Notice is given to the Recipient by the Sender providing the Recipient's email address or mobile phone number. You may originate these Transfers by use of a computer or a mobile smart phone. You may register for the Service which will make future Transfers more convenient for you. To use this Service you are providing information to our Service Provider from your mobile phone, desktop, laptop, or other computer. Service Provider is a vendor of Credit Union. By participating in the Service, you are representing to the Credit Union that you are the owner or you have the authority to act on behalf of the owner of the mobile phone number or email address you are using to send or receive messages regarding Transfers. In addition, you are consenting to the receipt of emails or automated text messages from the Credit Union or its agent, regarding the Transfers and represent to the Credit Union that you have obtained the consent of the Recipients of your intended Transfers. Funds may be transferred to any account in the United States as long as the Transfer is legal and allowed by the financial institutions involved.

Description of Service and Consent. Email/Mobile Transfers allows you to send money from your Bank of America personal checking or savings account to another Bank of America customer or a customer of another U.S. based bank by using a recipient's email address or mobile phone number. Another Bank of America customer or a customer of a different U.S. based bank may also send money to your personal or small business account using your email address or mobile phone number. In order to send or receive money transfers, you must register through Online Banking from your personal computer or Mobile Banking from your mobile device. Recipients of your money transfers must also register with Bank of America or another bank participating in the Email/Mobile Transfer Network or with ClearXchangeTM, a company that arranges electronic money transfers. Once registered, you may send a money transfer us ing Online Banking or Mobile Banking by entering the email address or mobile phone number of the recipient. In addition, money sent to your email address or mobile number will be deposited into the personal or small business account you designated when you registered for the service. By participating in the Email/Mobile Transfer Network Service, you are representing to us that you are the owner or you have the authority to act on behalf of the owner of the mobile phone number or email address you are using to send or receive messages regarding money transfers. In addition, you are consenting to the receipt of emails or automated text messages from Bank of America, or its agent, regarding the transfers and represent to us that you have obtained the consent of the recipients of your intended transfers to the receipt of such emails or automated text messages.

Description of Service and Consent. If enabled by Platform for your Account, Mobile check deposit ("Mobile Deposit") allows you to make deposits to your Account remotely by using the Mobile App to take a legible picture of the front and back of the negotiable check(s) and transmitting images of such instruments to Bank in compliance with Bank’s requirements ("Check Image(s)"). If the Check Image is accepted for deposit, Platform will notify you electronically through the communication method(s) you have elected as preference ("Electronic Notice"). The Bank will then attempt to collect the item by presenting the image or converting the image into a digital representation of the original check ("Substitute Check"). Unlike traditional check deposits, you retain the original paper check when you use Mobile Deposit. See Section 7.0 “Substitute Check Policy Disclosure” below for further information on Substitute Checks and Section 6.9 "Retention of Original Check" below for retention requirements. The manner in which Substitute Checks are cleared, presented for payment and deposited will be determined by the Bank, in Bank’s sole discretion. Platform, acting as an agent of the Bank, may change, modify, add or remove functionality from Mobile Deposit at any time, with or without notice to you.

Description of Service and Consent. You can deposit checks to some Varo Products (as disclosed in specific Product Terms) at no cost remotely using the App by taking a legible picture of the front and back of the negotiable check(s) and transmitting images of such instruments to us in compliance with our requirements ("Check Image(s)"). Funds Availability Notwithstanding anything to the contrary in any agreement or representation between you and Varo (including any Product Terms), by using Mobile Check Deposit, you agree that the deposits submitted using Mobile Check Deposit are not subject to the funds availability requirements of Federal Reserve Board Regulation CC. Funds from deposits made via Mobile Check Deposit generally are made available before the seventh business day following the day the deposit was accepted; however, we may release funds to you earlier (in full or in part) based on any other factors as determined by us in our sole discretion. We may also, at our discretion, apply additional delays on the availability of funds based on any other factors as determined by us in our sole discretion. We may also return or refuse to accept all or any part of a deposit to your account using Mobile Check Deposit at any time and will not be liable for doing so even if such action causes outstanding checks or other debits to your account to be dishonored and returned.
