MAP Policy. Reseller may sell the Products at any price, subject to the minimum advertised price limitations and MAP Policy set forth in Schedule 2 (the "MAP Policy"). In order to promote the development of a market for the Products while protecting and maintaining the image and integrity of the Products and related brands, Reseller agrees to comply with the MAP Policy. Tactacam may update the MAP Policy at any time by providing an updated Schedule 2 to Reseller, and such MAP Policy shall take effect 30 days after the date of the notice.
MAP Policy. The Synergy Manufacturing Minimum Advertised Price Policy (known hereafter as MAP) was created to protect Synergy Manufacturing’s brand integrity, protect resellers, and to allow effective selling and marketing of Synergy Manufacturing products by those resellers in the marketplace. MAP can be found as the listed retail price on the Synergy Manufacturing website and as the RETAIL/MAP listing in the Synergy Manufacturing Product Data available through ASAP Network. As a result of the material difference in the exchange rate between the US and Canada and the US and Australia, separate Canadian and Australian MAP listings have been added in the Synergy Manufacturing Product Data. This policy is for advertising of product only and does not enforce the actual selling price of a product. Synergy Manufacturing products can be sold for any price desired as long as they are not advertised below MAP. Synergy Manufacturing resellers may not advertise any current product for less than MAP. Advertising includes, but is not limited to: print ads, promotional flyers, direct mail, mail order material, catalogs, billboards, radio, television, email (including email blasts, newsletters), internet (including banner ads, Google AdWords, forum threads/posts), website e-commerce (including event sales and store wide discounts), internet auctions and auction sites, and other promotional efforts where a specific price is listed for a particular item. Any and all Internet ads may not include statements such as, “Prices too low to print”, “Buy Now”, “Limited Time Offer”, or “Strike Through Prices” insinuating prices which are lower than MAP. Resellers may not offer discount packages of any kind which include Synergy Manufacturing products, whether the discount is for Synergy Manufacturing products or those of another manufacturer. The Synergy Manufacturing brand must be sold as Synergy Manufacturing brand of parts. Resellers selling Synergy Manufacturing parts as their own brand of parts or advertising below MAP will be given a warning to correct the violations. Failure to comply within one week will result in suspension of the Synergy brand of products.
MAP Policy. The Distributor agrees to abide by Xxxxxx’s Minimum Advertised Price policy (“MAP Policy”) as set forth in this subsection. The Distributor agrees that it will not publish in any advertisement or other form of media, including but not limited to catalogs, mailers, promotional fliers, or Internet or web sites, a price for a Feniex product that is under the MAP Price. The MAP Policy does not prevent the Distributor from selling a Feniex product at any price it chooses. The MAP Policy applies only to published prices in any form of media. It does not prevent the Distributor from submitting a bid for the sale of a Feniex product, at a price lower than it could advertise the product under the MAP Policy. Failure to comply with this MAP Policy shall result in termination from the Distributor program. Feniex MAP price policies are country-specific. MAP Policy. Vital Choice requires all wholesale customers follow our MAP (Minimum Advertised Price) pricing policy. Vital Choice does reserve the right to stop shipments to any wholesale customer who engages in predatory pricing practices that conflicts with Vital Choice's own website pricing.
MAP Policy. Xxxxx Fishing Company, Inc. is committed to creating high margins for our authorized reseller and distribution network. Therefore, Xxxxx Fishing Company, Inc. is also committed to maintaining those margins by enforcing universal minimum advertised pricing as a condition of this agreement between Xxxxx Fishing Company, Inc. and Authorized Reseller. Authorized Xxxxx Fishing Company. resellers shall not advertise any Xxxxxxx Outfitters, Inc. products below a margin of 10% less the suggested retail price (MSRP).
MAP Policy. Licensor’s minimum advertised price policy (the “MAP Policy”) is set forth more specifically in Exhibit 3. [Need to see this] Licensee shall make independent business decisions related to the MAP Policy and shall determine the VOD Actual Retail Price of the Early Window Titles in its sole discretion as set forth in Section 5.2.2 of the VOD Terms of the Original Agreement. Notwithstanding the foregoing, in the event that Licensee markets, promotes or advertises an Early Window Title in violation of the MAP Policy, such violation shall not constitute a breach of the Agreement; provided however, that such violation shall result in the forfeiture of any advertising funds or promotional rebates (if any) offered by Licensor for such Early Window Title during the period of time that MAP is, or was, in effect. [Need to see MAP Policy] such Early Window Title is not viewable on more than one (1) Approved Early Window Device at a time (except for the concurrent viewing on two (2) Approved Early Window Devices for a period of up to five (5) minutes to allow for the transfer of the viewing experience from one Approved Early Window Device to the other). Subject as aforesaid, such Early Window Title shall be viewable on such Approved Early Window DeviceDevices an unlimited number of times during the Early Window Viewing Period applicable to such VOD Customer Transaction. For clarity, a VOD Customer may make multiple VOD Customer Transactions for an Early Window Title during such title’s Early Window License Period, provided, that each VOD Customer Transaction shall be subject to the Early Window Usage Rules set forth herein.
MAP Policy. Manufacturer has adopted a MAP policy, which is applicable to all authorized Cadex distributors and dealers around the world and is non-negotiable. Dealers remain free to establish their own in “house” resale prices, the Manufacturer will, without assuming any liability, impose penalties as described herein against those who advertise Cadex products on any media at a price lower than the MAP. This policy is applicable to all advertised prices made by Dealers advertising Cadex branded products. Dealer may not use shipping, handling or free products incentives to circumvent MAP. Product promotions with a price below MAP guidelines shall not violate this policy if they are advertised in conjunction with Cadex approved promotional activities. In the event a dealer chooses not to follow MAP, penalties will be imposed in the following manner:
1. First Notification: Manufacturer will send the dealer a communication noting the MAP violation and will be allowed 5 business days to fix the infraction without further sanction.
