DISPUTE AVOIDANCE AND SETTLEMENT. CHAPTER I
1. The objective of Part III is to avoid or settle any dispute between the Parties concerning the interpretation and application of this Agreement with a view to arrive at, where possible, a mutually agreed solution.
2. For disputes that relate to the collective action of SACU, SACU will act as a collective for the purposes of this Part, and the EU shall act against SACU as such.
3. For disputes that relate to an individual action of a SADC EPA State, the SADC EPA State concerned shall act individually for the purposes of this Part, and the EU shall act only against the specific State that it considers has infringed a provision of this Agreement.

DISPUTE AVOIDANCE AND SETTLEMENT. In2store is a provider of 3rd party logistics services to clients. As such its relationship with both staff and customers is essential to its longevity as a business and employer. All parties shall therefore genuinely undertake to resolve matters at the workplace.
2.2.1 An employee may nominate an Employee Representative for the purposes of the following dispute settlement procedure.
2.2.2 Disputes over matters arising from this Agreement (or any other dispute related to the employment relationship) must be dealt with according to the following procedure.
(a) The employee shall first submit the matter to their supervisor and discuss the matter.
(b) If not settled, the employee shall then submit the matter to a more senior Employer representative for further discussion. The employee may elect to involve their Employee Representative in those discussions.
(c) Alternatively, the Employer may submit an issue to the employee/s for discussion. The employee/s may seek the assistance and involvement of their chosen Employee Representative.
(d) In the event of the matter remaining unresolved after the above steps have been taken, either party may refer the matter to the Australian Industrial Relations Commission for mediation or conciliation.
(e) In the event of the mediation or conciliation being unsuccessful in resolving the matter, the parties may, by agreement, refer the matter to the Australian
2.2.3 Work shall continue without interruption while the dispute settlement procedures are being followed.
DISPUTE AVOIDANCE AND SETTLEMENT. Chapter 15 of the Basic Agreement shall apply mutatis mutandis with respect to the avoidance and settlement of disputes between the Parties concerning the interpretation or application of Chapters 1, 2 and 16 of this Agreement.
DISPUTE AVOIDANCE AND SETTLEMENT. ARTICLE 109
1. This Part applies to any dispute concerning the interpretation and application of the provisions of this Agreement, unless otherwise provided.
2. The objective of this Part is to avoid and settle any dispute between the Parties concerning the interpretation and application of this Agreement in good faith and to arrive at, where possible, a mutually agreed solution. ARTICLE 110
DISPUTE AVOIDANCE AND SETTLEMENT. [A text proposal will be made at a later stage for the resolution of disputes between the parties (“state to state”)]
DISPUTE AVOIDANCE AND SETTLEMENT. 59.1 A prime aim of the parties is the avoidance and resolution of industrial disputes by means of the provision of information and explanation, consultation, cooperation and negotiation.
59.2 Where a dispute arises in or in connection with any matter relating to any of the conditions of employment contained in this Agreement, the following procedures in this clause will apply with a view to settling the matter in dispute.
59.3 Without prejudice to any party, the parties will ensure that, until the procedures described in this clause have been completed:
(a) work continues in the normal manner, except where a bona fide safety issue exists;
(b) no industrial action will be taken by the University or the union(s); and
(c) the University will not change work, staffing or the organisation of work if such is the subject of the dispute, or take other action likely to exacerbate the dispute.
59.4 Where a bona fide safety issue exists, staff members will not work in an unsafe environment but, where appropriate, accept re-assignment to alternative suitable work or places of working until their normal place of work has been determined to be safe.
