Extraordinary Expense Reimbursement. All Settlement Class members who submit a valid Claim are also eligible to recover compensation for up to $5,000 of their documented extraordinary monetary out-of-pocket losses incurred on or after October 5, 2021, as a result of the Incident. This category of compensation requires documentation plausibly supporting that the loss was not reimbursed by any other source, the loss was in material part caused by the Incident, and the Settlement Class member made reasonable efforts to avoid, or seek reimbursement for, the loss, including but not limited to exhaustion of all available credit monitoring insurance and identity theft insurance. The determination of whether a loss was “in material part” caused by the Incident shall be determined by the Claims Administrator. Any Settlement Class member who suffered documented fraud, attempted fraud, or publication or actual misuse associated with PHI compromised as a result of the Incident shall have the right to claim up to an additional three hours of lost time, at $20 per hour, for time spent remedying the fraud or attempted misuse, subject to the $5,000 extraordinary expense cap.

Extraordinary Expense Reimbursement. All members of the Settlement Class who have 28 suffered a proven monetary loss and who submit a Valid Claim using the Claim Form are eligible for 1 up to $10,000 if: (1) the loss is an actual, documented, and unreimbursed monetary loss requiring the 2 submission of a proof of loss under penalty of xxxxxxx; (2) the loss was caused by the Data Incident; (3) 3 the loss occurred between January 16, 2021, and the Claims Deadline; and (4) the loss is not already 4 covered by one or more of the reimbursement categories listed in ¶ 2.1; and the member of the Settlement 5 Class made reasonable efforts to avoid, or seek reimbursement for, the loss, including but not limited to 6 exhaustion of all available credit monitoring insurance and identity theft insurance.
Extraordinary Expense Reimbursement. Xxxxxx shall reimburse, as provided for below, each Settlement Class Member in the amount of his or her proven loss, but not to exceed five thousand dollars and no cents ($5,000.00) per claim (and only one claim per Settlement Class Member), for a monetary out-of-pocket loss that occurred as a result of the Data Incident if: (a) the loss is an actual, documented, and unreimbursed monetary loss; (b) the loss was substantially more likely than not caused by the Data Incident; (c) the loss occurred during the period from August 27, 2021, through and including the end of the Claims Deadline (see ¶ 2.4); (d) the loss is not an amount already covered by one or more of the categories in ¶ 2.1; and (e) the claimant made reasonable efforts to avoid or seek reimbursement for the loss, including, but not limited to, exhaustion of all available credit monitoring insurance and identity theft insurance as required under ¶ 2.4.4. The total of all amounts recovered under this paragraph shall not exceed $5,000.00 per Settlement Class Member. Settlement Class Members with claims under this paragraph may also submit claims for benefits under ¶ 2.1.

Extraordinary Expense Reimbursement. Settlement Class Members are also eligible to receive extraordinary expense reimbursement, not to exceed $7,500 per Settlement Class Member, for monetary out-of-pocket losses that were plausibly caused by the Data Incident if: (a) it is an actual, documented, and unreimbursed monetary loss; (b) was caused by the Data Incident; (c) occurred during the time period from August 4, 2020, through the date of this Settlement Agreement (see ¶ 2.4); (d) is not an amount already covered by one or more of the categories in ¶ 2.1; (e) the claimant made reasonable efforts to avoid, or seek reimbursement for the loss, including but not limited to exhaustion of all available credit monitoring insurance and identity theft insurance. Compensation under this paragraph requires documentation, including proof of monetary loss occurring primarily because of the Data Incident and proof of reasonable mitigation efforts. Settlement Class Members may only submit one claim for benefits under this paragraph ¶ 2.2 and the total of all amounts recovered under this paragraph shall not exceed $7,500 per Settlement Class Member.
Extraordinary Expense Reimbursement. Settlement Class Members who submit a valid claim using the Claim Form are eligible to receive extraordinary expense reimbursement of up to $7,500 per Settlement Class Member for monetary out-of-pocket losses that was plausibly caused by the Data Incident if: • It is an actual, documented, and unreimbursed monetary loss; • Occurred during the time period from August 2020, through and including [INSERT DATE OF SETTLEMENT AGREEMENT]; • Is not an amount already covered by one or more of the categories in ordinary expense reimbursement listed above; and • You made reasonable efforts to avoid, or seek reimbursement for the loss, including but not limited to exhaustion of all available credit monitoring insurance and identity theft insurance, to be supported with documentation.
Extraordinary Expense Reimbursement. All members of the Settlement Class who have suffered a proven monetary loss and who submit a Valid Claim using the Claim Form are eligible for reimbursement of up to $5,000 if: (1) the loss is an actual, documented and unreimbursed monetary loss; (2) the loss was more likely than not caused by the Data Incident; (3) the loss occurred between January 26, 2023 and the Claims Deadline; (4) the loss is not already covered by one or more of the reimbursement categories listed in ¶ 2.1; and (5) the member of the Settlement Class made reasonable efforts to avoid, or seek reimbursement for, the loss, including but not limited to exhaustion of all available credit monitoring insurance and identity theft insurance. Members of the Settlement Class seeking reimbursement under ¶¶ 2.1 and/or 2.2 must complete and submit a Claim Form to the Claims Administrator, postmarked or submitted online on or before the 90th day after the Notice Commencement Date. The notice to the class will specify this deadline and other relevant dates described herein. The Claim Form must be verified by the member of the Settlement Class with a statement that his or her claim is true and correct, to the best of his or her knowledge and belief, and is being made under penalty of perjury. Notarization shall not be required. The member of the Settlement Class must submit reasonable documentation that the out-of-pocket expenses and charges claimed were both actually incurred and plausibly arose from the Data Incident. Failure to provide supporting documentation of the out-of-pocket expenses referenced above, as requested on the Claim Form, shall result in denial of a claim. No documentation is needed for lost-time expenses. Disputes as to claims submitted under this paragraph are to be resolved pursuant to the provisions stated in ¶ 2.4.
