FIPPA. The HSP acknowledges that the LHIN is bound by FIPPA and that any information provided to the LHIN in connection with this Agreement may be subject to disclosure in accordance with FIPPA.
FIPPA. The HSP acknowledges that the Funder is bound by FIPPA and that any information provided to the Funder in connection with this Agreement may be subject to disclosure in accordance with FIPPA.
FIPPA. The Recipient acknowledges that the Province is bound by the Freedom of Information and Protection of Privacy Act (Ontario) and that any information provided to the Province in connection with the Project or otherwise in connection with the Agreement may be subject to disclosure in accordance with that Act.
FIPPA. The HSPacknowledges that the LHIN is bound by FIPPA and that any information provided to the LHIN in connection with this Agreement may be subject to disclosure in accordance with FIPPA.
FIPPA. The parties acknowledge that the IESO is subject to the Freedom of Information and Protection of Privacy Act and that said act applies to confidential information in the custody or control of the IESO.
FIPPA. (a) Hospital and the Contracting Parties acknowledge and agree that, subject only to removal of information that falls within one of the exemptions under FIPPA unless consented to by the Contracting Parties under Section 17(3) of FIPPA, this Project Agreement and the Implementing Agreements are public documents that may be disclosed or published (including on websites) by Hospital.
(b) The Contracting Parties further acknowledge and agree that Hospital will be free to disclose any information, including this Project Agreement and the Implementing Agreements and any Confidential Information, to PIR, Infrastructure Ontario, MOHLTC and/or the Province and, subject to compliance with FIPPA, PIR, Infrastructure Ontario, MOHLTC and/or the Province will be free to use, disclose or publish (including on websites) the information on such terms and in such manner as PIR, Infrastructure Ontario, MOHLTC and/or the Province see fit.
(c) For greater certainty, the Contracting Parties acknowledge and agree that, subject only to the removal of any information pursuant to one of the exemptions under FIPPA, this Project Agreement or any of the Implementing Agreements, any contractual submissions or other records kept in accordance with this Project Agreement or any of the Implementing Agreements, any information related to the performance of the Contracting Parties or any information derived from this Project Agreement or any of the Implementing Agreements, including Confidential Information are public documents and information and, as such, may be disclosed by Hospital, PIR, Infrastructure Ontario, MOHLTC and/or the Province (the “Disclosing Parties”).
FIPPA. The Recipient acknowledges that the Province is bound by the FIPPA.
FIPPA. Without limiting the foregoing, the Participant acknowledges and agrees that this Agreement and all Confidential Information in the custody and control of the IESO or the Participant are subject to Applicable Laws that include the access provisions of FIPPA and that as a result, third parties may obtain access to each Party’s Confidential Information. Moreover, the Participant acknowledges that the IESO and its Representatives are subject to FIPPA which applies to and governs all recorded information in any form or medium, including Confidential Information, that is in the custody or control of the IESO (collectively, the “Records”), and may require the disclosure of the Records to third parties. To the extent that the IESO must comply with disclosure obligations under FIPPA, the Participant agrees:
(a) To keep the Records in its possession secure;
(b) To provide a copy of any Records to the IESO within seven (7) calendar days of being directed to do so by the IESO for any reason under FIPPA including an access request or privacy issue; and
(c) To implement other specific security measures that in the reasonable opinion of the IESO would improve the adequacy and effectiveness of the Participant’s measures to ensure, for the purposes of FIPPA, as applicable, the security and integrity of the Records held in the Participant’s possession.
FIPPA. The Supplier and the Purchaser acknowledge and agree that as of January 1, 2012, the Freedom of Information and Protection of Privacy Act (Ontario) (“FIPPA”) applies to and governs certain information. The Purchaser will maintain the confidentiality of this information in accordance with the provisions of FIPPA. However, the Supplier acknowledges and agrees that FIPPA may also require the disclosure of such information to third parties.
FIPPA. The Client acknowledges that all records prepared by the University in the performance of this Agreement are in the custody and control of the University. The University is, or will be subject to, the access and privacy provisions of The Freedom of Information and Protection of Privacy Act (Manitoba), which creates a right of access to records under the custody and control of public bodies subject to specific, limited exceptions. Except as required by law or as otherwise permitted pursuant to the terms of this Agreement, neither the University nor the Client will disclose the contents of this Agreement, or the foregoing records, other than for the purpose of implementation or enforcement of the same or for a general statement on the parties to the Agreement, the amount being paid for the Service and the general nature of the Service, either party being entitled to publish that information.
