Impaired Resident. A Resident deemed impaired by the Program Director, may be immediately dismissed from the program. Options other than dismissal may be offered, at the Program Director’s sole discretion. An impaired Resident is one who is unable to practice medicine with reasonable skill and safety because of physical or mental illness, deterioration through the aging process or loss of motor skills, or use or abuse of drugs or alcohol. By signing this Agreement, Resident represents to Hospital that he/she is not now impaired and does not abuse alcohol or drugs. Further, he/she agrees not to consume alcohol or other mood- altering substances while on duty or call for patient care delivery.

Impaired Resident. When there is a reasonable suspicion that a Resident has arrived for duty or while on duty has become impaired, the Resident shall be removed from the duty shift and shall be subject to applicable GME and Human Resource policies, including Hospital's Substance Abuse Policy. An impaired Resident is one who is unable to practice medicine with reasonable skill and safety to patients because of physical or mental illness, including deterioration through the aging process or loss of motor skills or use or abuse of drugs, including alcohol. By signing this contract, Resident states that he/she is not now impaired and does not abuse alcohol, drugs, or other performance impairing substances. Further, he/she understands and agrees that it is a violation of the Substance Abuse Policy to consume alcohol, drugs or other performance impairing substances while on duty or on call for patient care delivery.

  • STATUTORY PENALTY FOR INADEQUATE QUALIFIED INVESTMENT Pursuant to Section 313.0275 of the TEXAS TAX CODE, in the event that the Applicant fails to make $10,000,000 of Qualified Investment, in whole or in part, during the Qualifying Time Period, the Applicant is liable to the State for a penalty. The amount of the penalty is the amount determined by: (i) multiplying the maintenance and operations tax rate of the school district for that tax year that the penalty is due by (ii) the amount obtained after subtracting (a) the Tax Limitation Amount identified in Section 2.4.B from (b) the Market Value of the property identified on the Appraisal District's records for the Tax Year the penalty is due. This penalty shall be paid on or before February 1 of the year following the expiration of the Qualifying Time Period and is subject to the delinquent penalty provisions of Section 33.01 of the TEXAS TAX CODE. The Comptroller may grant a waiver of this penalty in the event of Force Majeure which prevents compliance with this provision.

  • Non-Participation in Insurance Your initials on this clause of the Agreement acknowledges the Patient’s understanding that neither the CLINIC, nor its Physician, participate in any health insurance or HMO plans or panels and cannot accept Medicare eligible patients.
