Level Two - Board of Education. If the grievance is not resolved to the grievant’s satisfaction, he, no later than seven (7) calendar days after the receipt of the Superintendent’s decision, may request a review by the Board of Education. The request shall be submitted in writing through the Superintendent, who shall attach all related papers and forward the request to the Board of Education. The Board, or a Committee thereof, shall review the grievance and shall, at the option of the Board, hold a hearing with the grievant and render a decision in writing within thirty-five (35) calendar days of receipt of the grievance by the Board.

Level Two - Board of Education. (a) In the event that the administrator is not satisfied with the disposition of his/her grievance at Level One, he/she may, within fifteen (15) days after receipt of the decision, file a written grievance indicating such dissatisfaction with the chairperson of the Board of Education.

Level Two - Board of Education a. If the grievant is not satisfied with the disposition of the grievance at Level One, the grievant may request that the Association file the grievance for appeal to the Board of Education. If the Association believes an appeal should be filed, the Association shall file the appeal with the Board within ten (10) days after the decision at Level One.
Level Two - Board of Education. (a) After receiving the written grievance, the Board or a committee of the Board shall schedule a meeting to be held within twenty (20) days with the administrator and an Association representative (if requested by the administrator) for the purpose of resolving the grievance. However, the ultimate decision on the grievance shall be rendered by the full Board. The decision shall be given in writing to the administrator and the president of the Association (if requested by the administrator) within fifteen (15) days of said meeting stating that the grievance is either upheld or denied.

The appeal to the Board of Education must be made in writing specifying: (a) The nature of the grievance; (b) The nature and extent of the injury, loss, or inconvenience; (c) The results of previous discussions; and (d) his/her dissatisfaction with the decision previously rendered. The appeal shall be submitted to the Board of Education through the Chief School Administrator. The Board, or a committee thereof, shall review the grievance and shall, at the option of the Board, or at the request of the employee grievant, hold a hearing with the employee grievant and render a decision in writing and forward copies thereof to the grievant and to the Association within thirty (30) calendar days of receipt of the appeal by the Chief School Administrator; or if a hearing is held, within twenty (20) calendar days of the date of the hearing. The hearing referred to herein, shall be within thirty (30) calendar days after the receipt of the appeal notice.
