Common use of Employee Sick Leave Bank Clause in Contracts

Employee Sick Leave Bank. a. All teachers and administrators shall be given the opportunity to be participants in the sick-leave bank. Once an employee has elected to participate that employee shall be a member for the contract year. b. On or before October 1 of each year teachers and administrators may contribute one (1) discretionary day and one (1) sick leave day to the sick-leave bank, such bank to be administered by the Association pursuant to the following guidelines. Licensed employees who do not choose to contribute shall not be eligible for participation. c. If one-half of the eligible teachers and administrators choose not to contribute to the sick-leave bank in any given year, then the sick-leave bank will be suspended for that contract year. d. Should the total days in the sick-leave bank be completely used, each participant shall contribute two (2) additional days of his/her sick leave to the sick leave bank. In the event that the employee has only one sick leave day remaining, he/she must contribute that day. e. To be eligible for sick-leave bank days any participant must, because of an accident or illness, be wholly, and continuously disabled and prevented from performing his/her regular employment and have a disability which requires an absence in excess of five (5) school days; and the participant must have exhausted his/her current discretionary, sick, and any accumulated sick leave days. The sick-leave bank days will be retroactive to the five (5) school days prior to receiving sick-leave bank days. f. The participant shall apply to the Executive Council of OEA for days to be used from the sick leave bank (application for the sick leave bank can be found in Appendix VII: Sick Leave Bank Application and should be made to the OEA President and Sick Leave Bank Committee Head). The initial grant of sick leave by the Sick Leave Bank Committee to an eligible employee shall be from 1 to 20 days. Upon completion of the 20 day period, additional entitlement may be extended by the sick leave pool committee upon demonstration of need by the applicant. g. The President of OEA or his/her designee may require a statement from the staff member’s physician certifying that he/she is incapable of performing his/her duties as a result of the accident or illness. The physician may be asked to certify in writing the number of days absence the given illness or disability requires. Subsequent absences by the employee shall be deducted from the sick leave bank provided the absences are related to the original accident/illness as verified by the staff member’s physician. h. A participant who applies for sick leave bank days shall be eligible for a maximum of two hundred (200) days in a three (3) consecutive school year period for the same accident or illness beginning with the school year in which the first day is drawn from the sick bank. Upon receiving KPERS disability, the participant shall no longer be eligible for sick bank leave days. i. Upon return to full-time service the employee must repay the pool fifty percent (50%) of all borrowed days in excess of 20, at a rate not less than three (3) days per year thereafter. The debiting of the repayment of the days will be done at the beginning of a new school term. Individuals may donate more than three (3) days to replenish the sick leave bank for the amount they used above 20 each year. If the employee wishes to pay back more than the minimum number of days, a letter including the number of days to be paid back must be submitted prior to the first day of school to Payroll. In the event that the employee returns to work prior to using all of the requested days, the extra days will be automatically returned to the sick leave pool. The employee will only be required to pay back fifty percent (50%) of the days used, not borrowed. Employees may donate to sick leave bank participants to help replenish/repay borrowed days in excess of 20. j. At the end of each contract year the unused days in the sick-leave bank shall be distributed as follows: i. If the number of unused days is less than the number of participants, those days shall be carried in the sick-leave bank for the next contract year. ii. If the number of unused days is more than the number of participants, each participant shall be credited with one (1) day of sick leave and the remainder carried in the sick-leave bank for the next contract year. iii. If the number of unused days is more than double the number of participants, each participant shall be credited with two (2) days of sick leave and the remainder carried in the sick-leave bank for the next contract year. iv. Should the bank not function for a period of five (5) consecutive years, the bank shall be considered dissolved and any remaining days will be eliminated.
