Damage Caused by Contractor. Damages caused by Contractor employees shall be repaired at no cost to the Government. In all instances where Contractor’s employees damage Government property or equipment, the Contractor shall provide a verbal report to the COR and KO within four (4) hours of occurrence. The Contractor shall notify the COR/ACOR and return the damaged area to its previous condition. All damage done by the Contractor and/or their sub-contractor(s) shall become the Contractor’s responsibility. The Contractor shall furnish all labor, materials and equipment to perform the repair work including cultivating and applying seed, sprigging, or placing sod. All turf repair work shall be maintained to ensure successful growth.

Damage Caused by Contractor. Notwithstanding OPRD’s responsibility for repairs established in section 3.1 of this Exhibit, Contractor is responsible for 100% of the cost to repair any damage that results from the negligent, reckless, or intentional actions of Contractor, its officers, employees or agents. Further, Contractor may be held responsible for the cost to replace any OPRD-owned items that are lost or stolen as a result of Contractor’s actions or negligence.
Damage Caused by Contractor. The Contractor shall exercise care to prevent damage to the Electronic Shelf Labels (ESL) and commissary merchandise when performing any services under this contract. If determination has been made that the Contractor’s failure to use reasonable care caused damage to the Electronic Shelf Labels, the Contractor shall replace/repair the damage at no expense to the Government as the Contracting Officer directs. Upon a written determination by the Contracting Officer that Contractor-caused damage to commissary merchandise (including merchandise with expired code dates) is excessive, the Contractor shall reimburse the Government for Contractor-damaged merchandise IAW the table contained in 6.1., TECHNICAL EXHIBIT 1.
Damage Caused by Contractor a. If Polk State’s contract administrator finds that repairs or changes are required to a building, its contents, or its appurtenances, which, in the opinion of Polk State’s contract administrator are rendered necessary as the result of the use of materials, equipment or workmanship which are inferior, defective, or not in accordance with the Contract’s Scope of Work, the Contractor shall promptly, upon receipt of notice from Polk State’s contract administrator, place in satisfactory condition and/or correct all defects, and shall made good any work, materials, equipment, and contents of said building or site disturbed in making such restoration. b. In any case where the fulfilling of the requirements of the Contract or any restoration work required thereby, if the Contractor disturbs any work guaranteed under another contract, Contractor shall restore such disturbed work to a condition satisfactory to Polk State’s Contract Administrator, and guarantee such restored work to the same extent as it was guaranteed under such other contract. c. Upon the Contractor’s failure to proceed promptly to comply as above, Polk State may either: 1) Have the work performed as Polk State’s Contract Administrator deems necessary, or 2) Allow the damaged or defective work or portion of the building, site contents, equipment, or work disturbed to remain in such unsatisfactory condition, provided that the Contractor shall promptly pay Polk State the sum expended by Polk State to correct the deficiency. d. In the event the Contractor fails to pay promptly on demand any sum expended or estimated, Polk State shall deduct the amount from any monies due or to become due to the Contractor under this Contract. e. Contractor shall replace any injured or dead plants/trees which were injured due to the disposal of waste water in planters or on Polk State grounds.

  • Termination by Contractor Contractor may, at its option, terminate this Contract upon the failure of MPS to pay any amount, which may become due hereunder for a period of sixty (60) days following submission of appropriate billing and supporting documentation. Upon said termination, Contractor shall be paid the compensation due for all services rendered through the date of termination including any retainage.

  • Claim by Contractor After receipt of the Notice of Termination from the state, the Contractor shall submit any claim for additional costs not covered herein or elsewhere in the Contract within 60 days of the effective termination date, and not thereafter. Should the Contractor fail to submit a claim within the 60-day period, the State may, at its sole discretion, based on information available to it, determine what, if any, compensation is due the Contractor and pay the Contractor the determined amount.

  • TERMINATION BY MPS - BREACH BY CONTRACTOR If Contractor fails to fulfill its obligations under this Contract in a timely or proper manner, or violates any of its provisions, MPS shall thereupon have the right to terminate it by giving five (5) days written notice before the effective date of termination of the Contract, specifying the alleged violations, and effective date of termination. The Contract shall not be terminated if, upon receipt of the notice, Contractor promptly cures the alleged violation with five (5) days. In the event of termination, MPS will only be liable for services rendered through the date of termination and not for the uncompleted portion, or for any materials or services purchased or paid for by Contractor for use in completing the Contract.

  • Termination due to Force Majeure 13.5.1 If the Force Majeure Event or its effects continue to be present beyond the period as specified in Article 4.5.3, either Party shall have the right to cause termination of the Agreement. In such an event, this Agreement shall terminate on the date of such Termination Notice.

  • Termination With Cause The Master Servicer may, at its sole option, terminate any rights the Primary Servicer may have hereunder with respect to any or all of the Mortgage Loans, as provided in Section 4.01 of this Agreement upon the occurrence of a Primary Servicer Termination Event.   • Vendor’s Termination If TIPS fails to materially perform pursuant to the terms of this Agreement, Vendor shall provide written notice to TIPS specifying the default (“Notice of Default”).
