HVAC Standards Clause Samples

The HVAC Standards clause sets out the specific requirements and benchmarks that heating, ventilation, and air conditioning systems must meet within a project or property. It typically references recognized industry standards, such as those from ASHRAE or local building codes, and may specify performance criteria like energy efficiency, air quality, and system capacity. By clearly defining these expectations, the clause ensures that all HVAC installations are safe, reliable, and compliant, thereby reducing the risk of disputes over system adequacy or regulatory violations.

HVAC Standards. The Building HVAC System serving the Premises is designed to maintain average temperatures within the Premises during Ordinary Business Hours of (1) not less than 70 degrees F. during the heating season when the outdoor temperature is -10 degrees F. or more and (ii) not more than 76 degrees F. during the cooling season when the outdoor temperatures are 94 degrees F. dry bulb and 74 degrees F. wet bulb. The HVAC System is designed based upon (i) electrical usage of 5 w▇▇▇▇ per useable square foot for all purposes (lighting and power) and (ii) a population load per floor of not more than one person per 125 square feet of useable area, other than in dining and other special use areas per floor for all purposes. Use of the Premises, or any part thereof, in a manner exceeding the forgoing design conditions or rearrangement of partitioning after the initial preparation of the Premises which interferes with normal operation of the air-conditioning service in the Premises may require changes in the air-conditioning system serving the Premises, at Client’s expense.
HVAC Standards. Alteration of or tampering with the Building HVAC settings, related airflows or any other HVAC systems within the Turn-Key Datacenter™ is strictly prohibited.
HVAC Standards. For any non-residential project pursuant to this Agreement installing, modifying or maintaining a Heating Ventilation and Air Conditioning (“HVAC”) system or component with incentives valued at $3,000 or more, Aggregator shall ensure that each worker or technician involved in the project, including all of its employees and agents and those of each Subcontractor, meet at least one of the following workforce criteria: Completed an accredited HVAC apprenticeship; Is enrolled in an accredited HVAC apprenticeship; Completed at least five years of work experience at the journey level as defined by the California Department of Industrial Relations, Title 8, Section 205, of the California Code of Regulations, passed a practical and written HVAC system installation competency test, and received credentialed training specific to the installation of the technology being installed; or Has a C-20 HVAC contractor license issued by the California Contractor’s State Licensing Board. This standard shall not apply where the incentive is paid to any manufacturer, distributor, or retailer of HVAC equipment, unless the manufacturer, distributor, or retailer installs or contracts for the installation of the equipment. For the avoidance of doubt, Aggregator is deemed to be equivalent to manufacturer, distributor, or retailer; therefore, the standard shall not apply unless Aggregator installs or contracts for the installation of the equipment.
HVAC Standards. As part of the construction drawing package, Landlord requires mechanical drawings, which are stamped by an engineer.
HVAC Standards. Provide heating from, ventilating and air conditioning, combining perimeter hot water distribution and a variable air volume distribution system.
HVAC Standards. Upon commissioning of the Building’s HVAC system, Landlord shall certify that the Building’s HVAC systems will perform in accordance with the approved Base Project Construction Documents and the approved TI Work Plans and at the ASHRAE 189.1 standards for “green” commercial buildings, and allow Tenant’s technical services team and consultants to evaluate and confirm the same. The Building’s HVAC system shall be designed, constructed and commissioned in accordance with the approved Base Project Construction Documents and the approved TI Work Plans and in a manner consistent with best industry practices to optimize energy efficiency and meet the reliability and redundancy requirements of Tenant. The Building’s HVAC system shall be designed to include consideration of special metering and other installed systems to meet current requirements for certification under existing LEED standards for Operations and Maintenance. All enhanced commissioning reports are to be reviewed and approved by Tenant.
HVAC Standards. The air conditioning system is based upon an occupancy of not more than one person per ▇▇▇ ▇▇▇▇▇▇ ▇▇▇▇ ▇▇ ▇▇▇▇▇ ▇▇▇▇, and upon a combined lighting and standard electrical load not to exceed 2.5 ▇▇▇▇▇ per square foot of usable area. In the event Tenant exceeds this condition or introduces onto the Premises equipment which overloads the system, and/or in any other way causes the system not adequately to perform their proper functions, supplementary systems may at Landlord's option be provided by Landlord at Tenant's expense, and Tenant shall reimburse Landlord in such an amount as will compensate it for the cost incurred by it in operating such supplementary systems.
