Laydays. The Laydays in the relevant Confirmation constitute a window for arrival of the Vessel at the Cargo Transfer Point. If the Vessel arrives within the Laydays, it is anticipated that loading of the Cargo may not be completed before the Laydays expire.
Laydays. Laytime shall not commence prior to the date stipulated at the time vessel is nominated and accepted, except with Buyer’s sanction.
Laydays a) Seller shall declare to Buyer the Laydays and the Cargo Reference Number in respect of the Cargo not later than, and time shall be of the essence in this respect, 1700 hours London time on the 15th Day prior to the first Day of the Laydays. By way of example, if a declaration is made on the first Day of the Specified Month then the earliest Laydays acceptable are 16th-18th of the Specified Month. Telephone declarations made by 1700 hours shall be valid, but must be promptly confirmed by telex from Seller. If the 15th Day prior to the first Day of the Laydays is a Saturday, Sunday or London Bank Holiday then such declaration shall be made not later than 1700 hours on the last preceding London Banking Day. Buyer shall use all reasonable efforts to ensure that appropriate facilities and sufficient authorised personnel are available for the prompt receipt of declarations.
b) If Seller is itself purchasing the Cargo from, or Buyer is itself selling the Cargo to, any third party, Seller or Buyer, as the case may be, undertakes to pass on as expeditiously as possible any communication given to it hereunder which it is contractually bound to give to such third party.
c) The Cargo Reference Number declared pursuant to Clause 3(a) shall relate to a Cargo which at the time of such declaration is, according to the Xxxxx System schedule or the Ninlan System schedule (as the case may be), intended by the Xxxxx System or the Nlnlan System to be made available for loading on the Scheduled Day. However, providing that the Cargo Reference Number is validly declared as aforesaid, Seller shall not be in breach of this Agreement if the Cargo Reference Number in respect of the Cargo is not at the time of loading the same as the Cargo Reference Number previously declared pursuant to Clause 3(a) provided that the Cargo Reference Number at the time of loading refers to a Cargo which at commencement of the Laydays declared pursuant to Clause 3(a) was scheduled by the Loading Terminal for loading on the Scheduled Day.
Laydays. The laydays in the Confirmation constitute the Delivery Window for the Vessel to tender a valid notice of readiness (“NOR”) to the Terminal. If the Vessel tenders NOR within the laydays, it is understood that loading may not be completed before the laydays expires.
Laydays. 12.1 Laydays shall commence 24 hours after tender of Notice of Readiness, provided the Vessel is in every respect ready to load sulphur, in free pratique and is cleared by Customs, whether the Vessel is in berth or not, unless sooner worked. Notwithstanding the foregoing, unless the Vessel is sooner worked, laytime will not start to count before the "Allowed Time" for the "Previously Loaded Vessel" has elapsed, where (i) "Allowed Time" means 24 hours, plus one hour for (A) each 10,000 dwt or part thereof of cargo over 150,000 dwt actually loaded in the case of Vessels loading coal or petroleum coke or (B) each 2,000 dwt or part thereof of cargo over 30,000 dwt actually loaded in the case of Vessels loading sulphur, after laytime commences for such Vessel, and (ii) "Previously Loaded Vessel" means, in relation to a Vessel which has given Notice of Readiness (the "Vessel's Notice"), the Vessel which immediately prior to the giving of the Vessel's Notice has given Notice of Readiness under this Agreement, is ready to load sulphur, is in free pratique and is cleared by Customs.
Laydays a) Latest September 30, Charterers shall give Owners a tentative annual schedule per quarter for the following contract year.
b) Tentative monthly shipping schedule covering next quarter shall be given by Charterers at latest thirty (30) days prior to the commencement of each quarter, and Owners shall confirm such schedule within 1 (one) week.
c) VESSELS NOMINATION PROCEDURE
1) Charterers to advise Owners of tentative shipping schedule on an annual/quarterly basis.
2) Charterers to advise Owners immediately upon placing a shipment purchase order with CST - stating shipment date and cargo size, 45-day notice.
3) 30 days prior to the shipment date Charterers to advise Owners of the (12 days) laydays required by CST. Production readiness stem to be confirmed - with 5 pct. m.o.l. in Charterers' option.
4) Minimum 15 days prior to the 1st day of the laydays, Owners to nominate a vessel for the shipment indicating vessel position and ETA and 12 days laydays.
5) Charterers to advise Owners within 2 (two) working days of vessels acceptance, except when Owners request Charterers acceptance within maximum 1 (one) working day.
d) If a vessel arrives before or after the laydays narrowed by Owners as mentioned above, the acceptance outside the said laydays is subject to further consultation between Owners and Charterers.
Laydays. The Laydays in the relevant Confirmation constitute a window for arrival of the Vessel at the Cargo Transfer Point; provided, however that the Laydays specified for a CIF or a CFR delivery shall constitute an estimate of Vessel arrival time and shall not be binding on Seller.
Laydays. The Employer to provide to the Guild an updated list of leave bank days for each employee on a monthly basis.
Laydays. The Vessel and all Associated Equipment shall be delivered to the Charterer at a port or place in accordance with Box 2 not later than 1600 hours local time at place of delivery on the canceling date stated in Box 5, the Owner giving written notice of readiness during office hours to the appropriate Government representative at the port or place of delivery on a working day (Saturdays, Sundays, or other recognized weekly days of rest, U.S. Government holidays, and holidays observed at the delivery port, whether national or local, shall not be considered working days). Government inspection of the Vessel shall be completed within a reasonable amount of time thereafter, not exceeding twenty-four (24) hours after proper tender of the notice of readiness, (Saturdays, Sundays, or other recognized weekly days of rest, U.S. Government holidays, and holidays observed at the delivery port, whether national or local, excepted in the computation of said twenty-four hour period). Hire shall commence upon acceptance of the Vessel by the Charterer but not before the commencing date stated in Box 5, unless approved in writing in advance by the Contracting Officer. The Charterer shall have the liberty to cancel this Charter at no cost to the Government should the Vessel or Associated Equipment not be ready in accordance with the provisions hereof by the canceling date stated in Box 5, said cancellation to be declared not later than twenty-four (24) hours after 1600 hours local time at place of delivery on the canceling date stated in Box 5, should the Vessel not be ready by that time. This paragraph shall not limit any right of the Government under this Charter Party or any right to take any other action authorized by law.
Laydays. Laytime shall not commence before the date stipulated in Part I, except with the Charterer’s sanction. Should the Vessel not be ready to load by 4:00 o’clock P.M. (local time) on the cancelling date stipulated in Part I, the Charterer shall have the option of cancelling this Charter by giving Owner notice of such cancellation within twenty-four (24) hours after such cancellation date; otherwise this Charter to remain in full force and effect.
