General and Criminal Background Checks. 5.2.13.1. PSP hereby represents and warrants, and by execution of an Assignment thereby represents and warrants, that neither PSP nor any of PSP’s employees have been convicted of a felony criminal offense, or of a crime involving moral turpitude, or that, if such a conviction has occurred, PSP has fully advised TFC in writing as to the facts and circumstances surrounding the conviction(s).

General and Criminal Background Checks. Architect represents that Architect and Architect’s employees have not been convicted of a felony criminal offense, or of a crime involving moral turpitude, or that, if such a conviction has occurred, Architect has fully advised Owner as to the facts and circumstances surrounding the conviction. Architect, and all of its employees, Consultants, and Contractors that will perform any work or services on-Site at a county-owned property shall be subject to a criminal background check. Any expense associated with such criminal background check shall be borne by Architect. All criminal background check forms for the Architect and all of Architect’s employees, Consultants, and Contractors that will initially commence any work on-Site must be fully completed and submitted to Owner within fifteen (15) Days of the date of the appropriate notice of award, and the process thereafter must be diligently pursued by Architect. All criminal background checks must be completed before the Architect or any employee, Consultant, or Contractor performs any services at the Site. All criminal background checks must be accomplished by the Texas Department of Public Safety (the “DPS”), which includes fingerprint processing by an independent third-party company selected by DPS. Upon receipt of the fingerprints of the Architect and Architect’s employees, Consultants, and/or Contractors, DPS, or Owner, will adjudicate the results of the criminal background searches in accordance with Owner’s background check requirements and guidelines. The failure to timely secure criminal background check clearance shall not be considered a legitimate delay in the performance of the services hereunder.
General and Criminal Background Checks. To the extent PSP conducts work at a TFC facility: (a) PSP shall conduct, or has conducted, a criminal background check at its own expense on each of its employees engaged in providing services under this Agreement prior to the commencement of such services. PSP’s employee shall be eligible to perform services for the Company if he or she, to such PSP's knowledge: (i) has not been convicted of or was placed in a pre-trial diversion program for any crime involving dishonesty or breach of trust including, but not limited to, check kiting or passing bad checks; embezzlement, drug trafficking, forgery, burglary, robbery, theft, perjury; possession of stolen property, identity theft, fraud, money laundering, shoplifting, larceny, falsification of documents; and/or (ii) has not been convicted of any sex, weapons or violent crime including but not limited to homicide, attempted homicide, rape, child molestation, extortion, terrorism or terrorist threats, kidnapping, assault, battery, and illegal weapon possession, sale or use.
