Documents; Standards. Each party may electronically transmit to or receive from the other party any of the transaction sets listed in the Appendix and transaction sets which the parties by written or mutual agreement add to the Appendix (collectively "Documents"). Any transmission of data which is not a Document shall have no force or effect between the parties unless justifiably relied upon by the receiving party. All Documents shall be transmitted in accordance with the standards and the published guidelines set forth in the Appendix.

No Documents are authorized for use between ABC and SUPPLIER except those listed on Item 2 of Appendix A. The sending party assumes all miscommunication risk arising out of the transmission of data that is not a Document and the receiving party has no responsibility with respect thereto. All Documents shall be transmitted in accordance with the standards set forth on Item 3 of Appendix A.

Either party may modify its election to use, not to use, or to change a service provider upon 30 days prior written notice to the other. i) Each party shall be responsible for the cost of any third party service provider with which it contracts, unless otherwise set forth in the Appendix. ii) As between the parties hereto, each party shall be liable for the acts or omissions of its third party service provider while transmitting, receiving, storing or handling Documents or performing related activities for such party; provided that if both parties use the same third party service provider to effect the transmission and receipt of a Document, as between the parties hereto, the originating party shall be liable for the acts and omissions of such third party service provider as to such Document. c)
Documents; Standards. Xxxxxx Xxx or its designated agent and the Issuer or its agent, so long as such agent is approved by Xxxxxx Xxx, may electronically transmit to or receive from each other various documents and acknowledgements (“Documents”). Transmissions of data or documents that comply with the requirements of the Xxxxxx Xxx Mortgage-Backed Securities Guide (“Xxxxxx Xxx MBS Guide”) and the applicable Xxxxxx Xxx Guaranty Agreement shall have the same force and effect as paper-based documents executed by the parties. If any EDI transmission of data or Documents does not comply with the requirements of the Xxxxxx Xxx MBS Guide, Xxxxxx Xxx’s guaranty and obligations under the Guaranty Agreement shall not take effect. All Documents shall be transmitted in accordance with the standards set forth in the Xxxxxx Xxx MBS Guide.
