FAMILY EDUCATIONAL RIGHTS AND PRIVACY. Act (FERPA). Parental consent must be obtained before personally identifiable information is used for any purpose other than meeting a requirement under the Individuals with Disabilities Education Act or disclosed to anyone other than officials of agencies collecting or using this information. The District may not release information from these records without parental consent except as provided in the Family Educational Rights and Privacy Act (FERPA).
FAMILY EDUCATIONAL RIGHTS AND PRIVACY. Act (FERPA) You hereby appoint Us as your agent for purposes of assuming duties that would otherwise be provided by You and providing the Services specified in this Agreement. The Services require Us to have access to personally identifiable information regarding Your students. As Your agent, We are subject to and shall comply with the Family Educational Rights and Privacy Act (FERPA) and its prohibitions against disclosure of personally identifiable information regarding students to third parties in connection with the Services and the License provided hereunder, except where permitted by the regulations of the United States Department of Education. We will take all necessary steps including, but not limited to, secure FTP, encryption, firewalled servers, and database systems that are inaccessible from the internet to protect confidential and directory information
FAMILY EDUCATIONAL RIGHTS AND PRIVACY. Act Customers subject to the Family Educational Rights and Privacy Act, 34 C.F.R. §99 et. seq. (“FERPA”), appoint Company aschool official” as that term is used in FERPA, and determine that Company has a “legitimate educational interestfor the purpose of carrying out its responsibilities under this Agreement. Company shall be bound by the relevant provisions of FERPA, including that it will remain under the “direct controlof Customer with respect to its use and maintenance ofeducation records” as that term is defined in FERPA. Company will use personally identifiable student data only as necessary to fulfill the Services in performance of this Agreement, and will only share personally identifiable student data with its third-party vendors as necessary to fulfill the Services in performance of this Agreement.

To comply with FERPA and the Family Privacy Protection Act of 2002, Vendor shall maintain the confidentiality of any student educational and personal information or records to which it has access. Vendor shall use and/or disclose protected student educational and personal information or records only to the extent necessary to satisfy obligations under this Agreement and may only do so consistent with this Agreement and FERPA. Such information may not be released without a properly completed authorization signed by the student’s parent or guardian. If information is released pursuant to the receipt of a properly completed authorization, documentation of the release must be maintained. A copy of the authorization must be included in this documentation.

Educational authorities conducting audit, evaluation, or enforcement of education programs; d. Appropriate parties in connection with financial aid to a student; e. Organizations conducting certain studies for or on behalf of the school; f. Accrediting organizations; g. To comply with a judicial order or lawfully issued subpoena; h. Appropriate officials in cases of health and safety emergencies; and i. Parents/Guardians/Relative Caregivers of a dependent student. For students in Xxxxxx Care, the Uninterrupted Scholars Act permits educational agencies and institutions to disclose a student's educational records, without parental consent, to a caseworker or other representative of a State or local child welfare agency authorized to access a student's case plan when such agency or organization is legally responsible, in accordance with the State law, for care and the protection of the student. 20 U.S.C. § 1232g(b)(1)(L). Schools may disclose, without consent, "directory information” including a student's name, address, telephone number, date and place of birth, major field of study, participation in officially recognized activities and sports, weight and height of members of athletic teams, degrees and awards received, dates of attendance, and the most recent previous educational agency or institution attended by the student. 20 U.S.C. § 1232g(a)(5)(A). Directory information does not include student identification numbers or Social Security numbers. However, schools must give public notice of the categories of information which it has designated as “directory information” and allow Parents/Guardians/Relative Caregivers and eligible students a reasonable period of time after such notice has been given for a Parent/Guardians/Relative Caregiver to inform the school that any or all information designated should not be released without prior consent. 20 U.S.C. § 1232g(a) (5)(B).
FAMILY EDUCATIONAL RIGHTS AND PRIVACY. Act (FERPA) and Xxxxx-Xxxxx-Xxxxxx Act (GLBA): Information and relevant data that the Contractor may gather during the performance of this Agreement may include personal information that is protected under the provisions of the federal Family Educational Rights and Privacy Act (FERPA), and the federal Xxxxx-Xxxxx-Xxxxxx Act (GLBA) (15 U.S.C § 6801, et seq., or section 4-190 through 4-197 of the C.G.S). The Contractor must take sufficient steps to safeguard the information and data from unauthorized disclosure. These safeguards must be in place from the time the data is gathered until the completion of the contract and any retention period and destruction of the relevant data or information.

  • Data Privacy Participant hereby explicitly and unambiguously consents to the collection, use and transfer, in electronic or other form, of Participant’s personal data as described in this Award Agreement and any other Restricted Stock Unit grant materials by and among, as applicable, the Employer, the Company and any Parent or Subsidiary for the exclusive purpose of implementing, administering and managing Participant’s participation in the Plan. Participant understands that the Company and the Employer may hold certain personal information about Participant, including, but not limited to, Participant’s name, home address and telephone number, date of birth, social insurance number or other identification number, salary, nationality, job title, any Shares or directorships held in the Company, details of all Restricted Stock Units or any other entitlement to Shares awarded, canceled, exercised, vested, unvested or outstanding in Participant’s favor (“Data”), for the exclusive purpose of implementing, administering and managing the Plan. Participant understands that Data will be transferred to a stock plan service provider as may be selected by the Company in the future, which is assisting the Company with the implementation, administration and management of the Plan. Participant understands that the recipients of the Data may be located in the United States or elsewhere, and that the recipients’ country of operation (e.g., the United States) may have different data privacy laws and protections than Participant’s country. Participant understands that if he or she resides outside the United States, he or she may request a list with the names and addresses of any potential recipients of the Data by contacting his or her local human resources representative. Participant authorizes the Company, any stock plan service provider selected by the Company and any other possible recipients which may assist the Company (presently or in the future) with implementing, administering and managing the Plan to receive, possess, use, retain and transfer the Data, in electronic or other form, for the sole purpose of implementing, administering and managing his or her participation in the Plan. Participant understands that Data will be held only as long as is necessary to implement, administer and manage Participant’s participation in the Plan. Participant understands if he or she resides outside the United States, he or she may, at any time, view Data, request additional information about the storage and processing of Data, require any necessary amendments to Data or refuse or withdraw the consents herein, in any case without cost, by contacting in writing his or her local human resources representative. Further, Participant understands that he or she is providing the consents herein on a purely voluntary basis. If Participant does not consent, or if Participant later seeks to revoke his or her consent, his or her status as a Service Provider and career with the Employer will not be adversely affected; the only adverse consequence of refusing or withdrawing Participant’s consent is that the Company would not be able to grant Participant Restricted Stock Units or other equity awards or administer or maintain such awards. Therefore, Participant understands that refusing or withdrawing his or her consent may affect Participant’s ability to participate in the Plan. For more information on the consequences of Participant’s refusal to consent or withdrawal of consent, Participant understands that he or she may contact his or her local human resources representative.
