Formal Stagefsk. If the aggrieved is not satisfied with the solution provided by the “Informal Stage,” the aggrieved or his/her representative, the Grievance Committee, may appeal to the Assistant Superintendent for Business, in writing, for review and determination. All such appeals must be brought no later than thirty (30) working days after the grievant knew or should have known of the facts underlying the grievance. Within five (5) work days of receipt of said written grievance, the Assistant Superintendent for Business must render a formal decision to the aggrieved and/or his/her representative in writing. If the grievance is not satisfactorily resolved at the level of the Assistant Superintendent for Business the aggrieved, within ten (10) days of receipt of the said Assistant Superintendent’s written decision, may appeal, in writing, to the Superintendent of Schools. Such written statement should set forth the specific nature of the grievance and the facts relating thereto. This statement shall indicate clearly that this is a statement of grievance and that the matter has already been determined by the Assistant Superintendent for Business. The employee shall waive any objection to disclosure of any matters in his/her personnel file for purposes of the hearing. Upon receipt of such written statement, the Superintendent of Schools will call a hearing within five (5) work days. At the hearing, the aggrieved or his/her representative may appear and present oral and/or written arguments. The Superintendent shall consider also verbal and/or written testimony by the building principal or immediate supervisor and Assistant Superintendent of Business, and a copy will also be filed with the District. The Superintendent’s report shall be in writing and shall contain a statement of his/her findings, fact, and conclusions and recommendations. The Superintendent shall send a copy of this report to each employee involved, his/her representative, if he/she has chosen to have a representative, his/her immediate supervisor and/or his/her building principal and to the Assistant Superintendent for Business, and a copy will also be filed with the H:\CSEA_Agreement_2007_-_2011_( 10150S).doc District. These reports must be submitted by the Superintendent of Schools within five (5) work days following the hearing.

  • Feasibility Study Buyer will, at Buyer's expense and within ____ days from Effective Date ("Feasibility Study Period"), determine whether the Property is suitable, in Buyer's sole and absolute discretion, for ___________________ use. During the Feasibility Study Period, Buyer may conduct a Phase I environmental assessment and any other tests, analyses, surveys and investigations ("Inspections") that Buyer deems necessary to determine to Buyer's satisfaction the Property's engineering, architectural and environmental properties; zoning and zoning restrictions; subdivision statutes; soil and grade; availability of access public roads, water, and other utilities; consistency with local, state and regional growth management plans, availability of permits, government approvals, and licenses; and other inspections that Buyer deems appropriate to determine the Property's suitability for the Buyer's intended use. If the Property must be rezoned, Buyer will obtain the rezoning from the appropriatx xxxernment agencies. Seller will sign all documents Buyer is required to file in connection with development or rezoning approvals. Seller gives Buyer, its agents, contractors and assigns, the right to enter the Property at any time during the Feasibility Study Period for the purpose of conducting inspections; provided, however, that Buyer, its agents, contractors and assigns enter the Property and conduct inspections at their own risk. Buyer will indemnify and hold Seller harmless from xxxxes, damages, costs, claims and expenses of any nature, including attorney's fees, expenses and liability incurred in application for rezoning or related proceedings, and from liability to any person, arising from the conduct of any and all inspections of any work authorized by Buyer. Buyer will not engage in any activity that xxxxx result in a construction lien being filed against the Property without Seller's prior written consent. If this transaction does not close, Buyer will, at Buyer's expense, (1) repair all damages to the Property resulting from the Inspections and return the Property to the condition it was in prior to conduct of the Inspections, and (2) release to Seller all reports and other work generated as a result of the Inspections. Buyer will deliver written notice to Seller prior to the expiration of the Feasibility Study Period of Buyer's determination of whether or not the Properxx xx acceptable. Buyer's failure to comply with this notice requirement will constitute acceptance of the Property as suitable for Buyer's intended use in its "as is" condition. If the Property is unacceptable to Buyer and written notice of this fact is timely delivered to Seller, this Contract will be deemed terminated as of the day after the Feasibility Study period ends and Buyer's deposit(s) will be returned after Escrow Axxxx receives proper authorization form all interested parties.

  • Formal Investigation Once the matter has been brought to the attention of the Store executive, an internal investigation of the complaint will be conducted at which time the complainant will be requested to present, in writing, the particulars of the harassment. Such internal investigation will be initiated no later than ten (10) business days of the matter being brought to the attention of the Store executive, and shall be concluded no later than thirty (30) business days of the initiation of the investigation. Any extension of the aforementioned time frames must have the agreement of the complainant and the union if the complainant has chosen to involve it. Based on the outcome of the investigation, which will be provided in writing upon the completion of the investigation, to both the complainant and the union, should the complainant consent to this disclosure, it will be determined if there has been a breach of Company policy on harassment, and the appropriate action will be taken in the event that harassment is determined to have occurred. STEP THREE - SUBSEQUENT INCIDENTS Subsequent incidents should immediately be reported and followed by a written description to the most senior store executive involved in Step Two for further investigation and disciplinary action, if confirmed, with a copy to the union Chairperson with the consent of the complainant. After all steps of the Harassment Protection Policy have been exhausted, if the incident has not been resolved to the satisfaction of the employee, the employee may file a grievance at Step 2 of the grievance procedure.
