Annual Schedule. By each June 30 subsequent to the Commercial Operations Date, Seller shall submit to Company, in the form requested by Company, a schedule of maintenance outages which will reduce the capacity of the Facility by [Drafting Note: the lower of five (5) MW or 10% of Allowed Capacity] or more for the next two-year period, beginning with January of the following year. Such annual schedule shall state the proposed dates and durations of scheduled maintenance, the scope of work for the maintenance and the estimated reductions in capacity for each projected maintenance event. Company shall review the maintenance schedule for the two-year period and inform Seller in writing no later than December 1 of the same year of Company’s concurrence or requested revisions, which Seller shall agree to unless, in Seller’s judgment, such proposed revisions will void or violate any warranties of equipment that is part of, or used in connection with, the Facility or violate any long-term service agreement with respect to such equipment; provided, that, in each such case, Seller shall promptly notify Company thereof, and Seller and Company shall endeavor to reach a mutually satisfactory resolution of the matter in question.

Annual Schedule. 1. Contractor shall submit an annual schedule to the Inspector for approval. The schedule shall indicate the time frames when the work shall be accomplished. 2. Contractor shall submit revised schedules when actual performance differs substantially from planned performance. 3. The items of work shall be performed Monday through Friday with the exception of trash. Trash will be emptied daily, Monday through Sunday, according to Performance Schedule below. Contractor shall indicate days of actual performance on weekly schedule. 4. Mowing shall only be performed on Tuesdays, Wednesdays and Thursdays (except major holidays) unless authorized by Inspector.

Annual Schedule. Within sixty (60) days after the filing of the United States federal income tax return of the Corporation or any Consolidated Group for any Taxable Year in which there is a Realized Tax Benefit or Realized Tax Detriment, the Corporation shall provide to each Exchanging TRA Member a schedule (an “Annual Schedule”) showing, in reasonable detail, (i) any increase or changes in items (ii) through (v) of Section 2.2 as shown on the Exchange Basis Schedule delivered to the applicable Exchanging TRA Member as a result of payments made to such Exchanging TRA Member pursuant to this Agreement, (ii) changes to any relevant items in connection with a Determination affecting such Exchange Basis Schedule, (iii) changes to any relevant items to correct material inaccuracies in such Exchange Basis Schedule identified as a result of the receipt of additional factual information relating to a Taxable Year after the date the initial Exchange Basis Schedule was provided to such Exchanging TRA Member pursuant to Section 2.2, (iv) changes to any relevant items to comply with the Expert’s determination under the Reconciliation Procedures with respect to the resolution of any issues between the Corporation and such Exchanging TRA Member that have been resolved by such Expert’s determination, (v) information necessary to provide such Exchanging TRA Member notice of a material change in the Realized Tax Benefit or Realized Tax Detriment in respect of such Exchanging TRA Member attributable to a carryback or carryforward of a loss or other tax item to such Taxable Year and (vi) information necessary to provide such Exchanging TRA Member notice of a material change in the Realized Tax Benefit or Realized Tax Detriment in respect of such Exchanging TRA Member attributable to an amended Tax Return filed in such Taxable Year. The Annual Schedule shall be subject to approval procedures of Section 2.5. References to an Exchange Basis Schedule in this Section 2.4 shall refer to the Exchange Basis Schedule delivered pursuant to Section 2.2 together with each Annual Schedule delivered to the applicable Exchange TRA Member.
Annual Schedule. The College will prepare an annual work schedule, posted on or before March 15 and September 15, respectively. The schedule shall follow a pattern of replication intended to provide reasonable determination of work schedules for successive periods. The annual schedule will be implemented for March 15, 2020. In cases where a position is known to remain open due to extended illness, injury, or termination, the College will provide five (5) weekdays notice for employees to determine voluntary coverage of the position. If voluntary coverage for an open position is not received by the College within three (3) weekdays of notification, the College will select individuals utilizing an objective rotation method, initiating the selection process with the “next in line” recipient of overtime. The College reserves the right to change work schedules whenever, in the opinion of the College, circumstances warrant. In such cases the College will attempt to make such changes with a minimum of five (5) weekdays notice. Emergencies may preclude such notice. Employees must request non-emergency vacation time no later than the first Friday of each month for vacation to be taken in that month. The employee must make a concerted effort to give notice 4 weeks prior to any planned vacation of five days or more. On an exceptional case-by-case basis, requests for non-emergency vacation time may be approved by the Director, Facilities. According to the following schedule, an employee’s vacation should be requested in one week (five consecutive scheduled work days) increments, (not to exceed two consecutive weeks in any request without prior approval by the Administrator), 11+ 2 Employees will be responsible to secure replacement coverage if “on shift”. Vacation days requested after the effective date of the schedule and/or alternate vacation requests for denied vacation time will be reviewed in the order received subject to the needs of the College. Vacations will remain subject to the provisions of Article VII of the agreement. Nothing in this section is meant to preclude the requirement for extra scheduled time and/or emergency work as the needs of the College require. Holidays shall be set as per the college academic calendar to suit the needs of the college and employees shall be scheduled as described above in a pattern of replication. Annual Schedule. OCME shall provide to City for City’s approval a proposed annual schedule of days and hours of operation of the model railroad (“Schedule”) no later than January 2 of each year. If City does not approve the proposed Schedule, OCME and City shall cooperate to determine a mutually agreeable Schedule. City’s approval shall not be unreasonably withheld. OCME shall operate the model railroad in accordance with the Schedule, except in the event of inclement weather or emergencies. OCME shall post the Schedule on the Premises in a location that is protected from tampering and inclement weather and accessible for viewing by the public. OCME shall also provide the Schedule on its website, xxx.xxxxxxxxxx.xxx, and social media.
Annual Schedule. The Seller shall provide the Purchasers’ Agent with an annual forecast shipping schedule of Concentrates (the “Annual Schedule”) that are required to be purchased and sold under this Agreement for each Contract Year (other than the First Contract Year) not later than 60 days prior to commencement of each Contract Year. For the First Contract Year, the Annual Schedule shall be provided no later than the Start-up Date. The Purchasers acknowledge and accept that the Annual Schedule will be an estimate only and that actual production of Concentrates and therefore the actual shipments timing may vary. The Seller shall endeavour to ensure that amounts of Concentrate shipped hereunder are evenly spaced throughout each Contract Year. Each Annual Schedule shall provide the Month of Estimated Shipment for each Parcel. The Seller shall update the Annual Schedule during the Contract Year to reflect for each Parcel the Month of Scheduled Shipment, provided that a Parcel shall not be assigned a Month of Scheduled Shipment without consultation and agreement with the Purchasers’ Agent, such agreement not to be unreasonably withheld. The Seller shall ensure that each Parcel shall be assigned a Month of Scheduled Shipment at least two months in advance of the commencement of the Month of Scheduled Shipment. Once the Seller and Purchasers’ Agent agree to a Month of Scheduled Shipment for a Parcel, the Seller shall use reasonable commercial efforts to deliver, and the Purchaser shall be obliged to take delivery of, such Parcel during such month.
