Typodermic warrants the licensed fonts to be free from defects in materials and workmanship under normal use for a period of twenty one (21) days from the date of delivery as shown on your receipt. Typodermic's entire liability and your exclusive remedy as to defective licensed fonts shall be, at Typodermic's option, either return of purchase price or replacement of any such product that is returned to Typodermic with a copy of the invoice or send a new version of the licensed fonts. Typodermic shall have no responsibility to replace the licensed fonts or refund the purchase price if failure results from accident, abuse or misapplication, or if any licensed fonts are lost or damaged due to theft, fire, or negligence. Any replacement product will be warranted for twenty one (21) days. This warranty gives you specific legal rights. You may have other rights, which vary from state to state. EXCEPT AS EXPRESSLY PROVIDED ABOVE, THE PRODUCT, IS PROVIDED AS IS”. NEITHER TYPODERMIC NOR THE DISTRIBUTOR MAKES ANY WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. The entire risk as to the quality and performance of the Product rests upon you. Neither Typodermic nor the distributor warrants that the functions contained in the Product will meet your requirements or that the operation of the licensed fonts will be uninterrupted or error free. NEITHER TYPODERMIC NOR THE DISTRIBUTOR SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES (INCLUDING DAMAGES FROM LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, AND THE LIKE) ARISING OUT OF THE USE OF OR INABILITY TO USE THE LICENSED FONTS EVEN IF MYFONTS OR THE FOUNDRY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.

If technical issues arise, we will exert all reasonable efforts to assist in their resolution. In the event that satisfactory resolution cannot be achieved, a refund will be provided as the extent of our liability. The Font Software and associated written materials are provided "as is." BlueTypo disclaims all warranties, whether expressed or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. Your exclusive responsibility lies in assessing the quality and performance of the font software, with BlueTypo offering no guarantee that the software's functions will fulfill your requirements or that its operation will remain uninterrupted or error-free. LICENSOR warrants the disk on which the Product is furnished to be free from defects in materials and workmanship under normal use for a period of thirty (30) days from the date of delivery to you as evidenced by a copy of your receipt. LICENSOR’s entire liability and your exclusive remedy as to the disk shall be replacement of the disk that does not meet LICENSOR’s Limited Warranty and which is returned to LICENSOR with a copy of receipt. If failure of any disk has resulted from accident, abuse, or misapplication, LICENSOR shall have no responsibility to replace the disk. Any replacement disk will be warranted for the remainder of the original warranty period.

If failure of the font soflware results from accident, abuse, or neglect, Canada Type assumes no responsibility to replace the soflware. THE SOFTWARE AND ACCOMPANYING WRITTEN MATERIALS ARE PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESSED OR IMPLIED, AND CANADA TYPE SPECIFICALLY DISCLAIMS THE WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE AND MERCHANTABILITY. The Foundry warrants the Fonts to be free from defects in materials and work- xxxxxxx under normal use for a period of thirty (30) days from the date of purchasing, or downloading, installing, using, or opening the compressed file that contains the Font Software, or otherwise handling digital typeface software created by the Foundry.

The Software and the Support Services shall not apply to the extent any Software performance or availability and Error is due to: (i) planned downtime; (ii) interruption of the Software in order to protect the integrity of the Software, inter alia, due to security issues, virus attacks, spam issues or other unforeseen circumstances; and (iii) a Force Majeure Event; (iv) circumstances attributable to the Subscriber (including any actions or inactions of Subscriber in violation of this XXXX) and/or Subscriber's systems, equipment, and/or your third party's service providers (including the Cloud Services provider) and/or Third Party Materials; (v) failure of the external internet beyond Consist's network, electrical or internet access disruptions; (vi) attacks (i.e. hacks, denial of service attacks, malicious introduction of viruses and disabling devices) caused by third parties; (vii) any use of the Software not in accordance with the Documentation.
