Minimum interval between shifts. (a) An Employee must wherever practicable have at least eight hours free from duty between the completion of one rostered shift and the commencement of the next rostered shift. Where the ordinary hours of work on a rostered shift have exceeded eight hours, the period free from duty must be at least equal to the number of ordinary hours of the shift being worked concurrently with the period free from duty.
Minimum interval between shifts. An Employee must have at least 8 hours rest between the finish of work and the commencement of the next shift. Where the hours of work on a rostered shift have exceeded 8 hours (including unplanned overtime), the period free from duty must be at least equal to the number of ordinary hours of the shift being worked concurrently with the period free from duty. The Hospital is committed to the prevention of worker fatigue. Where, due to unplanned overtime, an Employee has not been able to have an 8 hour break, where possible the roster will be adjusted to allow for the minimum interval between shifts to occur. If on instructions from the Employer the Employee is required to commence or continue work with less than 8 hours between the finish of work and the commencement of the rostered shift, the Employee will be paid at overtime rates (per clause 4.4) while working and will be released at the earliest possible opportunity, with the remainder of the rostered shift being paid at ordinary rates of pay. Upon being released from duty, the employee is entitled to be absent until they have had at least 8 consecutive hours off duty, without loss of pay for ordinary working time occurring during their absence.
