Emergency De-commissioning. (a) If, in the reasonable opinion of the Concessionaire, there exists an Emergency which warrants decommissioning and closure to construction of whole or any part of the Project/ Project Facility, the Concessionaire shall be entitled to de-commission and close the whole or the relevant part of the Project construction for so long as such Emergency and the consequences thereof warrant. Provided, however, that such decommissioning will be notified to the Independent Consultant promptly. The Independent Consultant may issue such directions as it may deem appropriate to the Concessionaire for dealing with such Emergency and the Concessionaire shall abide by the same.

Emergency De-commissioning. 16.8.1 If, in the reasonable opinion of the Concessionaire there exists an emergency which warrants decommissioning and closure to traffic of whole or any part of the Project Highway, the Concessionaire shall be entitled to de-commission and close the whole or the relevant part of the Project Highway to traffic for so long as such emergency and the consequences thereof warrant, provided however that such emergency decommissioning will be notified to MPRDC promptly. MPRDC may issue directions to the Concessionaire for dealing with such situations and the Concessionaire shall abide by such directions. MPRDC reserve the rights not to permit such modifications.

The ITEL may issue such directions as it may deem appropriate to the Concessionaire for dealing with such Emergency and the Concessionaire shall abide by the same.

The BSCDCL may issue such directions as it may deem appropriate to the Concessionaire for dealing with such Emergency and the Concessionaire shall abide by the same.
Emergency De-commissioning. (a) Save and except as otherwise expressly provided in this Agreement, if the Project or any part thereof shall suffer any loss or damage during the Concession Period, from any cause whatsoever, the Concessionaire shall, at its cost and expense rectify and remedy such loss or damage in a manner so as to make the Project conform in every respect to the Specifications and Standards, quality and performance as prescribed by this Agreement.

The AUTHORITY may issue such directions as it may deem appropriate to the Operator for dealing with such Emergency and the Operator shall abide by the same.
Emergency De-commissioning a) If DTIDCL, under public interest, is of the opinion that there exists an Emergency or any other situation which warrant decommissioning and closure of whole or any part of the Project/Project Assets, DTIDCL shall notify to the Concessionaire to de-commission and close the whole, or the relevant part of the Project for so long as such Emergency and the consequences thereof warrant. DTIDCL may issue such directions as it may deem appropriate to the Concessionaire for dealing with such Emergency and the Concessionaire shall abide by the same.

Emergency De-commissioning. (a) If, in the reasonable opinion of the Concessionaire there occurs an emergency which warrants decommissioning and closure to traffic of any part or the whole of the Project, the Concessionaire shall be entitled to de-commission and close the relevant part or the whole of the Project to traffic for so long as such emergency and the consequences thereof warrant, provided however that such emergency decommissioning will be notified to LDA Representative promptly. LDA Representative may, subject to the terms of the Agreement, issue directions to the Concessionaire for dealing with such situations and the Concessionaire shall abide by such directions.

  • Emergency Escalation Escalation is strictly for purposes of notifying and investigating possible or potential issues in relation to monitored services. The initiation of any escalation and the subsequent cooperative investigations do not in themselves imply that a monitored service has failed its performance requirements. Upon resumption of standard operations, Agreement Termination requirements and charges will apply as described in Section XIV.

  • Emergency Use In the case of any civil emergency or disaster, the Licensee shall, upon request of the Issuing Authority, make available to the Town a channel for use during the civil emergency or disaster period.
