Employment Security and Income Maintenance Plan. 53.1 The provisions of the Supplemental Agreement governing the Employment Security and Income Maintenance Plan will apply to employees covered by this Agreement as specified therein.

Employment Security and Income Maintenance Plan. The parties hereto agree to meet within days following signing of the Memorandum of Agreement referred to in Clause hereof to the Employment Security provisions of this Memorandum of Settlement, and Article of Agreement as amended hereby so that an Security and Income Maintenance Plan will established in respect of employees covered by this Memorandum of Settlement. PASSES The Unions' proposal concerning Passes is resolved on the basis of the letter attached hereto as Appendix "A".

ARTICLE When through an unusual development it becomes necessary to transfer work from a seniority district to another seniority district, not more than a sufficient number of employees to perform such work shall, in seniority order, be given the opportunity to transfer, carrying their seniority rights with them. The proper officer of the Company and the National President shall cooperate to determine the number of employees who shall transfer. Employees who transfer under this provision shall after calendar days lose their seniority on the seniority district they left.

ARTICLE Final Settlement of Disputes Without Stoppage of Work A grievance concerning the interpretation or alleged violation of this Agreement or an appeal by an employee that has been unjustly disciplined which is not settled at Step of the grievance procedure shall be submitted to the mutually agreed upon Arbitrator for final settlement without stoppage of work. Request for arbitration must be given within calendar days from the date of receiving decision at Step of the grievance procedure. Disputes arising out of proposed changes in rates of pay, rules, or working conditions, modifications in or additions to the terms of this Agreement are specifically excluded from the jurisdiction of the Canadian Railway Office of Arbitration.
