Instructions, inspections and audits. 26.1 The Contractor shall carry out all instructions of the Project Manager, which comply with the applicable laws where the Site is located.
26.2 The Contractor shall permit the Government of Zanzibar to inspect the Contractor's accounts and records relating to the performance of the Contractor and to have them audited by auditors appointed by the Government of Zanzibar if so required by the Government of Zanzibar.

The Contractor's and its Subcontractors' and sub-consultants' attention is drawn to Sub-Clause 25.1 (Fraud and Corruption) which provides, inter alia, that acts intended to materially impede the exercise of the Public Procurement Regulatory Authority's inspection and audit rights constitute a prohibited practice subject to contract termination (as well as to a determination of ineligibility pursuant to the Public Procurement Regulatory Authority's prevailing sanctions procedures).

The Contractor’s attention is drawn to Sub-Clause 73.2 which provides, inter alia, that acts intended to materially impede the exercise of the GoN’s/EMPLOYER’s inspection and audit rights provided for under this Sub-Clause constitute an obstructive practice subject to contract termination.

The Employer‟s personnel shall at all reasonable times during construction of the Work be entitled to examine, inspect, measure and test the materials and workmanship, and to check the progress of the construction. If the Project Manager instructs the contractor to carry out a test not specified in the Employer‟s Requirement to check whether any work has a defect and the test shows that it does, the Contractor shall pay for the test and any samples. If there is no defect, the test shall be a Compensation Event. The Contractor shall permit the Funding Source named in the SCC to inspect the Contractor‟s accounts and records relating to the performance of the Contractor and to have them audited by auditors appointed by the Funding Source, if so required by the Funding Source.
