Common use of Minimum Hours of Work Clause in Contracts

Minimum Hours of Work. An employee who is not provided prior day’s notice by 4:00 p.m. that a regularly scheduled work day has been cancelled shall receive a minimum of three (3) hours pay at his regular rate of pay for such day. An employee who completes a shift or is sent home from work before he has worked three (3) hours, shall receive a minimum of three (3) hours pay at the rate of pay he would have earned if the work had been performed. In the case that the employer is unable to provide work for the employee because of fire, lightning, power failure, storms, client cancellation of work events, or similar causes beyond the employer’s control, or such things cause work to stop or prevent work from starting, employees who report for work shall receive a minimum pay of three (3) hours pay at their regular rate of pay. In such cases, employees shall, prior to the beginning of the work day, make reasonable efforts to determine from their supervisor whether their shift is cancelled. If they do not, they may not be eligible for the minimum hours. Employees must inform the Employer of a means of being contacted on short notice. If the Employer so attempts to inform the employee of a lack of work due to weather but is unable to do so, the employee will not be entitled to show up time. If the employee chooses to leave prior to finishing their three (3) hours of work assigned, the employer will only pay for the hours completed.
