Height Limitations. ‌ The Port reserves the right to take any action it considers necessary to protect the aerial approaches of the Airport against obstructions, including the right to prevent the Airline from erecting, or permitting to be erected, any building or other structure on the Airport which, in the opinion of the Port, would limit the usefulness of the Airport or constitute a hazard to aircraft or which would otherwise fail to comply with Federal Aviation Regulations, Part 77, as such may be amended or replaced from time to time.

Height Limitations. Hospitals and medical office buildings, regardless of their location on the Property, are allowed a maximum building height of 200’. Any buildings on the Property that directly abut, or are located on a subdivided parcel abutting or directly across a road from, a parcel zoned residential and located on the following roads (collectively, the “Residential Roads”): Statz Street; the portion of Deer Springs Road between Statz Street and Xxxxxx Street; Xxxxxx Street; or Rome Boulevard, are allowed a maximum building height of 60’. In addition, all buildings on the Property that directly abut the Residential Roads will be allowed an increase of one foot of building height for each one-foot increase of the required C-2 zone 30’ building setback, up to a maximum building height of 200’. All other buildings on the Property that do not directly abut a parcel zoned residential on the Residential Roads are allowed a maximum building height of 200’. Any variance from the foregoing height limitations shall be subject to the approval of all relevant governmental authorities, including the FAA.

Height Limitations. The Height of Additional Improvements must not exceed thirty-five (35) feet or the Height of the highest Existing Improvement (for example, the barn in any of the Minimal Protection Areas,) whichever is greater. This limitation is subject to the following supplemental limitations and exceptions: (i) Fences, walls and gates remain limited as in the Highest Protection Area. A limitation on a number of Seats limits the number of unique Authorized Users of the Service.
