Force Account Change Orders. A Force Account Change Order may be used in the event (i) CM/GC and Owner cannot agree on the Change Order Sum for a Lump Sum Change Order, (ii) costs associated with a Change Order cannot be reasonably determined prior to beginning the Change Order Work, or (iii) the Owner and CM/GC have agreed to Unit Prices for the Work but cannot determine the number of Units involved in the Change Order (“Unit Price Change Order”).

Force Account Change Orders. TxDOT may at its discretion issue a Force Account Change Order whenever TxDOT determines that it is advisable. The Force Account Change Order shall instruct DB Contractor to perform the additional (or modified) Maintenance Services, indicate expressly the intention to treat the items as changes in the Maintenance Services, set forth the kind, character, and limits of the Maintenance Services as far as they can be ascertained, state the terms under which changes to the Maintenance Price will be determined and state a not-to-exceed (NTE) total change in the Maintenance Price. DB Contractor will maintain its records as required by Section 4.5.12 and submit daily records in accordance with Section 4.5.12.2.1. If DB Contractor determines that the costs of the Maintenance Services authorized pursuant to a Force Account Change Order will exceed the stated NTE, DB Contractor shall notify TxDOT of the additional costs required to complete such Work and TxDOT may approve an increase to the stated NTE. DB Contractor is not obligated to perform Work authorized pursuant to a Unit-priced Change Order once the approved NTE (as it may be adjusted) has been reached. Upon final determination of the allowable costs and subject to Section 4.5.12.2.4, TxDOT shall issue a modified Change Order setting forth the final adjustment to the Maintenance Price, which shall not exceed the stated NTE amount (as such amount may be adjusted as described herein).
Force Account Change Orders. The District may at its discretion issue a Force Account Change Order whenever the parties cannot agree to a Lump Sum Change Order or the District concludes that a Force Account Change Order is advisable. The Force Account Change Order shall instruct the DB Contractor to perform the Work, indicating expressly the intention to treat the items as changes in the Work and setting forth the kind, character, and limits of the Work as far as they can be ascertained; the terms under which changes to the Contract Price will be calculated; and the estimated total change in the Contract Price anticipated there under. Upon final calculation of the allowable costs, the District shall issue a modified Change Order setting forth the final adjustment to the Contract Price. The costs and additional amounts allowed in Section 15 (and no others) shall be used for calculating the change in the Contract Price. No direct compensation will be allowed for other miscellaneous costs for which no specific allowance is provided in Section 15.5. The District and the DB Contractor may agree to negotiate unit prices for a Force Account Change Order. Measurement of any unit-priced quantities will be as specified in the Change Order. Unit prices shall be deemed to include all costs for labor, material, overhead, and profit; and shall not be subject to change regardless of any change in the estimated quantities. Upon final determination of the quantities, the District will issue a modified Change Order setting forth the final adjustment to the Contract Price.

VPRA may also issue a Directive Letter with pricing determined on a Force Account basis.

  • Force Account The Change Order cost is accomplished by Force Account in the event the Contractor and Design Professional cannot agree on the cost of the Change Order or the cost cannot be reasonably determined prior to beginning the Work.

  • Agreement Changes The Company reserves the right to change the terms of this Agreement and the Plan without your consent to the extent necessary or desirable to comply with the requirements of Code section 409A, the Treasury regulations and other guidance thereunder.

  • Contract Changes Changes may not be made in the terms and conditions of this contract without the agreement and written permission of the Director of Residence Life or the Director’s designee.

  • Operating Account To the extent funds are not required to be placed in a lockbox pursuant to any Loan Documents, Property Manager shall deposit all rents and other funds collected from the operation of the Property in a reputable bank or financial institution in a special trust or depository account or accounts for the Property maintained by Property Manager for the benefit of the Company (such accounts, together with any interest earned thereon, shall collectively be referred to herein as the “Operating Account”). Property Manager shall maintain books and records of the funds deposited in and withdrawals from the Operating Account. With funds from Company, Property Manager shall maintain the Operating Account so that an amount at least as great as the budgeted expenses for such month is in the Operating Account as of the first of each month. From the Operating Account, Property Manager shall pay the operating expenses of the Property and any other payments relative to the Property as required by this Agreement. If more than one account is necessary to operate the Property, each account shall have a unique name, except to the extent any Lender requires sub-accounts within any account. Within three (3) months after receipt by Property Manager, all rents and other funds collected in the Operating Account, after payment of all operating expenses, debt service and such amounts as may be determined by the Property Manager to be retained for reserves or improvements, shall be paid to the Company.

  • Change Orders Any alteration or deviation from the Services mentioned or any other contractual specifications that result in a revision of this Agreement shall be executed and attached to this Agreement as a change order (“Change Order”).
