Deputization a. The Sheriff agrees, in compliance with California Penal Code Sections 830.6 and 830.8, to deputize qualified Hoopa Tribal Police Officers who have successfully completed a standard background investigation acceptable to the Sheriff, and the training course for deputy sheriff officers prescribed by the California Commission on Peace Officer Standards and Training (hereinafter “P.O.S.T.”) or an equivalent federal training course recognized by P.O.S.T. as equivalent to P.O.S.T. requirements. Said deputization will not be unreasonably delayed.
Deputization. In order to best coordinate the provision of law enforcement services to citizens on and around the Reservation, the Sheriff agrees to deputize state-certified, tribal law enforcement officers who are employed by the SMPD at the Sheriff’s discretion. In the event that SMPD officers are deputized and are dispatched by the Sheriff’s Office outside of the Reservation, then such SMPD officers shall provide law enforcement services as Sheriff’s Office deputies in accordance with this Agreement.
Deputization. As addressed in Section III of this Agreement, the Tribe’s SMPD officers will be certified through the State of Wisconsin. In addition, if authorized by the Tribe, the SMPD officers may be deputized by the Sheriff. If the Tribe requests that the Sheriff deputize a SMPD officer, then the Tribe shall provide the Sheriff with all required background documentation for deputization. All documentation will be reviewed jointly by designated Tribal and County staff. The Sheriff shall have the sole determination regarding issuance of a deputy card. The Sheriff shall meet with the Tribe’s Lieutenant and other tribal representatives prior to revoking a deputy card of a SMPD officer. The parties understand that deputy sheriffs are required to have good behavior and competence. Any revocation of the deputy card by the Sheriff should be based in cause and done in good faith. If deputization by the Sheriff is not administered to the Tribe’s SMPD officers, the parties agree that remaining terms of this Agreement shall be unaffected and remain in full force and effect.

Deputization. All Portland Police personnel assigned to the PJTTF, in a full-time capacity, will be subject to a limited background inquiry and will be sworn as deputized Special Federal Officers, with the FBI securing the required deputization authorization. These deputizations will remain in effect throughout the tenure of each investigator’s assignment to the PJTTF or until termination of the task force.
