Maintenance and Sustainment. The use of FEMA preparedness grant funds for maintenance contracts, warranties, repair or replacement costs, upgrades, and user fees are allowable under all active grant awards, unless otherwise noted. EMPG Program grant funds are intended to support the Goal and fund activities and projects that build and sustain the capabilities necessary to prevent, protect against, mitigate the effects of, respond to, and recover from those threats that pose the greatest risk to the security of the Nation. In order to provide Sub-Recipients the ability to meet this objective, the policy set forth in GPD’s IB 379 (Guidance to State Administrative Agencies to Expedite the Expenditure of Certain DHS/FEMA Grant Funding) allows for the expansion of eligible maintenance and sustainment costs, which must be in: (1) direct support of existing capabilities; (2) must be an otherwise allowable expenditure under the applicable grant program; (3) be tied to one of the core capabilities in the five mission areas contained within the Goal, and (4) shareable through the EMAC. Additionally, eligible costs may also be in support of equipment, training, and critical resources that have previously been purchased with either federal grant funding or any other source of funding other than DHS/FEMA preparedness grant program dollars. When purchasing a stand-alone warranty or extending an existing maintenance contract on an already-owned piece of equipment system, coverage purchased shall not exceed the period of performance of the award used to purchase the maintenance agreement or warranty. As with warranties and maintenance agreements, this extends to licenses and user fees as well.

Maintenance and Sustainment. 7 The contractor shall provide maintenance and sustainment support of ISR systems. Technical support may include, but is not limited to: on-site maintenance and repair; repair and/or operation of ISR systems; Troubleshoot Helpdesk support of ISR systems; and development of maintenance/repair manuals. The contractor shall develop a reliability and maintainability program to define and implement detailed techniques and tasks required to ensure that Reliability, Maintainability, and Availability (RMA) requirements are satisfied.

All costs that are incurred before or after the award’s period of performance ends are not chargeable to the award and will be disallowed per 2 CFR 200.309 Period of Performance. Contracts, agreements, and extended warranty shall not be prepaid or prorated. For example, a maintenance agreement purchased with FY2017 grant funding may not provide maintenance or warranty coverage beyond the expiration of the period of performance for your FY2017 grant (June 30, 2017). The exception to the requirement is if the standard maintenance contract or warranty is included in the original purchase package of the item and under the same grant award as the original purchase of the system or equipment, in this instance coverage may exceed the period of performance, as long as the coverage purchased is consistent with what is typically provided for.
