Lead Commissioner. 29.1 The Lead Commissioner shall be NHS Swale CCG. In the event that the Lead Commissioner withdraws from the Joint Committee or withdraws from the role of Lead Commissioner, the remaining Member CCGs will agree a successor Lead Commissioner from between them. Any clause, responsibility or liability quoted in this Agreement or the Terms of Reference, or any associated Schedule or Appendix pertaining to the Lead Commissioner, shall then transfer to the successor Lead Commissioner.
Lead Commissioner. Each Commissioner appoints the Lead Commissioner to carry out the responsibilities in respect of the Commissioning Contract set out in Schedule 3 Part B as its agent, subject to the terms of this Agreement.

The Lead Commissioner for the planning and procurement phase of the commissioning is Xxxxxxx Xxxxx from Essex County Council as Chair of the EWMH Redesign Project Board. Each Commissioner appoints the Lead Commissioner to carry out the responsibilities in respect of the Commissioning Contract, as its agent, subject to the terms of this Agreement. 8.2 Commissioners acknowledge that, regarding those of its roles and responsibilities that relate to routine contract management, information and reporting, the Lead Commissioner may undertake those actions as reasonably required and in accordance with objectives and principles of this Agreement, but without further consultation with the Commissioners regarding routine contract management matters. 8.3 Where the Lead Commissioner proposes to take any actions under the Commissioning Contract that affect the commissioning strategy, procurement, commissioning responsibilities or decisions of the Commissioners, including actions relating to the variation, termination or suspension of the Services, Prices under the Commissioning Contract or any other actions in respect of the Commissioning Contract that affect the statutory commissioning responsibilities of the Commissioners (such actions being Lead Commissioner Actions), the Lead Commissioner may (subject to clause 8.5) take that Lead Commissioner Action only after receiving the approval of each Commissioner in accordance with clause 9. 8.4 Each Commissioner appoints the Lead Commissioner as its agent to sign any variations to the Commissioning Contract on its behalf, but the Lead Commissioner may not sign any variation to the Commissioning Contract on behalf of the Commissioners except in accordance with clause 9. 8.5 If a Suspension Event occurs and the Lead Commissioner reasonably believes that it is necessary to suspend any Service in accordance with General Condition 16 of the Commissioning Contract with immediate effect, the Commissioners agree that the Lead Commissioner may take such immediate action in respect of any affected Service as the Lead Commissioner considers necessary, provided that the Lead Commissioner must promptly report the circumstances of the suspension to all affected Commissioners, and any affected Commissioner may call a meeting of the Collaborative Forum under clause 6.11 to discuss the suspen...
Lead CommissionerThe Service is a joint commission between NHS Nene CCG, NHS Corby CCG, NHS Peterborough and Cambridge CCG, collectively referred to as ‘the CCGs’ for the purposes of this Agreement and Northamptonshire County Council (the Council). The lead commissioning responsibility will rest with Nene CCG under the auspices of the Children and Young People’s Joint Commissioning Team managed by the Deputy Head of Joint Commissioning supported by the Commissioning Manager Emotional Health & Wellbeing.

  • Commissioner Chairman, Loudoun County Board of Supervisors. Contract Documents - The Contract Documents are complimentary, and what is required by one shall be as binding as if required by all. The intent of the Contract Documents is to include all items necessary for the proper execution and completion of the Work, including without limitation, all labor, materials, equipment and furnishings required in connection therewith. Such incorporated documents customarily include but are not limited to; the Invitation for Bid (Proposal) including any and all addendums and attachments, , Loudoun County Revisions to 2007 VDOT Road & Bridge Specifications Division 1 General Provisions, Plans, , Bidder Response/ Proposal, Owner – Contractor Agreement and all attachments and exhibits thereto, Supplemental General Conditions, 2007 VDOT Road and Bridge Specifications, Insurance coverage/polices, bonds, Specifications, and all Modifications, including addenda and subsequent change orders. The edition of the Road and Bridge Specifications cited in the Invitation for Bid (Proposal) and Contract, which include addenda or Revisions issued prior to the Bid Date, the Supplemental Specifications, Special Provisions, Special Provision Copied Notes, the Plans, the Edition of the Road and Bridge Standard Drawings cited on the title sheet of the plans which include Addendum’s or Revisions issued prior to the Bid Date. Oral representations or promises will not be considered a part of the Contract. Any soils, geotechnical or other reports, surveys and analyses which may be made available to the Contractor for review or information under this Contract, are not adopted by reference into, nor are they part of the Contract Documents.

  • Grievance Commissioner System This is to confirm the discussion of the parties during collective bargaining that they are committed to encouraging early discussion and resolution of labour relations issues at the local level and seek to resolve grievances in a timely and cost efficient manner. To that end, this is to confirm that pursuant to Article 8, the parties agree that the Employer and Union at individual nursing homes may agree to utilize the following process in order to resolve a particular grievance through the utilization of a joint mediation-arbitration procedure:

  • CENTRAL LABOUR RELATIONS COMMITTEE C4.1 OPSBA, the Crown and OSSTF agree to establish a joint Central Labour Relations Committee to promote and facilitate communication between rounds of bargaining on issues of joint interest.

  • Department Chairpersons 17.1 In each elementary, middle and senior high school, the need for department chairpersons/team leaders shall be determined by the principal. Each such department chairperson/team leader shall be appointed for one (1) academic year. If possible, such appointment should be made prior to the end of the preceding academic year. Teachers shall have the right to refuse such appointment. Team leaders will have coordinating and planning functions for their teams and shall serve as liaison between their teams and the principal. They shall not be considered administrative employees. 17.2 When feasible, and after consultation with them, department chairpersons and team leaders will be provided with release time commensurate with the responsibilities assigned to them by their principal.

  • Technical Committee 1. The Technical Committee shall comprise: (a) nine experts representing different regions of the Agreement Area, in accordance with a balanced geographical distribution; (b) one representative from the International Union for Conservation of Nature and Natural Resources (IUCN), one from the International Waterfowl and Wetlands Research Bureau (IWRB) and one from the International Council for Game and Wildlife Conservation (CIC); and (c) one expert from each of the following fields: rural economics, game management, and environmental law. The procedure for the appointment of the experts, the term of their appointment and the procedure for designation of the Chairman of the Technical Committee shall be determined by the Meeting of the Parties. The Chairman may admit a maximum of four observers from specialized international inter- governmental and non-governmental organizations. 2. Unless the Meeting of the Parties decides otherwise, meetings of the Technical Committee shall be convened by the Agreement secretariat in conjunction with each ordinary session of the Meeting of the Parties and at least once between ordinary sessions of the Meeting of the Parties. 3. The Technical Committee shall: (a) provide scientific and technical advice and information to the Meeting of the Parties and, through the Agreement secretariat, to Parties; (b) make recommendations to the Meeting of the Parties concerning the Action Plan, implementation of the Agreement and further research to be carried out; (c) prepare for each ordinary session of the Meeting of the Parties a report on its activities, which shall be submitted to the Agreement secretariat not less than one hundred and twenty days before the session of the Meeting of the Parties, and copies shall be circulated forthwith by the Agreement secretariat to the Parties; and (d) carry out any other tasks referred to it by the Meeting of the Parties. 4. Where in the opinion of the Technical Committee there has arisen an emergency which requires the adoption of immediate measures to avoid deterioration of the conservation status of one or more migratory waterbird species, the Technical Committee may request the Agreement secretariat to convene urgently a meeting of the Parties concerned. These Parties shall meet as soon as possible thereafter to establish rapidly a mechanism to give protection to the species identified as being subject to particularly adverse threat. Where a recommendation has been adopted at such a meeting, the Parties concerned shall inform each other and the Agreement secretariat of measures they have taken to implement it, or of the reasons why the recommendation could not be implemented. 5. The Technical Committee may establish such working groups as may be necessary to deal with specific tasks.

  • Labour Management Relations Committee In recognition of the mutual benefits of open communications and on-going consultation between the faculty and the employer, the Labour/Management Relations Committee will meet on a regular basis and have equal representation for the Union and the Employer. The LMRC will serve as an open forum for the free and candid discussion of matters of mutual concern to faculty members and management.

  • Professional Development Committee There shall be a Professional Development Committee composed of two (2) members of the Association one of whom shall be the Bargaining Unit President or designate and two (2) representatives of the Hospital one of whom shall be the Chief Nursing Officer or designate and one human resources representative.

  • Authority of Committee All determinations made by the Committee with respect to the interpretation, construction and application of any provision of this Agreement shall be final, conclusive and binding on the parties.

  • Local Professional Development Committee A. There shall be a Local Professional Development Committee (LPDC) to oversee, review, and approve individual professional development plans (IPDP) for course work, continuing education units and/or other equivalent activities. 1. The LPDC shall be responsible to recommend for the Superintendent’s approval, all in-service activities and workshops offered in the district during the school year for staff professional development. 2. Recommendations for District Workshops and In-Service activities should be submitted to the LPDC for approval and recommendation no later than the last school day of the year prior to the year it will be implemented. 3. The LPDC chair shall review and approve all “Professional Growth Reimbursement Application” forms. B. The LPDC shall consist of three (3) teachers appointed by the Association President and two (2) members appointed by the Superintendent. One of the Superintendent's appointees will be a Principal employed by the district. C. Appointments shall be for two (2) years with half of the committee members being appointed every other year. 1. Appointments shall be made on or before May 1. 2. The Appointments shall be made by each party outlined above, notifying the other of those appointed. 3. In the event of a vacancy, the committee members shall be replaced in accordance with "B." above. 4. The Association shall name a fourth teacher member and the Superintendent shall name a third administrative member to serve as alternates and attend trainings. These two (2) people shall act as substitutes when a committee member is absent. D. This committee shall meet monthly. 1. The committee may also be convened by the request of two sitting members. 2. A quorum shall consist of five (5) members. When administrative licenses/certificates are reviewed, two (2) sitting teacher members will abstain and the decision will be decided by three (3) members. 3. If the committee determines it is needed, they will be provided two (2) professional release days to meet during regular school hours. Substitutes will be provided for the committee members on these release days. 4. Committee members shall be provided an additional annual stipend of $1,000 for meetings beyond the normal work day or year. This stipend shall be paid in two (2) semi-annual payments. Any member who fails to serve the full year shall have the above compensation prorated on a monthly basis for each month served. 5. Decisions of the LPDC will be made by consensus of the committee members present. 6. The committee minutes shall be prepared and maintained in compliance with the laws governing the operation of committees of public bodies.

  • NATIONAL LABOR RELATIONS BOARD CERTIFICATION Contractor certifies that no more than one (1) final unappealable finding of contempt of court by a Federal court has been issued against Contractor within the immediately preceding two-year period because of Contractor's failure to comply with an order of a Federal court, which orders Contractor to comply with an order of the National Labor Relations Board.
