Common use of FLSA Overtime Clause in Contracts

FLSA Overtime. 1. Effective August 23, 2004, shift Fire Captains will receive FLSA overtime pay for all hours worked in excess of 212 hours during a 28-day work period at a rate of time and one-half the employee's regular rate of pay. For purposes of this section, hours worked shall mean only those hours actually worked during the work period. Paid leave time shall not count as hours worked for purposes of determining eligibility for FLSA overtime. 2. Effective June 27, 2005, shift Fire Captains will receive FLSA overtime pay for all hours worked in excess of 212 hours during a 28-day work period at a rate of time and one-half the employee's regular rate of pay. For purposes of this section, hours worked shall mean those hours actually worked during the work period and paid-leave time. 3. Effective August 22, 2005, shift Fire Captains will receive FLSA overtime pay for all hours worked in excess of 212 hours during a 28-day work period at a rate of time and one-half the employee's regular rate of pay. For purposes of this section, hours worked shall mean those hours actually worked during the work period and, exclusive of IOD time, paid- leave time. For the purpose of calculating FLSA overtime, the City agrees to count up to 30 consecutive shifts for each incident of IOD as hours worked, or up to 30 cumulative shifts in any one 12-month period per incident of IOD, including related incidents of IOD, as hours worked.
