Monitoring of Content. As a general policy matter, the University does not monitor the content of electronic communications without the user’s consent. However, users should be aware that access to and inspection of electronic communications (including e-mail) may be granted or required under certain conditions as set forth in the ECP (for example, where there is reason to believe a law has been violated, or when there is a critical time-sensitive operational need). The ECP’s procedures for nonconsensual access will be followed where necessary. Users should also be aware that access to, inspection of, and preservation of relevant electronic communications (including e-mail) is required by federal law when the University reasonably anticipates that a lawsuit may be filed against it or is engaged in legal action.

Monitoring of Content. Cologix shall have no obligation to monitor postings, content or transmissions made in connection with the Services. Cologix, without Customer’s prior approval, will not monitor or grant access to any postings, content, or transmissions unless required by law, valid subpoena, or other legal requirement. Cologix may use and disclose such monitoring and postings as required.

Unplanned Absences or Separation Users are advised that in the case of an unplanned, extended absence, the University may find it necessary to access an individual’s electronic communications in order to ensure business continuity. Such access will be conducted with the least perusal of contents possible, per the ECP. The individual will be informed of the access upon return to work. After an individual separates from the University, the University may access electronic communications records for business purposes and may destroy electronic files, including e-mail.
Monitoring of Content. Facebrity reserves the right to monitor all user content posted on/submitted to the Services. Facebrity may at its sole discretion remove any user content, including, but not limited to the content that contains any illegal content, viruses, spyware and malware, obscene or pornographic materials, libelous, defamatory, violent or hate-oriented content, promotes any commercial activities, or any other content that may harm Facebrity, its business or reputation. Without limiting the foregoing, Facebrity may remove any material that Facebrity, in its sole discretion, finds to be in violation of these Terms or otherwise objectionable. Customer acknowledges and expressly agrees that Concentric will not be liable to Customer or its customers for any action Concentric takes to remove or restrict access to obscene, indecent or offensive content made available by Customer, nor for any action taken to restrict access to material made available in violation of any law, regulation or rights of a third party, including but not limited to, rights under the copyright law and prohibitions on libel, slander and invasion of privacy.
