First Come, First Serve - Accrued Leave Requests. First come, first serve requests cover all accrued leaves (except sick leave). First come, first serve requests may be submitted immediately following the sign-up periods for pre-determined leave, and can cover the period of time until the next pre-determined leave sign-up period. These will be held, and then reviewed for approval, for the current month and following month only. Employee accrued leave requests submitted during this period shall be granted on a first come, first serve basis subject to the operating requirements of the Agency. Ties shall be broken by seniority. Monthly accrued leave schedules which result from this Section shall be posted no later than the 20th of the preceding month. Should a dispute arise concerning the operating requirements of the Agency, the issue must be immediately filed and will be given an expedited hearing at Step 3 of the grievance procedure within four (4) business days. An answer will be given within one (1) business day of the Step 3 hearing. Leave request denials shall be accompanied by the reason for the denial. Individual support areas may meet and attempt to reach consensus on a different process for first come first serve requests. Participants shall include manager and xxxxxxx and others. Xxxxxxxxx must be put in writing and signed off by the personnel director and AFSCME representative and will be posted in the work area. Consensus must include no increase in overtime and assurance that training needs are met. Consensus must be reached within fifteen (15) working days from start to finish of the process. If consensus is not reached, support area may ask assistance of management and union to help facilitate the process. If no consensus is reached, current contract language above prevails.

  • Certification of Funds; Budget and Fiscal Provisions; Termination in the Event of Non-Appropriation This Agreement is subject to the budget and fiscal provisions of the City’s Charter. Charges will accrue only after prior written authorization certified by the Controller, and the amount of City’s obligation hereunder shall not at any time exceed the amount certified for the purpose and period stated in such advance authorization. This Agreement will terminate without penalty, liability or expense of any kind to City at the end of any fiscal year if funds are not appropriated for the next succeeding fiscal year. If funds are appropriated for a portion of the fiscal year, this Agreement will terminate, without penalty, liability or expense of any kind at the end of the term for which funds are appropriated. City has no obligation to make appropriations for this Agreement in lieu of appropriations for new or other agreements. City budget decisions are subject to the discretion of the Mayor and the Board of Supervisors. Contractor’s assumption of risk of possible non-appropriation is part of the consideration for this Agreement. THIS SECTION CONTROLS AGAINST ANY AND ALL OTHER PROVISIONS OF THIS AGREEMENT.

  • Service and Seniority Continuation While on pregnancy/birth or parental, or adoption leave, a Nurse shall continue to accrue and accumulate Service and Seniority credits at the same rate as before the leave for the duration of the leave and the Nurse’s Service and Seniority shall be deemed to be continuous. This provision is not applicable to a Casual Nurse.

  • Annual Leave Accrual If an employee leaves State Classified employment and is later rehired, he/she shall accrue annual leave at the same rate as a new hire. However, once a rehired employee has been in pay status for five (5) years, all previous service time shall be credited for annual leave accrual. The only exception shall be for employees rehired who repay severance pay received.

  • Sick Leave Accumulation a. All unused days of sick leave at full pay for all employees, shall accumulate to a maximum of two hundred ten (210) days. Such sick leave benefits so accrued will be usable after the annual full days allowed, and prior to any half pay benefits.

  • Available Funds-Contingency-Termination a. The State is prohibited by law from making commitments beyond the term of the current State Fiscal Year. Payment to Local Agency beyond the current State Fiscal Year is contingent on the appropriation and continuing availability of Agreement Funds in any subsequent year (as provided in the Colorado Special Provisions). If federal funds or funds from any other non-State funds constitute all or some of the Agreement Funds, the State’s obligation to pay Local Agency shall be contingent upon such non-State funding continuing to be made available for payment. Payments to be made pursuant to this Agreement shall be made only from Agreement Funds, and the State’s liability for such payments shall be limited to the amount remaining of such Agreement Funds. If State, federal or other funds are not appropriated, or otherwise become unavailable to fund this Agreement, the State may, upon written notice, terminate this Agreement, in whole or in part, without incurring further liability. The State shall, however, remain obligated to pay for Services and Goods that are delivered and accepted prior to the effective date of notice of termination, and this termination shall otherwise be treated as if this Agreement were terminated in the public interest as described in §2.C.

  • Pay for Unused Sick Leave Unused sick leave not to exceed 70 days will be paid at the rate of $50 per day when the teacher retires or leaves U.S.D. 506 employment, provided the teacher has a minimum of 10 years of service in U.S.D. 506. Article VI: Activity Ticket Each teacher of U.S.D. 506 shall be issued an activity ticket, which shall be honored at all regular school functions held within the district. Said ticket shall not be honored at basketball tournaments and special events. Said ticket shall be honored for employee, spouse, and children who have not yet graduated from high school. The Board of Education will have an expectation that those teachers in attendance at school functions will assume a reasonable amount of general supervision as needed.
