Legal Compliance; Workplace Safety. In carrying out its obligations under the Agreement, including the performance of Services, Supplier shall at all times comply with all applicable all federal, provincial, and municipal laws, regulations, standards, and codes. Supplier shall obtain all applicable permits, licences, exemptions, consents and approvals required for the Supplier to manufacture and deliver the Goods and perform the Services.

Legal Compliance; Workplace Safety. In carrying out its obligations under the Agreement, including the performance of Services, Supplier shall at all times comply with all applicable federal, provincial, and municipal laws, regulations, standards, and codes. Supplier shall be at all times registered with the workplace safety and insurance board under the Ontario Workplace Safety and Insurance Act, 1997 and shall maintain its workers’ compensation accounts in good standing, and provide Buyer with evidence of good standing upon request. Supplier shall obtain all applicable permits, licences, exemptions, consents and approvals required for the Supplier to manufacture and deliver the Goods and perform the Services.

The Supplier shall at all times comply with all applicable statutory, federal, provincial, and municipal laws, regulations, standards, and codes including but not limited to such laws and regulations relating to the workplace, consumer safety, environmental protection, labor payments, welfare, health & compensation. The Supplier shall obtain all applicable permits, licenses, exemptions, consents and approvals required for the Supplier to manufacture and deliver the Goods and perform the Services as per the Order of TBSPL. 13.2. At the request of TBSPL, the Service Provider shall provide such documentary evidence are required to verify the compliance of clause no.13.1 including but not limited to Master roll , bank’s statement, wage register, wage slip , PF Challan, ESI Challan, PF Slip, ESIC & PF Registration. Annual payment statement like Payment of annual leave, Bonus etc. & submitting compliance thereof. 13.3. With respect to deliveries and the performance of services, the Supplier alone shall be responsible for compliance with regulations for the prevention of accidents. 13.4. Any failure by the Supplier to satisfy the Statutory Compliances may be made good by TBSPL at a cost to the Supplier. TBSPL shall, on a report having been made by an inspecting officer in the relevant statute , have the power to deduct from the monies due to the Supplier any sum required or estimated for making good the loss suffered by a worker by reason of non-fulfillment of the statutory conditions of the contract for the benefit of workers, non-payment of wages including PF, ESI, Employee Compensation or of deductions made from his or their wages which are not justified by the norms of the contract or non-observance of the said Supplier’s Labour Regulations. 13.5. The Supplier shall indemnify TBSPL and pay the full amount to TBSPL towards any liability, costs, damages, expenditure including legal costs etc. arising out of or in connection with the non- compliance of statutory provisions mentioned above.

Delivery of the material, sample, substance. Client shall, at its own expense, pack, load, and deliver the material, sample and/or any other substance for which the Client requested Services/Analysis to Location. No charges will be reimbursed by INRS for transportation, insurance, shipping, storage, handling, cartage, packaging or similar charges or otherwise agreed to in writing by INRS. Risk of loss or damage shall pass to INRS upon receipt of material, sample and/or any other substances once received by INRS at the Location. Supplier shall at all times follow strict adherence to either the Australian Work Health and Safety Act, 2011 or New Zealand’s Health and Safety at Work Act, 2015 and shall ensure its workers are aware and adhere to these requirements. Supplier shall obtain all applicable permits, licences, exemptions, consents and approvals required for the Supplier to manufacture and deliver the Goods and perform the Services. The Supplier shall at all times also comply and ensure all persons for whom it is responsible shall comply with all the Buyer’s policies, rules, regulations, restrictions, guidelines, directives and orders when on the Buyer’s land and premises.

  • DRUG-FREE WORKPLACE REQUIREMENTS Contractor will comply with the requirements of the Drug-Free Workplace Act of 1990 and will provide a drug-free workplace by taking the following actions: a. Publish a statement notifying employees that unlawful manufacture, distribution, dispensation, possession or use of a controlled substance is prohibited and specifying actions to be taken against employees for violations. b. Establish a Drug-Free Awareness Program to inform employees about: 1) the dangers of drug abuse in the workplace; 2) the person's or organization's policy of maintaining a drug-free workplace; 3) any available counseling, rehabilitation and employee assistance programs; and, 4) penalties that may be imposed upon employees for drug abuse violations. c. Every employee who works on the proposed Agreement will: 1) receive a copy of the company's drug-free workplace policy statement; and, 2) agree to abide by the terms of the company's statement as a condition of employment on the Agreement. Failure to comply with these requirements may result in suspension of payments under the Agreement or termination of the Agreement or both and Contractor may be ineligible for award of any future State agreements if the department determines that any of the following has occurred: the Contractor has made false certification, or violated the certification by failing to carry out the requirements as noted above.   • CONTRACT WORK HOURS AND SAFETY STANDARDS As per the Contract Work Hours and Safety Standards Act (40 U.S.C. 3701-3708), where applicable, all Customer Purchase Orders in excess of ,000 that involve the employment of mechanics or laborers must include a provision for compliance with 40 U.S.C. 3702 and 3704, as supplemented by Department of Labor regulations (29 CFR Part 5). Under 40 U.S.C. 3702 of the Act, each contractor must be required to compute the wages of every mechanic and laborer on the basis of a standard work week of 40 hours. Work in excess of the standard work week is permissible provided that the worker is compensated at a rate of not less than one and a half times the basic rate of pay for all hours worked in excess of 40 hours in the work week. The requirements of 40 U.S.C. 3704 are applicable to construction work and provide that no laborer or mechanic must be required to work in surroundings or under working conditions which are unsanitary, hazardous or dangerous. These requirements do not apply to the purchases of supplies or materials or articles ordinarily available on the open market, or contracts for transportation or transmission of intelligence.
