Definition of Affected Employees. For purposes of this Article, the parties agree that the AUSD has a district-wide Title I program. CSEA and AUSD agree that all employees in the following classification shall comply with the requirements of the Act according to this Agreement. The affected classifications are:

Definition of Affected Employees. For purpose of this Agreement, CSEA and MCOE agree that MCOE has a Title I program in its Alternative Education Department and therefore employees in the Instructional Assistant and Instructional Resource Assistant classifications in that department, shall comply with the requirements of the Act by January 8, 2006. Although MCOE provides Instructional Assistant – Special Education support staff to classrooms throughout the County, MCOE and CSEA believe that these assistants are not affected by NCLB and are not required to meet the requirements of the Act. Even so, MCOE and CSEA reserve the opportunity to discuss inclusion of Instructional Assistants – Special Education within NCLB, or similar requirements.

The affected classifications are: ● Classroom Assistant I (CA I) ● Special Education Severe Needs Aide (SNA) ● After School Activity Leader ● After School Activity Site Leader Educational or Proficiency Requirements: Employees in the affected classifications and all new hires into the affected classifications shall possess a high school diploma, GED or equivalent and shall fulfill one of the legal requirements detailed in the Act and described below. ● Completed 48 semester hours of study at an accredited institution of higher education ● Possess Associates Degree or higher from an accredited institution of higher education ● Pass a proficiency assessment and/or test certified by the District as meeting the definition of rigor in the Act.

CSEA and KCUSD agree that all employees in paraeducator classifications shall comply with the requirements of the Act according to timelines outlined in this Agreement.   • Employer Compensation Upon Separation An Employee, upon her separation from employment, shall compensate the Employer for vacation which was taken but to which she was not entitled.

  • Non-Vested Retirement Gratuity for Teachers 1. The minimum years of service for retirement gratuity shall be defined as the lesser of the contractual minimal service requirement in the 2008-2012 collective agreement, or ten (10) years.

  • VESTED RETIREMENT GRATUITY VOLUNTARY EARLY PAYOUT a) An Employee eligible for a Sick Leave Credit retirement gratuity as per Appendix A shall have the option of receiving a payout of his/her gratuity on August 31, 2016, or on the employee’s normal retirement date.
