components (e.g., database software that supports particular application software) relating to such non-current release on a non-current release and Supplier will promptly notify Triad if that is the case. For purposes of this Section, “reasonable currency” means that, unless otherwise directed by Triad, (i) [**], unless otherwise specified in Schedule J.1, and (ii) Supplier shall install Minor Releases promptly or, if earlier, as requested by Triad.

In addition, unless otherwise directed by TxDOT, Service Provider shall keep Software within release levels supported by the appropriate third party vendor to maintain compatibility with other Software or Equipment components of the Systems and of TxDOT's Retained Systems and Processes. To the extent Third Party Software for which Service Provider is operationally responsible under this Agreement is no longer supported by the applicable licensor or manufacturer, Service Provider shall use commercially reasonable efforts to perform maintenance for such Software as required. For purposes of this Section, "reasonable currency" means that, unless otherwise directed by TxDOT, (i) Service Provider shall maintain Software within one Major Release of the then-current Major Release, unless otherwise reasonably specified by TxDOT and (ii) Service Provider shall install Minor Releases promptly or, if earlier, as requested by TxDOT.
Currency of Software. Subject to and in accordance with SECTIONS 6.4, 9.5, 9.6, 9.7(c) and SCHEDULE J, Provider agrees to maintain reasonable currency for Software for which it is financially responsible under this Agreement and to provide maintenance and support for new releases and versions of Software for which it is operationally responsible. For purposes of this Section, "reasonable currency" shall mean that, unless otherwise directed by Xxxxxxxx, (i) Provider shall maintain Software within one Major Release of the then current Major Release, unless otherwise specified in SCHEDULE J, ATTACHMENT J-10, and (ii) Provider shall install Minor Releases promptly or, if earlier, as requested by Xxxxxxxx. Provider will maintain reasonable numbers of multiple Major Releases for which commercial support is available, as directed by Xxxxxxxx, without any increase in the Monthly Base Charges.
Currency of Software. For purposes of this Section 9.7(a), “reasonable currency” shall mean that, unless otherwise directed by ABM, Supplier shall install Major Releases and Minor Releases in accordance with the applicable Service Responsibilities Matrices (SRM’s) set forth in Schedule E.

For purposes of this Section, “reasonable currency” shall mean that, unless otherwise directed by Kraft, (i) Supplier shall maintain Software within one Major Release of the then current Major Release, unless otherwise specified in the applicable Supplement, and (ii) Supplier shall install Minor Releases promptly or earlier, if requested by Kraft.
