Leave Sharing. An employee who has more than 200 hours of sick leave accrued may donate sick leave to an employee or employees who are on sick leave for catastrophic illness pursuant to the following restrictions: A. The employee receiving the sick leave must have exhausted all of his/her available paid leave including all sick leave and annual leave. B. The employee receiving the sick leave may not be on leave for an on-the-job injury covered by Workers’ Compensation Insurance. C. The employee giving the sick leave must do so in writing and in blocks of eight (8) hours and shall not exceed 120 hours in any fiscal year. The sick leave being given shall be indicated be on a form provided by the County. (Appendix C.) D. The grant of sick leave must be irrevocable to the employee that donated the leave. If the leave is not used for the purpose donated it shall be donated to the catastrophic leave bank. E. If a donation is made by an employee at a different pay rate than the receiving employee, pursuant to N.R.S. 245.210.4, the donated time shall be converted into money at the hourly rate of the donor and the money shall then be converted into sick leave at the hourly rate of salary of the recipient. The total hours donated to an employee shall not exceed the number of hours necessary to avoid a loss in pay between the time the employee exhausts his/her paid leave pursuant to subsection 10.8.1 and either the employee’s return to work or the employee’s eligibility for disability insurance. G. Last Resort Bank. Retiring employees may donate unpaid sick leave hours to the catastrophic sick leave bank so long as the donation does not cause the bank to exceed 1000 hours. Leave Sharing. An employee Bargaining unit members who has have accrued more than 200 hours twenty-two (22) days of sick leave accrued may donate accumulated sick leave. Employees may not donate an amount of sick leave that will result in sick leave account going below twenty-two (22) days. The employee donating the days shall specify the number of days to an employee or be donated. Transfers of sick leave under this provision are limited to transfers from employees who are on do not accrue annual vacation leave. Donated sick leave shall not be counted as deleted from the current year accumulation for catastrophic illness pursuant to the following restrictions:
A. sick leave cash out purposes. The employee receiving the sick leave donated days must have exhausted all available leave before using the donated days, and be suffering from, or have a relative or household member suffering from an illness, injury, impairment, or physical or mental condition which is of his/her available paid an extraordinary or severe nature and which has caused, or is likely to cause, the employee to go on unpaid leave including all of absence. Requests for the initiation of a sick leave and annual leave.
B. The sharing program must be accompanied by a doctor's statement indicating that a valid medical condition exists, which precludes the employee from returning to work. If the medical condition does not exist with the employee, then it must also be established that the family would greatly benefit from the personal attention of the employee. No employee shall be allowed to receive an amount of donated leave which totals more than 180 days during one contract year. Furthermore, no employee may request a transfer of an amount of leave that would result in his or her sick leave account going below twenty-two (22) days. Donated but unused leave days shall revert back to the employee who donated the leave days. An employee receiving the donated sick leave may not be on leave days shall receive the same benefits and pay as if he or she had been working. For purposes of this section an FTE day donated will provide for an on-the-job injury covered by Workers’ Compensation Insurance.
C. The employee giving FTE day received regardless of the salary status of the donating and receiving employees. Contributions of sick leave must do so in writing and in blocks of eight (8) hours and shall not exceed 120 hours in any fiscal year. The sick leave being given shall be indicated be on a form provided by voluntary basis and the County. (Appendix C.)
D. The grant names of sick leave must be irrevocable to the employee that donated the leave. If the leave is not used for the purpose donated it donors shall be donated to the catastrophic leave bank.
E. If a donation is made by an employee at a different pay rate than the receiving employee, pursuant to N.R.S. 245.210.4, the donated time kept confidential. The association shall be converted into money at the hourly rate permitted to make its membership aware of the donor and the money need for donations but shall then be converted into sick leave at the hourly rate precluded from individual solicitations.
