Illness and Injury Leave. 14.2.1 For each year of service, every full-time unit member of the Solana Beach School District shall be entitled to ten (10) days of absence due to personal illness or injury with full pay. Permitted days of absence are exclusive of all days the unit member is not required to render service to the District. If a unit member does not take the full amount of leave allowed in any school year, the amount not taken shall be accumulated from year to year. A part-time unit member on a regular basis is entitled to a pro-rated amount of sick leave. 14.2.2 Any unused sick leave credit may be used by the unit member for sick leave purposes, without loss of compensation. Upon exhaustion of all accumulated sick leave credit, the unit member who continues to be absent for purposes of this policy shall receive for up to one hundred (100) days, the difference between his/her salary and the salary of a substitute or the salary that would have been paid to a substitute if one was sought but not secured, or if a substitute was not needed. In order to qualify for the differential pay, a unit member shall first use all accumulated sick leave credit. However, if a school year terminates before the one hundred (100) day period is exhausted, the bargaining unit member may take the balance of the 100 days in the subsequent school year. Only one increment of differential pay shall be allowed for any single illness. 14.2.3 Upon request, if a unit member is absent due to illness, he/she shall furnish a statement signed by a physician verifying his/her illness. 14.2.4 Access to each unit member’s accumulated sick leave is available on the paystub which is accessible via the Employee Self-Serve System. 14.2.5 A unit member who must be absent from duty because of disability as a result of pregnancy or convalescence following childbirth is eligible for leave which shall be taken from available sick leave. Under no circumstances is this leave to be used for purposes of childcare. Available sick leave benefits will commence upon certification by a physician that the unit member is disabled because of pregnancy or convalescence from childbirth. Available sick leave benefits will end when the physician certifies that the unit member’s disability no longer exists. (See Maternity Leave for other related leave provisions).

17.2.2 A member employed less than a full year. A part-time unit member on , less than five (5) days per week or less than a regular basis full work day is entitled to a pro-rated amount of prorated sick leave.

17.2.4 A unit member may transfer unused accrued sick leave credit from another California public school or charter school provided that the OCSA can verify the accuracy of records of such leave with the previous employer.
17.2.5 Credit for leave of absence need not be prior to taking such leave by the member and such leave of absence may be taken at any time during the school year. If a member does not render service for an entire year, but has used by all paid sick leave, the unit member amount of compensation received for sick leave purposes, without loss taken but unearned shall be repaid to the OCSA and the OCSA shall have the right to make any necessary adjustment on the last warrant.
17.2.6 The Charter School shall annually provide each unit member with an accounting of compensation. used and available sick leave days.
17.2.7 Upon exhaustion of all accumulated and current sick leave creditleave, the unit member who continues to be absent for purposes unable to work due to injury or illness and who provides the physician’s confirmation of this policy fact in writing shall receive additional leave paid at the rate of difference between the member’s pay and the substitute rate for up one additional period not to exceed one hundred (100) days over a period of any two (2) consecutive school years. This leave shall not apply to temporary teachers.
17.2.8 If the OCSA has reason to believe that the member is or has been abusing the sick leave privileges, or if the member is absent for more than three (3) consecutive days, the difference between his/her salary member may be required to present a medical doctor's certificate verifying the fact of the personal illness or injury and the salary resulting inability to work. If verification is required, due to an absence of a substitute or 3 consecutive days, OCSA will notify the salary that would have been paid to a substitute if one was sought but not secured, or if a substitute was not needed. In order to qualify for the differential pay, a unit member shall first use all accumulated by phone or email on or before day 3 of their absence so that the member can schedule an appointment with their doctor. The OCSA reserves the right to have a member who is on sick leave credit. However, if a school year terminates before the one hundred (100) day period is exhausted, the bargaining unit member may take the balance of the 100 days in the subsequent school year. Only one increment of differential pay shall be allowed for any single illness.
14.2.3 Upon request, if a unit member is absent due to illness, he/she shall furnish a statement signed examined at OCSA expense by a physician verifying his/her illnessdesignated by the OCSA to assist in determining the member's inability to perform assigned duties.
14.2.4 Access 17.2.9 A member returning from a leave of more than two weeks shall not return to each unit work until he or she submits a medical doctor's authorization to return to work and identifying any limitations on the member’s accumulated sick leave ability to perform essential functions of the position. Otherwise, notice must be given as soon as the need for the intended absence is disabled because known.
