Locates. Prior to doing any work in the Right-of-Way, Grantee shall give appropriate notices to the Grantor and to the notification association established in C.R.S. Section 9-1.5-105, as such may be amended from time to time. Within forty-eight (48) hours after any Grantor bureau or franchisee, licensee or permittee notifies Grantee of a proposed Right-of-Way excavation, Grantee shall, at Grantee's expense:
(A) Mark on the surface all of its located underground facilities within the area of the proposed excavation;
(B) Notify the excavator of any unlocated underground facilities in the area of the proposed excavation; or
(C) Notify the excavator that Grantee does not have any underground facilities in the vicinity of the proposed excavation.
Locates. The Company agrees that, throughout the Term it shall, at its own cost, record and maintain adequate records of the locations of its Equipment. Each Party shall, at its own cost and at the request of the other Party (or its contractors or authorized agents), physically locate its respective facilities by marking the ROW using paint, staking or other suitable identification method (“Locates”), under the following circumstances:
(a) in the event of an Emergency, within two hours of receiving the request or as soon as practicably possible, following which the requesting Party will ensure that it has a representative on site (or alternatively, provide a contact number for its representative) to ensure that the area for the Locates is properly identified; and
(b) in all other circumstances, within a time reasonably agreed upon by the Parties.
Locates. By entering into this Agreement, the Broker will grant you the ability to locate HTB Stocks through multiple vendors. Your acceptance of a locate for a short sale order does not guarantee that the necessary shares will be delivered to the Clearing Firms for settlement of your short sale transaction. The Broker, at its sole discretion, may elect to buy in some or all of the shares necessary to cover your short position at any time, including on the trade date in which your short position was established, and at any time or date thereafter. By entering into a short position, you agree that you take on full financial and market risk, including the risk that you may incur losses as a result of the Broker buying in your short position. By entering into this Agreement, you acknowledge that you may incur significant fees by selling securities short in your account. When you accept a locate for a HTB Stock, you will be charged a locate fee (“HTB/Locate Fee”) for each day you maintain a short position. The HTB/Locate fee is charged the moment you accept a locate on a HTB Stock, even if you never enter an order to sell short the located security. If you hold a located HTB Stock overnight, you will incur an overnight fee (“Overnight Fee”). All charges for Locates and Hard to Borrow fees will be reflected on your monthly brokerage statement. The Overnight Fee is in addition to the Locate Fee. The Locate Fee and Overnight Fee will be billed on a daily and/or monthly basis appearing on your statement collectively as “HTB Fees”. Locate/HTB Fees are completely separate from the short interest fees that the Clearing Firms may charge your account for holding short positions overnight. The amount of the HTB/Locate Fee is determined by the broker dealer that is providing the locate. However, the Broker may participate in volume discounts offered by the locate provider when applicable.
Locates. Locates. Physically and spatially identifying underground facilities and appropriately marking or flagging the facilities. This may be initiated by calling “811” to contact the appropriate “Dig Safe” call center and requesting a locate.
Locates. The Company agrees that, throughout the Term it shall, at its own cost, record and maintain adequate records of the locations of its Equipment. The Company agrees, at its own cost, to register as a member of Ontario One Call and shall comply with the Ontario Underground Infrastructure Notification System Act, 2012, as amended.
Locates. Grantee shall comply with the requirements of ORS 757.542-757.562 and ORS 757.993 (2009), and the rules and regulations promulgated thereunder in OAR Chapter 952.

Locates. 24.1 The Customer acknowledges and permits reasonable unobstructed access to and from the Customer’s property to locate existing buried structure or services, for the purpose of installation, repair, or construction, upon reasonable request by EH!tel, customer, land owner, contractor, service provider, or any other agency.
24.2 At least 5 business days prior to installation, the Customer will disclose to EH!tel or its contractors, the location of privately owned buried structures and/or services (including but not limited to weeping beds, sprinkler systems, hydro outlets, tile drainage and catch basins, xxxxx and water lines), that may be in the path of the fibre installation.
24.3 At least 5 business days prior to installation, the Customer will disclose to EH!tel or its contractors, providers of existing services to the premise including but not limited to telephone, cable, gas or propane, water and sewage, hydro.
24.4 The Customer and/or its authorized agents will notify EH!tel at least 5 business days prior to any type of activity, construction or installation, on the property or premise that requires breaking the ground in the vicinity of EH!tel ‘s service, lines (drops) or equipment. EH!tel will respond to the notification with a locate report within 5 business days, and if requested or required, xxxx the location of EH!tel ‘s service, lines or equipment with flags, paint, or stakes.
