Enforcement Mechanisms. The state shall have the mechanism to restrain immediately and effectively any person engaging in any unauthorized activity or operation, which is endangering or causing damage to public health or the environment as applicable to the program requirements. The Commission shall also have the means to sue in courts of competent jurisdiction to prohibit any threatened or continuing violation of any UIC program requirement. Additionally, the Commission shall have the mechanism to access or sue to recover in court civil penalties and criminal remedies as established in the Texas Water Code, Chapter 27, Subchapter F, and 40 CFR §145.13.
Enforcement Mechanisms. Licensee acknowledges and agrees that (a) Licensed Software will only operate on servers on which valid license keys are installed and (b) Licensed Software may contain certain other mechanisms to enforce the Licensed Storage Amount limitation and the other limitations set forth in this Agreement. Cloudian will have no liability of any kind in connection with any inability of Licensee to use the Licensed Software or the Cloudian Product in excess of such limitations due to such mechanisms or any other causes.
Enforcement Mechanisms. The federal government has available several enforcement mechanisms that it may apply to firms participating in the DBE program, including, but not limited to, the following:
X. Xxxxxxxxxx or debarment proceedings pursuant to 49 CFR Part 26 B. Enforcement action pursuant to 49 CFR part 31 C. Prosecution pursuant to 18 USC 1001.
Enforcement Mechanisms. The EUTCA includes mutual commitments not to lower standards on the environment, workers right and climate change and includes provisions ensuring mutual enforcement. There is a mutual right to “rebalance” the agreement in the event of significant divergences between the UK and the EU that may impact trade. This rebalancing clause is much stricter than measures found in other EU trade deals. The UK has also agreed to accept common principles on state aid and to the concept of an independent competition agency to assess those state aid regimes. Xxxxxxx could be imposed if either side moves too far away from the other and a binding arbitration system has been agreed as a means of policing the overall agreement. The ECJ will continue to play a role in Northern Ireland, which will remain subject to EU single market and customs union rules.
Enforcement Mechanisms. Appropriate mechanisms should be in place to ensure that the following objectives are achieved:
(i) to ensure a good level of compliance with the rules, including a high degree of awareness among data controllers of their obligations, and among data subjects of their rights and the means of exercising them; the existence of effective and dissuasive sanctions; and systems of verification by authorities, auditors or independent data protection officials;
(ii) to provide support and help to individual data subjects in the exercise of their rights, which they must be able to enforce rapidly and effectively, and without prohibitive cost, including through an appropriate institutional mechanism allowing independent investigation of complaints;
(iii) to provide appropriate redress to the injured party where rules are not complied with, allowing compensation to be paid and sanctions imposed where appropriate.

Enforcement Mechanisms. SFMTA will bring to the attention of DOT any false, fraudulent, or dishonest conduct in connection with the Program so that DOT can take the steps (e.g. referral to the Department of Justice for criminal prosecution, referral to the DOT Inspector General, action under suspension and debarment or Program Fraud and Civil Penalties rules) provided in Section 26.109. Contractor may also be subject to penalties and/or a debarment action under the San Francisco Administrative Code, or liquidated damages for failure to meet particular contract SBE requirements. Failure to comply with the requirements of the SBE Program constitutes a material breach of contract and will be grounds for termination of the contract. Funds may also be withheld under the Contract pending investigation of a complaint of violation of the SBE Program.
Enforcement Mechanisms. 1. Carrying out of a review of the legal and regulatory framework applicable to tax administration in order to improve, if needed, the procedures related to: (a) tax collection, investigation and auditing; and (b) the application of sanctions to tax evaders.
2. Strengthening of the tax auditing department of the SAT, through: (a) the design and implementation of: (i) an audit information system; (ii) procedures for, inter alia: (A) the selection, programming and execution of taxpayer audits; and (B) supervising and monitoring of taxpayer audits; and (iii) a training program for the benefit of the personnel mentioned in (b) herein; (b) the hiring of qualified personnel to carry out tax audits for the SAT; and (c) the acquisition and utilization of goods required therefor. Part D: Social Communications
1. Carrying out of a national campaign (consisting, inter alia, of seminars, workshops and media campaigns) to inform the public with respect to, inter alia: (a) the establishment and functioning of the SAT; (b) the changes introduced or to be introduced in the tax laws and their regulations; (c) the rights and obligations of the taxpayers; and (d) the improved systems and procedures for tax compliance referred to in Parts B.1 and B.2 above, including the design, printing and distribution of materials required therefor.
2. Carrying out of national surveys to assess the public’s understanding and awareness of the existing legal and regulatory framework applicable to taxation.
3. Design and implementation of a program to educate students attending primary, secondary and tertiary schools with respect to the rights and obligations of taxpayers.
4. Provision of training to the personnel of the SAT concerning the structure and functions of the SAT.
