Illness, Injury and Emergency Leave. Paid leaves for personal illness, injury, or emergency of an employee, will be 6 granted on the basis of twelve (12) days at the beginning of each year, cumulative 7 to 180 days of unused leave, and transferable as per any applicable state and 8 federal statutes. Such leave is in the form of insurance and is not deferred income 9 due at a later date. 10

Certificated 17 provides for transfer of accumulated leave from the previous District. 19 A physician's statement of illness may be required upon the request of the Superintendent's 20 or designee if the illness extends beyond five (5) days. 22 Emergency leave shall be granted to employees when said leave is requested in accordance 23 with the definition contained herein. 25 An emergency is defined as a sudden, unexpected situation that is beyond the 26 employee's control that causes and/or requires the employee to be absent from work. 28 In the event a serious illness or injury to a close family member requires an employee to 29 care for the family member, the employee may use sick/emergency leave. 31 Employees may cash in unused sick leave above an accumulation of sixty (60) days from the 32 previous year's accumulation, at a ratio of one (1) full day's monetary compensation for 33 four (4) accumulated sick leave days. At the employee's option, he/she can cash-out his/her 34 unused sick leave days in January of the school year following any year in which a minimum 35 of sixty (60) days of sick leave is accrued and each January thereafter, at the rate equal to 36 one day's monetary compensation of the employee for each four (4) full days of accrued 37 sick leave. The employee's sick leave accumulation shall be reduced four (4) days for each 38 day compensated. No employee may receive compensation for sick leave accumulated in 39 excess of one (1) day per month. 41 The District and Association agree to offer participation in a medical reserve trust program 42 for employees: 1) separating from employment, eligible for retirement, and eligible for up 43 to one hundred eighty (180) days of sick leave cash-out at a 1:4 ratio; 2) who have 44 accumulated sixty (60) days or more days of sick leave, annual cash-out in January of up to
Illness, Injury and Emergency Leave. A. A total of twelve (12) working days per year, with full pay, shall be allowed each full-time certificated employee as illness, injury, and emergency leave. For employees commencing employment at the beginning of the contract year, such leave shall be granted in the following manner: 4 days in September and the remaining 8 days in January.
B. Certificated employees terminating employment prior to the end of the contract year and/or employees commencing employment after the beginning of the contract year, shall accrue illness, injury and emergency leave at the rate of one day per contract month, provided the date of employment is on or before the 15th day of a calendar month. Such leave shall not exceed twelve (12) days per contract year.
C. Certificated employees under contract with the District as less than full-time employees shall be granted leave in the same proportion as their part-time contract bears to a full-time contract (see Article III, Section 3-C.
1). Certificated employees contracting with the District after the beginning of the fiscal year shall be granted leave on a pro-rata basis as their contract bears to a full-time contract.
D. Leave benefits will be available to certificated employees for reasons of personal injury or illness. The District may request a physician’s certificate or other suitable proof acceptable to the District.
E. A certificated employee who knows in advance that he or she will be absent for medical purposes should notify the immediate building supervisor and/or Superintendent as soon as possible to insure proper planning for substitute teachers.
F. Pertaining to the individual employee, at the exhaustion of illness, injury, and emergency leave, an employee unable to perform his or her duties because of illness, injury, or emergency, may, upon written request, be granted a leave of absence without pay by the Board for no longer than to the end of the current contract year.
G. All requests for emergency leave must be approved by the Superintendent.
H. A certificated employee who does not complete a contract year but has used sick leave in excess of one day per month entitlement shall have said excess withheld from the final paycheck. In the event the final paycheck has been issued, the individual shall reimburse the District in full within 30 days of receipt of written notification from the District.
Illness, Injury and Emergency Leave. Every employee under contract for a full school year in a position requiring certification shall be entitled to twelve (12) days sick leave for personal illness, and/or injury or illness. Sick leave is available when employees are unable to work due to a health condition regardless of whether the condition related to physical or mental health. Such leave is also available for medical appointments or treatment. Consistent with state law, an employee may also use his/her sick leave to care for: (a) his/her child with a health condition that requires treatment or supervision; or (b) his/her spouse, domestic partner, parent, parent-in-law, or grandparent who has a serious health condition or an emergency condition. In addition, emergency leave is available pursuant to Section 39.10 due to the serious illness of other members of the immediate family. Sick leave not taken shall accumulate up to the maximum number of days employees are allowed to cash out upon separation of employment under state law. An employee may use a maximum of ten (10) days of sick leave following the birth or adoption of the employee’s child to care for the mother and/or child. Additional sick leave may be used in accordance with the above paragraph. An employee, under contract as a part-time employee, shall be entitled to that proportion of twelve (12) days leave of absence for illness or injury as the total number of days contracted bears to the number of days in the certificated employee basic work year. Pay for any period of absence shall be the same as would have been received by contract for such period of absence. All sick leave must be taken in units of half or full days.

Sick leave may be 13 used for purposes of personal or immediate family illness, injury, emergency, pregnancy, 14 childbirth, and physical disability. Doctor's certification of illness may be required by the school district if an employee is absent for five (5) or more consecutive days or if a distinguishing pattern of absenteeism occurs. The recommendation of a doctor for consultation, treatment, etc., to or by a specialist shall be considered in the same category as illness in regard to leave from school, provided it is for treatment of an injury or condition of an emergency nature. Each contracted full-time employee shall be able to accumulate sick leave without limitation, but is allowed only to use 180 days for sick leave buy-out upon retirement.

When an employee’s FTE decreases or increases during the school year, the FTE increase/decrease will be reflected in an adjustment to the number of days front loaded at the start of the year. The total days available under the contract shall be placed at the disposal of the certificated employee at the beginning of the contract year. Unused sick leave shall be accumulative year-to-year up to a maximum of one hundred eighty (180) days. Each employee covered by Industrial Insurance shall reimburse the District monies paid. Such reimbursement shall restore sick leave accrued to such employee on a prorated basis of the reimbursement. Employees who work less than a full year shall be allowed that portion of leave of absence for personal illness or injury as the total days employed bears to the number of days in the employment year. All personal illness of more than five (5) days duration shall be substantiated by a doctor's verification or a written signed letter by the employee.
