It is the intent of this contract that members of this bargaining unit should not be required to perform overtime work for other units that can be feasibly completed by other units. It is the further intent of this contract that if a member of another unit seeks to avoid overtime workthat he or she is capable of performing by obtaining volunteers, non-classified employees may he or she shall be authorized responsible for obtaining volunteers to work overtimefill not only the overtime shift, but also any other shifts in the bargaining unit that would become vacant by virtue of the volunteer replacing the member of another bargaining unit.

(h) Institutions and other work units which routinely distribute overtime shall do so on a rotational basis, in a fair and equitable manner for both List 3 below at each correctional facility of their choice. Such participation is voluntary and involuntary distribution any overtime opportunity will only occur after first being offered to those on List 1 and 2. Employees who volunteer for List 3 are responsible for maintaining their core competencies. Employees placed on List 3 are solely requesting voluntary overtime and shall not be subject to any order-in or order-over by virtue of overtime within each such unitvolunteering for List 3. Employees desiring to work voluntary overtime shall so indicate, annually, in accordance with instruction from their division or department head. In all cases of reduced holiday forces, employees will be called on the basis of being first out on the established call list of the shift involved.
(d) Employees for overtime service will be obtained first by calling the employees on the overtime call list who are on rest days on the shift involved. Additional employees, if needed, will be called first from the overtime list of the preceding shift; and if still more employees are needed, they will be called from the overtime list of the following shift.
(e) The handling of overtime call lists will be the duty of the committees at the various points. At points where committees agree in writing to volunteers accept the responsibility to call employees for overtime service, this will be permitted. When the xxxxxxx is designated to call such employees, the committees will be used to verify the fact that an employee called for overtime service cannot be contacted.
(f) If an employee is held over beyond the close of his regular shift to complete the unfinished job at hand and he is worked two hours and forty minutes or more, the first man out for overtime on the shift on which the overtime occurs will be paid a like amount of time at the penalty rate. The provisions of this paragraph shall not be considered contrary used consistently to defeat the concept intent of equitable distribution of overtime.

Distribution of Overtime. (a) Appointing authorities shall Both parties agree that it is fair to make a every reasonable effort to distribute divide overtime work, so far as equitably practical within each job classification, department and shift based upon the qualifications of the employee to perform such work without displacing the employees normally performing that work during the normal work week. Saturday and Sunday will not be construed as possible among classified employeespart of the normal workweek except in the case of mandatory overtime. Employees placed on List 3 are solely requesting voluntary overtime and shall not be subject to any order-in or order-over by virtue of overtime within each such unitvolunteering for List 3. Distribution of Overtime. 1. Overtime will be distributed equally to all qualified employees at a given location, as the circumstances will permit. Each department or operational unit will maintain a list of qualified employees who have requested overtime assignments. The order of placement on the list shall be based upon the order in which the Supervisor has received the written request. In case of simultaneous requests, the order shall be based on seniority.
2. If overtime requires a special skill or knowledge as determined by the Supervisor, it shall be assigned to the employee with that special skill or knowledge who first appears on the overtime eligibility list. Employees with excessive tardiness or absence may, at the District's discretion, be denied overtime. An employee who is denied overtime on the basis of excessive tardiness or absence may appeal this decision for further consideration to his/her site administrator or designee with five (a5) Appointing authorities days' notice in writing, and may be represented by the Union, if he/she so desires, in such appeal.
3. A record of overtime worked shall make be maintained by an employee's immediate Supervisor. This log, called the "Accumulative Overtime Log (AOTL)," shall be the only basis for the resolution of disputes over the assignment of overtime in accordance with this Article. The log shall be maintained as follows:
a. Logs shall be maintained on a reasonable effort pay period basis.
b. As overtime assignments are completed, the number of hours worked shall be entered next to distribute an employee's name. The number of overtime as equitably as possible among classified employeeshours worked shall be totaled for each employee for each pay period. Holiday hours shall not be shown and shall not count in the computation of overtime hours.
c. Logs shall be maintained up-to-date, and shall not change or alter the regular workweek of an employee (once posted where applicable) be available for the purpose of avoiding the payment of overtime or shift differential. Distribution of Overtime. 23.1 In all overtime work situations, the primary consideration must be to promote the safe and efficient conduct of the operations by having qualified employees do the necessary work.
23.2 The Company will establish overtime groups. Overtime will be distributed among qualified employees in an overtime group to the extent practical and consistent with the efficient conduct of the operations. Employees in an overtime group, and their supervisors, will attempt to establish satisfactory procedures for distributing overtime in their group. If employees and supervisors in a particular overtime group are not able to establish satisfactory overtime distribution procedures, then the following procedures will apply to that overtime group:

(f) Employees 23.4 A maintenance employee working on a job which extends into overtime shall be given retained on that job until it is completed. If the job lasts more than two (2) weeks’ notice of scheduled overtime. The Union President will be provided with a copy of the overtime list. (d) If no qualified employee should be available or willing to work the overtime required, the Company shall be free to have this work done.
(e) In situations where an employee is scheduled to work overtime and fails to do so, and in addition fails to notify the Company of such failure to work prior to two (2) hours preceding the start of his scheduled work shift, the Company may temporarily transfer an employee to fill such work shift requirements or shall have this overtime work done as per (d) above.
(f) When an employee or employees from one overtime group is/are brought in to the other group for the purpose of distribution of overtime work, the employees of that other group with the least overtime hours credited to them shall be considered first when assigning overtime in their new group, always provided that they are qualified to do the work required.
(g) The distribution of overtime opportunities shall be done as equitably as possible first among the employees in a classification, second among the qualified employees in the group, and third among the employees outside the group. Normally the overtime will be offered first to the employee with the lowest number of credited hours and so on. In the case of any inequity demonstrated by an employee, such employee shall be given the first opportunity to catch up subject to

Distribution of Overtime. (a) Appointing authorities Overtime will be distributed equally by classification in each regular working headquarters to the best ability of the Supervisor in charge, using the biweekly posted overtime list as a guide for such distribution. Distribution of Overtime. Local Management will divide overtime work in each overtime distribution unit by shift as impartially as is practicable among employees on the seniority roster. Distribution of Overtime.
1. Overtime will be distributed equally to all qualified employees at a given location. Each department or operational unit will maintain a list of such employees who have requested to be on the "Accumulative Overtime Log (aAOTL)." The order of placement on the list shall be based on seniority.
2. If overtime requires a special skill or knowledge as determined by the supervisor, it shall be assigned to the employee with that special skill or knowledge who first appears on the Accumulative Overtime Log (AOTL). Whenever overtime requires a special skill or knowledge, the supervisor shall provide a description of the assignment, and the special skill or knowledge needed, in writing, upon request. Employees with more than three (3) Appointing authorities unapproved absences within sixty (60) calendar days may be denied overtime by being skipped twice on the overtime rotation or for fourteen (14) calendar days following the most recent absence whichever comes first. An employee who is denied overtime on the basis of excessive unexcused absence may appeal this decision for further consideration to their site administrator or designee with five (5) days' notice in writing, and may be represented by the Union, if they so desire, in such appeal.
3. A record of overtime worked shall make be maintained by the Department Head or designee. These logs, called the "Accumulative Overtime Log (AOTL)," (Appendix G) shall be the primary basis for the resolution of disputes over the assignment of overtime in accordance with this Article. The log shall be maintained as follows:
a. Overtime logs shall be maintained on a reasonable effort pay period basis.
b. As overtime assignments are completed, the number of hours, date, and event worked shall be entered next to distribute the employee's name. The number of overtime as equitably as possible among classified employeeshours worked shall be totaled for each employee for each pay period.
c. Overtime logs shall be maintained up-to-date, and shall be posted for inspection by unit employees at all times.
d. Overtime logs shall be made available to SEIU Local 99 Stewards upon request.
4. Management shall attempt to contact the employee for overtime. The employee will indicate preferred method of contact. Employees who work an overtime assignment or are offered an overtime assignment from the Accumulative Overtime Log (AOTL)and do not change or alter accept it, shall be placed at the regular workweek bottom of the list for reassignment. Notwithstanding the foregoing, employees who are offered an overtime assignment to cover for an employee who had previously accepted said assignment may refuse the overtime without losing their place on the "Accumulative Overtime Log (once posted where applicable) AOTL)." The AOTL shall include the preferred method of contact for each employee. Employees who are next on the purpose eligibility list and work a regular schedule during the time the overtime becomes available, shall continuously be next on the list until the overtime is offered to them outside of avoiding the payment of overtime or shift differential. 5. Nothing in this section shall be deemed to bar the District from requiring the employee to work overtime in cases of emergency as determined by the District.
6. The District and the Union will comply with the Fair Labor Standards Act (cFLSA).
7. Overtime opportunities shall be offered to employees as soon as possible when the need for overtime is reasonably foreseeable by management, no less than two (2) With written request and working days’ notice in advance of the assignment shall be given to the relevant employee seniority list. Eligible employees must commit to the overtime within twenty-four (24) hours' noticehours of being notified or forfeit the assignment. Employees who take illness leave during the notice period after committing to an overtime assignment in the same week pursuant to this section shall forfeit the overtime assignment.

Notwithstanding the above, if Management cannot schedule legislated training for regular full-time employees during the employee’s regular scheduled hours, then overtime shall be mandatory for purposes of legislated training as scheduled by Management and equitable manner shall be paid at the applicable overtime rate for both voluntary all hours of training. Distribution of Overtime. Without prejudice to the respective rights of the parties as set out above any discipline for failing to work the assigned overtime shall be preceded by notice to the last employee and shall be made effective no earlier than five (5) working days after notice to be required the employee of such discipline. There shall be one (1) overtime list. This list will be a campus- wide overtime list rotated on the basis of overtime opportunity offered for work. In order for an Employee on the list to be eligible to work overtime in a given area, the Employee must be qualified to perform the work available. Employees are encouraged (with the Supervisor's knowledge) to familiarize themselves with the various buildings and areas in order to be deemed qualified to carry out the necessary assignments when overtime hours are available.
B. When an Employee cannot work overtime for a valid reason, he/she shall be charged for the opportunity, just as if he/she has worked. An Employee who cannot be contacted within 20 minutes (eof contact) to work overtime shall miss that opportunity to work. Refused overtime, approved absences, illness, or overtime for which an Employee could not be contacted, shall count as opportunity for time worked. If classified employees are scheduled for no one within the specific overtime work group can be reached, the overtime will go to any licensed Employee covered by this Agreement. Monday’s overtime requirement postings will be taken down on Wednesday of the same week and will be applied for the Monday through Sunday period of the calendar week in which the schedule becomes effective. The overtime will be awarded via the posted department schedules or by verbal contact with the employees involved. Additional overtime requirements may be posted as necessary provided that adequate time is available for the employee to sign the postings. An employee’s failure to sign-up for posted overtime will be considered a refusal and may be charged accordingly. No employee shall be excluded charged for refusals after having been charged eight (8) hours of overtime in a normal workday, or the number of hours applicable to a mutually agreed to alternative work schedule. If it is not known twenty-four (24) hours prior to the beginning of that shift that overtime will be required, the Company will offer it to the employee working the shift preceding the overtime who is on the top of the overtime list and who is qualified and available to fill the vacancy. When a full shift of overtime is needed, it will be offered in hour units equal to the number of hours for the regular or alternative shift.

Hours refused by a member of the Bargaining Unit shall be credited in the same manner as hours actually worked. Inability to contact a member of the Bargaining Unit shall count as a refusal and date and time of the attempt to contact the member of the Bargaining Unit shall be noted on the log. If the opportunity is refused, it shall be offered to full-time members of the Bargaining Unit scheduled for the contiguous shift immediately following the shift on which the opportunity occurs. Incidental overtime opportunities are those known to the Employer less than eight (8) hours in advance.

If the proper procedure above has been followed and sufficient manpower has not been obtained to fill the overtime opportunity, then the Sheriff may fill the remaining manpower requirement for the overtime detail by either offering the opportunity to a qualified member of another Bargaining Unit covered under this Agreement, or by mandatory assignment of the least senior member of the Bargaining Unit available for work or a Special Deputy at the Sheriffs discretion.

Overtime assignments of employees on the job site shall be rotated on the basis of inverse order of seniority. Such employees shall be deemed to have been offered and to have accepted the overtime work. (h) Institutions and other work units which routinely distribute overtime shall do so on a rotational basis, in a fair and equitable manner for both List 3 below at each correctional facility of their choice. Such participation is voluntary and involuntary distribution any overtime opportunity will only occur after first being offered to those on List 1 and 2. Employees who volunteer for List 3 are responsible for maintaining their core competencies. Employees placed on List 3 are solely requesting voluntary overtime and shall not be subject to any order-in or order-over by virtue of overtime within each such unitvolunteering for List 3. Distribution of Overtime. A. If an Employee is off, upon return to work, he/she must work one full shift before being eligibleto work overtime. There shall be one (a1) Appointing authorities overtime list. This list will be a campus- wide overtime list rotated on the basis of overtime opportunity offered for work. In order for an Employee on the list to be eligible to work overtime in a given area, the Employee must be qualified to perform the work available. Employees are encouraged (with the Supervisor's knowledge) to familiarize themselves with the various buildings and areas in order to be deemed qualified to carry out the necessary assignments when overtime hours are available.
B. When an Employee cannot work overtime for a valid reason, he/she shall make a reasonable effort be charged for the opportunity, just as if he/she has worked. An Employee who cannot be contacted within 20 minutes (of contact) to distribute work overtime shall miss that opportunity to work. Refused overtime, approved absences, illness, or overtime for which an Employee could not be contacted, shall count as equitably as possible among classified employeesopportunity for time worked. If no one within the specific overtime group can be reached, the overtime will go to any licensed Employee covered by this Agreement. Minimum call-in time is four (4) hours at the proper overtime rate (if applicable).
C. Approved absences (with or without pay), illness, and vacancies may be covered by a campus relief person, double covered or, after one (1) week of absence, paid overtime (if applicable).
D. The overtime list shall be monitored by the Chief Xxxxxxx, Management will provide the Chief Xxxxxxx with the necessary documentation to monitor the overtime. This does not change or alter modify the regular workweek role of an employee (once posted where applicable) supervision in authorizing the assignment of overtime, nor the role of management in authorizing overtime. Management shall have no obligation to equalize overtime for Employees not on the overtime list.
E. When a specific overtime assignment has already been started on straight time, then the Employee who began the assignment shall continue on it for the purpose remainder of avoiding that work period. If at any time it is determined that an overtime assignment was not made in accordance with the terms of this Agreement, the remedy shall be make-up overtime work which would not ordinarily be performed on overtime, to take place within thirty (30) days of such determination. Failure to provide such work after such determination shall subject the Company to payment. The Company will have no obligation to provide make-up overtime work to any employee as equitably a result of a call out, with less than one (1) hours’ notice, or holdover of another employee. Distribution of Overtime. 1. The Company will endeavor to distribute available overtime evenly in the Bid Job within the same Job Classification. Available overtime shall be offered to the qualified employee having the lowest amount of overtime hours indicated on the overtime list within his Bid Job in his Job Classification. If an employee is inadvertently by-passed by overtime, and there is an opportunity for him to make up the time, then he shall be given the overtime work to which entitled. The Company will endeavor to keep the overtime balanced in the Bid Job within the Job Classification so as not to exceed eight (8) hours at the end of each calendar month. Employees on vacation may be called and can work overtime provided the overtime list has been run first for employees not on vacation. If an employee does not want overtime, it is his responsibility to exclude himself. If he does, he will not be charged the overtime, otherwise he will be charged. An employee may exclude themselves from overtime if a vacation is included in conjunction with their scheduled off days.
5. An employee having telephone facilities, but who cannot be personally contacted, will be charged for overtime hours.

8. If there is overtime work available at the end of a shift, which the Company estimates will not take more than one hour into the next shift, the Company may retain an employee or employees for overtime up to one hour and employees will be charged hours worked.

Overtime will be distributed as equitably as possible among classified employees, and shall not change or alter the regular workweek of an employee (once posted where applicable) to employees who volunteer for the purpose of avoiding the payment of overtime or shift differential. Distribution of Overtime. (a) Appointing authorities shall make a reasonable effort to The Company will distribute overtime uni- formly among qualified employees normally per- forming the work in question. In the event that it becomes unreasonable to do so because of operating conditions, the Company may distribute overtime by shift. Probationary employees will not participate in overtime distribution unless the entire depart- ment is working, or if the overtime requirements are not fulfilled within the department, within the department or classification. Overtime will be rotated among all qualified employees until each has been offered his turn, after which rotation sequence will start anew. A record of overtime shall be kept for each overtime log number. An employee unable to work overtime when requested shall be credited as equitably having worked his turn. Distribution of Overtime. 1. Overtime will be distributed equally to all qualified employees at a given location, as the circumstances will permit. Each department or operational unit will maintain a list of qualified employees who have requested overtime assignments. The order of placement on the list shall be based upon the order in which the Supervisor has received the written request. In case of simultaneous requests, the order shall be based on seniority.
2. If overtime requires a special skill or knowledge as determined by the Supervisor, it shall be assigned to the employee with that special skill or knowledge who first appears on the overtime eligibility list. Employees with excessive tardiness or absence may, at the District's discretion, be denied overtime. An employee who is denied overtime on the basis of excessive tardiness or absence may appeal this decision for further consideration to his/her site administrator or designee with five (a5) Appointing authorities days' notice in writing, and may be represented by the Union, if he/she so desires, in such appeal.
3. A record of overtime worked shall make be maintained by an employee's immediate Supervisor. This log, called the "Accumulative Overtime Log (AOTL)," shall be the only basis for the resolution of disputes over the assignment of overtime in accordance with this Article. The log shall be maintained as follows:
a. Logs shall be maintained on a reasonable effort pay period basis.
b. As overtime assignments are completed, the number of hours worked shall be entered next to distribute an employee's name. The number of overtime as equitably as possible among classified employeeshours worked shall be totaled for each employee for each pay period. Holiday hours shall not be shown and shall not count in the computation of overtime hours.
c. Logs shall be maintained up-to-date, and shall not change or alter the regular workweek of an employee (once be posted where applicable) for the purpose of avoiding the payment of overtime or shift differential. (a) Bid Job
(b) Qualified employee with the lowest hours in the Sub Group 190 Balance overtime work, non-classified call list: Qualified employees may be authorized that choose to work overtime190 Balance Operator overtime must sign-up on the “overtime call sheet” that is posted in the Administration Building break room. The “overtime call sheet” will be posted Monday- Thursday each week for available 190 Balance Operator overtime in the following week.Employees who choose to sign up and be called for 190 Balance overtime will have the right to accept or deny overtime when called. For the purpose of computing overtime equalization, all eligible employees will be charged overtime hours equal to the amount of hours called. Employees are not permitted to call anyone, including the overtime caller or gatehouse to add or remove his/her name at any time. Each employee must personally sign the “overtime call sheet” to be eligible for receiving overtime calls. It is understood that only the employees who wish to participate in 190 Balance Operator overtime call list must sign up each week.
(f) Employees 10. 13. When it becomes necessary to continue work employee is working on a particular project on an overtime basis, job towards the employee required to perform such overtime work will normally be the one who has been working on the same project during end of his or her regular work hoursshift and the Company deems that the job should continue, the Company may ask the employee to stay up to four (4) hours or until job is finished. Employee will be charged actual hours worked.
(h) Institutions and other work units which routinely distribute overtime shall do so on a rotational basis, in a fair and equitable manner for both voluntary and involuntary distribution 14. There will be no scheduling of overtime within each such unitexcept in the following departments; Shipping and Receiving, Amcycle, the Turnaround Crew, Balance Operator Department, and Tankermen. Overtime can be called seventy-two (72) hours in advance in the appropriate classification.
15. When an employee accepts overtime, it becomes part of his regular schedule and is subject to the Attendance Control Program.
