Installation of the Equipment. Tenant shall, at its sole cost and expense, and at its sole risk, install the Equipment in a good and workmanlike manner, and in compliance with all of the following (the “Codes”): building, electric, communications, and safety codes, ordinances, standards, regulations, and requirements of the Federal Government, including, without limitation, the Federal Communications Commission (the “FCC”) or any successor agency having jurisdiction over radio or telecommunications, the Federal Aviation Association, the State of Florida, Broward County, and all other governmental authorities having jurisdiction. Prior to installation, Tenant shall deliver to Landlord copies of Tenant’s plans and specifications for the installation for the Equipment and proof that all plans and specifications are in accordance with the Codes. Tenant shall cause the plans and specifications for the Equipment to conform to Landlord’s design and engineering criteria provided to Tenant from time to time in effect and shall make any reasonable changes required by Landlord or its agents, engineers, or architects. In no event shall Tenant’s installation of the Equipment damage the Building Project or existing structures on the Building Project. or interfere with the maintenance of the Building Project, any system contained in the Building Project, any system currently serving the Building Project, or any radio or telecommunication equipment operated from the Building Project. Without limiting the generality of the foregoing, Tenant shall not install the Equipment in any manner which would void or limit any warranty or guaranty covering the roof of the Building Project. Tenant shall notify Landlord upon completion of the installation of the Equipment Landlord’s review and approval of the plans and specifications for the installation of the Equipment and Landlord’s supervision and inspection of such installation shall not be construed in any way as approval by Landlord of the adequacy or safety of the installation of the Equipment or as a waiver of any of Landlord’s rights under this License, and Tenant shall be solely responsible for the adequacy and safety of the installation and operation of the Equipment and solely liable for any damages or injury arising out of such installation and operation, other than injury or damages arising out of the negligence or willful misconduct of Landlord. Installation of the Equipment. 7.1 The Hirer shall install the Equipment at the Delivery Address (except in the event of Dry Hire of the Equipment (pursuant to clause 8)). The cost of installation shall not be included in the Rental Payment and shall be chargeable separately by the Hirer at the cost notified by the Hirer to the Customer from time to time. 7.2 Any date and/or time provided by the Hirer for the installation of the Equipment (the ‘Installation Date’) shall be an estimate only and time shall not be of the essence. The Hirer shall not be liable whatsoever to the Customer or any third party for any failure to delay installing the Equipment on the estimated Installation Date. For the avoidance of any doubt, the Hirer does not warrant and cannot guarantee that the Installation Date shall be on the same date as the Delivery Date and/or the Pick-Up date and is subject to the Hirer’s availability. 7.3 Upon installation by the Hirer, the Hirer may provide the Customer with a handover including, without limitation, in respect of the use, handling and daily maintenance of the Equipment. The Customer warrants that it will comply with all handover instructions during the Hire Period. 7.4 The Customer shall procure that a duly authorised representative of the Customer shall be present at the installation of the Equipment. If the Customer notices any defects following installation of the Equipment, it must notify the Hirer immediately. Acceptance of any defects shall be at the sole and absolute determination of the Hirer. 7.5 Notwithstanding any defects noted and agreed in clause 7.4, the Customer’s acceptance by such representative of installation shall constitute conclusive evidence that the Customer has examined the Equipment and has found it to be in good condition, complete and fit in every way for the purpose for which it is intended. If required by the Hirer, the Customer's duly authorised representative shall sign a receipt confirming such acceptance.
Installation of the Equipment. (a) CCE will agree with the Hirer where within an Outlet that the Equipment will be installed. CCE may use an agent to deliver and install the Equipment. (b) The Hirer must ensure that there is adequate access to and sufficient clear space in the intended location for the Equipment, that it is suitable for the Equipment in accordance with CCE’s require- ments, and that a properly earthed electricity socket with a current rating suitable for the Equipment and complying with all relevant legislation (including a means of mains isolation) is available within 2 metres of the intended location of the Equipment (although not located directly behind where the Equipment will be situated) and which can be easily reached. Where the Equipment is Dispensed Equipment the Hirer is additionally responsible for the provision of a water stopcock plus connection fittings within 2.5 metres of the Equipment’s location and ensuring that mains drinking water which complies with all appropriate legislation is available to be supplied to the Equipment. If planning permission is required the Hirer must obtain such planning permission at its cost. (c) To the extent permitted by law, CCE does not accept any liability for any loss or damage resulting from the performance of the installation work carried out by its employees or agents.

Installation of the Equipment. 6.1 Cyta undertakes the installation, wiring and configuration of the DSL Modem, the Splitter/Filter Equipment and the Set Top Box at the Subscriber’s premises, provided Cyta is their supplier. In case the Modem has not been provided by Cyta, Cyta shall not be held liable for the correct configuration and operation of the Modem. 6.2 During the installation Cyta shall follow the Subscriber’s instructions but shall not be liable for restoration in case of changes in the layout of the Subscriber’s premises due to the installation of the Equipment. 6.3 The Subscriber must provide a suitable space for placing the Equipment. Failure to do so may cause a delay in the provision of the Service. 6.4 The Subscriber must give access to the premises to Cyta’s personnel who will install the Equipment. In the case where Cyta’s personnel need to cross through or enter premises which belong to a third party in order to install the Equipment, the Subscriber shall be obliged to obtain the third party’s consent. 6.5 Cyta’s obligation for the installation of the Equipment is limited to the activation of the equipment and the confirmation that the Service is operating correctly, up to the television set. Cyta shall not be obliged to configure the operation of the Service through any other equipment and/or to set up such equipment.

The FDOT shall install the Equipment as listed in Exhibit B attached hereto and by this reference made a part hereof with its own forces or through a contract let by the FDOT at FDOT’s sole cost and expense. b.
