IDENTIFYING AND EVALUATING HISTORIC PROPERTIES. A. The STA will be responsible for identifying and evaluating all historic properties within each activity’s area of potential effect, and evaluating eligibility for the National Register of Historic Places, in consultation with the individual State Historic Preservation Officer (SHPO), following the procedures set out in 36 CFR 800.4. B. The STA may encourage or require project sponsors to include historic property documentation or survey results as part of the transportation enhancement activity application, in consultation with the SHPO.
IDENTIFYING AND EVALUATING HISTORIC PROPERTIES. Preliminary step in identifying potential historic properties. All Projects will require a CEDO Project Review Form (CEDO-PRF). During the review stage of the Environmental Review process, CEDO shall consult with VDHP to identify information in existing inventories on historic properties that may be affected by project activities. This should include but not be limited to: current listings of the NRHP; Vermont Historic Sites and Structures Survey and State Register of Historic Places; Vermont Archaeological Inventory; properties recommended as meeting the National Register Criteria for Evaluation and determined to be potentially eligible for the NRHP by VDHP; and any other readily available information in SHPO’s Online Resource Center files. VDHP shall also apply the environmental predictive model to determine if the project area contains potential archaeological sites. VDHP shall provide any applicable information identified in the above background review to CEDO. In the case of scattered site housing rehabilitation or scattered site economic development projects, where the specific locations of projects are unknown at the preliminary review stage, CEDO, qualified professional/approved CEDO employee if needed, shall conduct the above background review once specific locations are known. CEDO may submit recommendations for eligibility for properties to VDHP concurrently with proposed treatment plans to expedite the Section 106 review. After a 15-day initial review, VDHP shall inform CEDO of any missing or additional documentation required for evaluation. VDHP shall provide written comments to CEDO within 30 days following receipt of adequate documentation. If it is determined that there is a potential for historic architectural and/or archaeological properties to be affected, a qualified professional must be retained or an approved CEDO employee assigned to review the project.

IDENTIFYING AND EVALUATING HISTORIC PROPERTIES. 96 97 The Federal agency shall identify and evaluate historic properties and archaeological resources 98 using online site data submission pages that shall be entered using the XXXX portal. 100 The Federal agency shall obtain permits from the LPC for any restoration, alteration, 101 reconstruction, demolition, or new construction that affects the exterior of an individual 102 landmark or a building in a historic district if the project requires a permit from the Department 103 of Buildings. 104 105 The Federal agency shall obtain permits from the LPC for any archaeological field investigations 106 in New York City. 107 108 V. Documentation Requirements 109 110 The Federal agency shall comply with the following NYSHPO and LPC requirements, as 111 applicable, when submitting documents to NYSHPO and LPC for a Tier 2 undertaking in the 000 Xxxxx xx Xxx Xxxx and the City of New York, except as otherwise determined by the Federal 113 agency in consultation with the NYSHPO and the LPC: 114 115 • Recommended Standards for Historic Resources Surveys (NYSHPO 2010) 116 • Phase I Archaeological Report Format Requirements Guidelines (NYSHPO 2005) 117 • Standards for Cultural Resource Investigations and the Curation of Archaeological 118 Collections in New York State (NYAC 1994) 119 • Landmarks Preservation Commission Guidelines for Archaeological Work in New 120 York City (LPC 2002) 121 • City Environmental Quality Review (CEQR) Technical Manual (NYC Mayor’s 122 Office 2014) 123 124 The Federal agency shall consult with the NYSHPO and LPC prior to the onset of Tier 2 projects 125 to ensure that these regulations are up to date. 126 127 VI. Document Review Process 128 129 The Federal agency shall comply with the following requirements when submitting documents to 130 the NYSHPO and LPC for review: 131 132 • The Federal agency shall send final reports to the NYSHPO for review by uploading 133 to XXXX in electronic copy. 134 • The Federal agency shall send final reports to the LPC for review in hard copy. 135 • The NYSHPO and LPC shall review and comment on all adequately documented 136 project submittals within 30 calendar days of receipt. 137

Insofar as ground conditions, tree lean, and shape of clearings per- mit, trees shall be felled so that their tops do not extend outside Clearcutting Units, construction clearings, and ar- eas of regeneration cutting. B6.000 Xxxxx Xxxxxxx. Stumps shall not exceed, on the side adjacent to the highest ground, the maximum heights set forth in A6, except that occasional stumps of greater heights are acceptable when Purchaser determines that they are necessary for safe and efficient conduct of logging. Unless otherwise agreed, Purchaser shall re-cut high stumps so they will not exceed heights specified in A6 and shall dispose of severed portions in the same manner as other logging debris. The xxxxx heights shown in A6 were selected with the objective of maximum reasonable utilization of the timber, unless Sale Area Map shows special areas where xxxxx heights are lower for aesthetic, land treatment, or silvicultural rea- sons.

  • Research Independence The Company acknowledges that each Underwriter’s research analysts and research departments, if any, are required to be independent from their respective investment banking divisions and are subject to certain regulations and internal policies, and that such Underwriter’s research analysts may hold and make statements or investment recommendations and/or publish research reports with respect to the Company and/or the offering that differ from the views of its investment bankers. The Company hereby waives and releases, to the fullest extent permitted by law, any claims that the Company may have against such Underwriter with respect to any conflict of interest that may arise from the fact that the views expressed by their independent research analysts and research departments may be different from or inconsistent with the views or advice communicated to the Company by such Underwriter’s investment banking divisions. The Company acknowledges that the Representative is a full service securities firm and as such from time to time, subject to applicable securities laws, may effect transactions for its own account or the account of its customers and hold long or short position in debt or equity securities of the Company.

  • Foreign-Owned Companies in Connection with Critical Infrastructure If Texas Government Code, Section 2274.0102(a)(1) (relating to prohibition on contracts with certain foreign-owned companies in connection with critical infrastructure) is applicable to this Contract, pursuant to Government Code Section 2274.0102, Contractor certifies that neither it nor its parent company, nor any affiliate of Contractor or its parent company, is: (1) majority owned or controlled by citizens or governmental entities of China, Iran, North Korea, Russia, or any other country designated by the Governor under Government Code Section 2274.0103, or (2) headquartered in any of those countries.

  • Sub-Advisor Compliance Policies and Procedures The Sub-Advisor shall promptly provide the Trust CCO with copies of: (i) the Sub-Advisor’s policies and procedures for compliance by the Sub-Advisor with the Federal Securities Laws (together, the “Sub-Advisor Compliance Procedures”), and (ii) any material changes to the Sub-Advisor Compliance Procedures. The Sub-Advisor shall cooperate fully with the Trust CCO so as to facilitate the Trust CCO’s performance of the Trust CCO’s responsibilities under Rule 38a-1 to review, evaluate and report to the Trust’s Board of Trustees on the operation of the Sub-Advisor Compliance Procedures, and shall promptly report to the Trust CCO any Material Compliance Matter arising under the Sub-Advisor Compliance Procedures involving the Sub-Advisor Assets. The Sub-Advisor shall provide to the Trust CCO: (i) quarterly reports confirming the Sub-Advisor’s compliance with the Sub-Advisor Compliance Procedures in managing the Sub-Advisor Assets, and (ii) certifications that there were no Material Compliance Matters involving the Sub-Advisor that arose under the Sub-Advisor Compliance Procedures that affected the Sub-Advisor Assets. At least annually, the Sub-Advisor shall provide a certification to the Trust CCO to the effect that the Sub-Advisor has in place and has implemented policies and procedures that are reasonably designed to ensure compliance by the Sub-Advisor with the Federal Securities Laws.

  • FALSE STATEMENTS CONCERNING HIGHWAY PROJECTS T h i s p r o v i s i o n i s applicable to all Federal-aid construction contracts and to all related subcontracts. In order to assure high quality and durable construction in conformity with approved plans and specifications and a high degree of reliability on statements and representations made by engineers, contractors, suppliers, and workers on Federal- aid highway projects, it is essential that all persons concerned with the project perform their functions as carefully, thoroughly, and honestly as possible. Willful falsification, distortion, or misrepresentation with respect to any facts related to the project is a violation of Federal law. To prevent any misunderstanding regarding the seriousness of these and similar acts, Form FHWA-1022 shall be posted on each Federal-aid highway project (23 CFR 635) in one or more places where it is readily available to all persons concerned with the project: 18 U.S.C. 1020 reads as follows: "Whoever, being an officer, agent, or employee of the United States, or of any State or Territory, or whoever, whether a person, association, firm, or corporation, knowingly makes any false statement, false representation, or false report as to the character, quality, quantity, or cost of the material used or to be used, or the quantity or quality of the work performed or to be performed, or the cost thereof in connection with the submission of plans, maps, specifications, contracts, or costs of construction on any highway or related project submitted for approval to the Secretary of Transportation; or Whoever knowingly makes any false statement, false representation, false report or false claim with respect to the character, quality, quantity, or cost of any work performed or to be performed, or materials furnished or to be furnished, in connection with the construction of any highway or related project approved by the Secretary of Transportation; or Whoever knowingly makes any false statement or false representation as to material fact in any statement, certificate, or report submitted pursuant to provisions of the Federal-aid Roads Act approved July 1, 1916, (39 Stat. 355), as amended and supplemented; Shall be fined under this title or imprisoned not more than 5 years or both."

  • Proposed Policies and Procedures Regarding New Online Content and Functionality By October 31, 2017, the School will submit to OCR for its review and approval proposed policies and procedures (“the Plan for New Content”) to ensure that all new, newly-added, or modified online content and functionality will be accessible to people with disabilities as measured by conformance to the Benchmarks for Measuring Accessibility set forth above, except where doing so would impose a fundamental alteration or undue burden. a) When fundamental alteration or undue burden defenses apply, the Plan for New Content will require the School to provide equally effective alternative access. The Plan for New Content will require the School, in providing equally effective alternate access, to take any actions that do not result in a fundamental alteration or undue financial and administrative burdens, but nevertheless ensure that, to the maximum extent possible, individuals with disabilities receive the same benefits or services as their nondisabled peers. To provide equally effective alternate access, alternates are not required to produce the identical result or level of achievement for persons with and without disabilities, but must afford persons with disabilities equal opportunity to obtain the same result, to gain the same benefit, or to reach the same level of achievement, in the most integrated setting appropriate to the person’s needs. b) The Plan for New Content must include sufficient quality assurance procedures, backed by adequate personnel and financial resources, for full implementation. This provision also applies to the School’s online content and functionality developed by, maintained by, or offered through a third-party vendor or by using open sources. c) Within thirty (30) days of receiving OCR’s approval of the Plan for New Content, the School will officially adopt, and fully implement the amended policies and procedures.

  • Program Monitoring and Evaluation The Recipient shall prepare, or cause to be prepared, and furnish to the Association not later than six months after the Closing Date, a report of such scope and in such detail as the Association shall reasonably request, on the execution of the Program, the performance by the Recipient and the Association of their respective obligations under the Legal Agreements and the accomplishment of the purposes of the Financing.”
